50A Application to VCAT for review of decision as to disability (1) The following persons may apply to VCAT for a review of a decision under section 50(1)— (a) the person who made the request for access to disability services under section 49(1); (b) the person in respect of whom the request under section 49(1) was made. (2) An application under subsection (1) must be made within 28 days after the person is notified of the decision under section 49(4). (3) On an application under subsection (1), VCAT may— (a) confirm the decision; or (b) order that the decision be substituted by the decision of the Tribunal; or (c) remit the matter to the Secretary for further consideration in accordance with this Act. (4) A decision of VCAT under subsection (3)(b) has effect as if it were the decision of the Secretary.
