245 Continuation of safety screening requirements for notifications about persons providing services to NDIS participants (1) This section applies if, immediately before the commencement day— (a) a person had a safety screening that was current in accordance with the safety screening requirements; and (b) a notification or complaint had been made to the Secretary that is relevant to that person's suitability to provide services under the NDIS to NDIS participants; and (c) the complaint or notification had not been finally dealt with in accordance with the safety screening requirements. (2) Despite the amendment of this Act by section 194 of the **Worker Screening Act 2020**— (a) the Secretary may investigate the complaint or notification; and (b) the safety screening requirements continue to apply for 3 months after the commencement day to the extent necessary to enable the notification or complaint to be investigated. ***safety screening requirements*** means the safety screening requirements for persons employed or engaged, or to be employed or engaged, by registered NDIS providers for the purpose of providing services to NDIS participants set out in the safety screening policy issued by the Secretary, as in force immediately before the commencement day.
