What it does
This instrument, the Director Identification Number Laws (Other Government Bodies) Disclosure Framework 2022, authorises a limited set of disclosures of protected director identification information held by the Commonwealth Registrar. It is made under section 1270K of the Corporations Act 2001 and section 16 of the Commonwealth Registers Act 2020 and comes into operation the day after registration (see the instrument's commencement clause). The instrument identifies the class of information covered as "director ID information" and specifies four permitted categories of disclosure: to officials of PGPA bodies for use in the course of their official duties (s 5(1)(a)); to courts and tribunals subject to section 1270Q of the Corporations Act and section 21 of the Commonwealth Registers Act (s 5(1)(b)); to State or Territory employees (including local government) for use in the course of their official duties in relation to a government entity (s 5(1)(c)); and to taskforce officers for purposes of a multi‑agency taskforce (s 5(1)(d)). The instrument provides that authorised disclosures will not require payment of a fee and will generally be provided electronically (s 5(2)). It also states that those disclosures, when made in accordance with the instrument, would otherwise have exposed the disclosing person to criminal liability under subsection 1270L(1) of the Corporations Act and subsection 17(1) of the Commonwealth Registers Act but are permitted by operation of this instrument (s 5(3)). The instrument expressly does not compel disclosure; it authorises disclosure but does not create an obligation to disclose (s 5(4)). It also sets a procedural expectation for individuals seeking to prevent disclosure under the statutory non‑disclosure processes , they must show that the detrimental consequence from disclosure outweighs the benefit to other government bodies (s 6). Finally, the instrument repeals an earlier disclosure framework instrument from 2021 (s 7).
