86 Participating entities to maintain insurance as directed by the Digital ID Regulator

(1) The Digital ID Regulator may, in writing, direct an accredited entity that is participating in the Australian Government Digital ID System to maintain adequate insurance against any liabilities arising in connection with the obligations under section 85. (2) If the Digital ID Regulator gives a direction to an entity under subsection (1), the direction is taken to be a condition imposed under paragraph 64(2)(a) on the entity’s approval to participate in the Australian Government Digital ID System. (3) A direction given under this section is not a legislative instrument.
