34 APP‑equivalent agreements

(1) The Minister may, on behalf of the Commonwealth, enter into an agreement (an APP‑equivalent agreement) with an entity covered by subsection (2) that prohibits the entity from collecting, holding, using or disclosing personal information in any way that would, if the entity were an organisation within the meaning of the Privacy Act 1988, breach an Australian Privacy Principle. (2) The entities are as follows: (a) a department or authority of a State; (b) a department or authority of a Territory. (3) The Minister must provide the Information Commissioner with a copy of an APP‑equivalent agreement within 14 days after it is entered into.
