What it does
This Determination, issued under subsection 24(3) of the Public Service Act 1999, preserves the terms and conditions of employment for Senior Executive Service employees who are moved between APS agencies to implement the Administrative Arrangements Orders made by the Governor-General in Council on 18 September 2013, as amended on 3 October 2013. It applies to a Senior Executive Service employee who has been, or will be, moved from an APS Agency known as the Losing Agency to another APS Agency known as the Gaining Agency by a determination in writing under section 72(1)(a) of the Public Service Act 1999. The instrument also covers a Senior Executive Service employee moved from the Australian Agency for International Development, referred to as AusAID, to the Department of Foreign Affairs and Trade, referred to as DFAT, by a determination under section 72(1)(a) to give effect to the order made on 17 October 2013 under section 65 of the Public Service Act 1999, which abolished AusAID as an Executive Agency on 1 November 2013. In the case of such a Moving Aid Employee, AusAID is defined as the Losing Agency and DFAT as the Gaining Agency.
The Determination takes effect on and from 18 September 2013. It continues in force until it is replaced in its entirety by another determination made under section 24(3) of the Public Service Act 1999 or until it is revoked. It ceases to apply to an employee if an Agency Head makes a determination under section 24(1) that is expressed to replace this Determination in its entirety, if the Agency Head and the employee enter into a written common law agreement expressed to replace this Determination in its entirety, if an enterprise agreement that covers the employee commences operation, or if the employee commences employment in an APS agency that is not a Gaining Agency to which the employee was moved under section 72(1)(a). Employees to whom this Determination applies are not covered by any enterprise agreement other than one that commences operation after the date on which this Determination takes effect.
