19Owner of unregistered design

##### 19 Owner of unregistered design (1) Subject to this section, the author of a design is the owner of the design. (2) Where, in accordance with an agreement for valuable consideration entered into by a person with another person, the other person or an employee of the other person acting in the course of his employment makes a design for the first‑mentioned person, the first‑mentioned person is the owner of the design. (3) Subject to subsection (2), where a design is made by a person in the course of his employment with an employer, the employer is the owner of the design. (4) The owner of a design or the assignee of any interest in a design may, by instrument in writing signed by him or on his behalf, assign to another person the whole or any part of his interest in the design. (5) In this section, design does not include a registered design.
