#### 56 Recovery of amounts paid: false or misleading information Scope (1) This section applies if: (a) an amount is paid purportedly by way of a payment of dental benefit; and (b) as a result of the giving of false or misleading information, the amount paid exceeds the amount (if any) that should have been paid. Debt due to the Commonwealth (2) The amount of the excess is recoverable as a debt due to the Commonwealth from: (a) the person by or on behalf of whom the information was given; or (b) the estate of that person. > Note: See section 56D for review of decisions. (3) Subsection (2) applies: (a) whether or not the amount was paid to the person by or on behalf of whom the information was given; and (b) whether or not any person has been convicted of an offence in relation to the giving of the information. Form of information is immaterial (4) For the purposes of this section, it is immaterial whether the false or misleading information is given: (a) in a document; or (b) in a statement; or (c) in any other form.
