What it does
This instrument, titled the Defence Trade Controls (Foreign Country) Instrument 2024, operates as a schedule-style legislative instrument that does two discrete mechanical things: it specifies a list of foreign countries for the purposes of paragraph 15(4)(c) of the Defence Trade Controls Act 2012 (the Act), and it repeals the earlier instrument that performed that listing function. The instrument identifies itself (s 1), specifies a commencement date of 1 September 2024 (s 2), and records its statutory authority as subsection 15(4A) of the Act (s 3). Section 4 records the standard schedule operation rule that any instrument referred to in a Schedule is amended or repealed as set out in the Schedule and that other items in a Schedule have effect according to their terms.
Substantively, section 5 supplies a table of 31 foreign countries which are declared "specified for the purposes of paragraph 15(4)(c) of the Act." The list is set out as a numbered table of items 1 to 31 and names: Argentina; Austria; Belgium; Bulgaria; Canada; Czech Republic; Denmark; Estonia; Finland; France; Germany; Greece; Hungary; India; Ireland; Italy; Japan; Latvia; Lithuania; Luxembourg; Netherlands; New Zealand; Norway; Poland; Portugal; Republic of Korea; Spain; Sweden; Switzerland; United Kingdom; United States of America. The instrument makes no other substantive changes to the Act itself and does not amend the Act’s text; it operates by specifying which foreign countries are "specified" for the single cross-reference in paragraph 15(4)(c).
Schedule 1 contains a single item titled "Repeals", and that item expressly repeals "Defence Trade Controls Act 2012 - Foreign Country List", being "the whole of the instrument." Thus the 2024 instrument replaces the previous instrument that performed the same listing function. The instrument contains no separate explanatory material, definitions, or transitional provisions beyond the commencement date, and it contains no penalty provisions. Its legal effect is therefore focused and administrative: on and from 1 September 2024 the list of countries in s 5 is the operative list for the specified purpose in paragraph 15(4)(c) of the Act, and the prior instrument is removed from the statute book by Schedule 1.
