The Guidelines rely on a small set of interlocking concepts that determine eligibility assessments under the Act: "commitments on the home", "income", partnered versus not partnered status, "gross weekly income", and a set of "hardship factors" the Secretary must consider (cl 4; cls 5-7).

• Commitments on the home. This term is defined to include mortgage instalments, homeowner’s insurance, property rates, taxes, charges or other outgoings, body corporate or retirement village management fees, instalments of loans raised for essential repairs, and any other financial commitment relating to a home which the Secretary is satisfied is extraordinarily high and justified to include (cl 4, definition of commitments on the home). The definition therefore covers both ongoing housing carrying costs and specific repair-loan repayments, and it gives the Secretary discretion to expand the category where an extraordinary, justified commitment exists.

• Income and gross weekly income. "Income" is defined by a list of included items (salary, other employment income, investment income, veterans’ pensions, social security payments, workers compensation, superannuation) and a residual clause allowing inclusion of other amounts if the Secretary is satisfied they are income; it also expressly excludes child allowances, philanthropic contributions and board paid by immediate family residing in the principal home (cl 4, definition of income). The Guidelines frame the threshold tests using "gross weekly income" (cls 5-6), so the listed income streams must, in practice, be converted into a weekly gross measure for the comparison.

• Partnered status. The financial tests differ depending on whether an applicant is partnered or not. For partnered applicants, the test uses combined gross weekly income for both partners and the commitments on the couple’s principal home (cls 5(b)(i), 6(b)(i), 7(a)). For individuals, the test uses the person’s gross weekly income and commitments for their principal home (cls 5(b)(ii), 6(b)(ii), 7(b)). The Guidelines therefore require the Secretary to determine partnership status for the relevant assessment period.

• Percentage thresholds and comparison to average earnings. For "financial hardship" the numerical threshold is whether weekly commitments are more than 30% of gross weekly income (cl 5(b)). For "serious financial hardship" the threshold is whether weekly commitments exceed 100% (i.e. exceed gross weekly income) (cl 6(b)). The Guidelines identify an additional hardship factor, comparing the applicant’s (combined) gross weekly income with the average weekly earnings for an adult in full‑time employment in the State or Territory where the principal home is located (cl 7(a)-(b)). That provides a contextual benchmark for low earnings.

• Mandatory matters to have regard to. The Secretary "is to have regard to" the hardship factors in section 7 when deciding both hardship and serious hardship (cls 5(a), 6(a)). The phrase "is to have regard to" prescribes matters the decision‑maker must consider, while the Guidelines preserve discretionary evaluation , they do not convert the factors into formulaic determinative rules beyond the numerical thresholds.

Key operational consequences for decision-makers are that the Secretary must identify and quantify the applicant’s eligible income and commitments, ascertain partnered status and location of the principal home, compare commitments to the specified percentage thresholds, and address the discrete hardship factors (including consideration of alternatives to reduce commitments and any special circumstances such as health or employment). The instrument gives the Secretary discretion to include atypical income or commitments if satisfied they should be counted, which creates a case-by-case assessment rather than a closed list rule (cl 4).

The Guidelines affect persons whose financial circumstances are under consideration under sections 20, 21 or 23 of the Defence Service Homes Act 1918. The instrument itself frames its operation as guidance "for the purposes of section 20 or 23" (financial hardship, cl 5) and "for the purposes of section 21" (serious financial hardship, cl 6), so the primary affected population is applicants or beneficiaries of measures under those Act provisions. The text does not restate the contents of ss 20-23 of the Act; it operates as a decision-making framework for the Secretary where those sections are engaged (cl 3).

Who pays. Financially, the Guidelines delineate which payments and outgoings are to be treated as "commitments on the home" when assessing hardship. The listed categories identify who must meet recurring housing costs in the absence of relief: mortgage instalments, homeowner’s insurance, property rates, taxes, charges or other outgoings, body corporate or retirement village fees, and instalments on loans for essential repairs (cl 4, definition of commitments on the home). Individuals in receipt of veterans’ pensions and social security payments, workers compensation, superannuation or other listed income streams are those whose income will be measured against housing commitments under the Guidelines (cl 4, definition of income).

Who decides. The Secretary of the Department of Veterans’ Affairs is the decision-maker. The instrument defines "Secretary" as the Secretary of the Department of Veterans’ Affairs (cl 4). The Guidelines repeatedly allocate functions to the Secretary , for example, the Secretary "is to have regard to" the hardship factors (cls 5(a)-6(a)) and the Secretary has a residuary power to include other financial commitments or other amounts as income provided the Secretary is satisfied they are extraordinarily high or that they are income respectively (cl 4, definitions).

Who must provide information. The Guidelines do not prescribe a formal application form or a list of documentary evidence, but they require the Secretary to assess items such as weekly commitments and gross weekly income and to have regard to attempts to reduce commitments and other factors (cls 5-7). Practically, affected persons seeking a hardship finding under the Act will need to present information on their mortgage and other home commitments, income sources, partnership status, location of the principal home, any attempts to negotiate with lenders or obtain alternative financing, and relevant personal circumstances such as health or employment. The Guidelines themselves do not set out procedural requirements for evidence or timelines.

Geographic reach and benchmarks. The Guidelines introduce geographic differentiation by reference to "the State or Territory in Australia in which their principal home is located" when comparing gross weekly income against average weekly earnings (cl 7(a)-(b)). This means the Secretary’s assessment will take account of the State/Territory context of the principal home, which is material to the hardship factors.

Excluded items. The definition of income excludes several items from the gross weekly income calculation: an allowance or payment for a dependent child, a contribution from a philanthropic organisation, and board paid by an immediate family member living in the principal home (cl 4, paragraphs (i)-(k)). Persons receiving such payments should expect those amounts not to be treated as income for the numerical tests in the Guidelines unless the Secretary exercises discretion under the residual clause.

In short, the Guidelines affect applicants under specified sections of the Act, the Secretary as the decision-maker, and, indirectly, lenders and service providers whose fees and charges are counted as commitments when assessing hardship.

The Guidelines impose binding duties on the Secretary regarding the matters the Secretary must consider when assessing hardship and serious hardship. They do not articulate rights in statutory form for applicants, but they specify the decision framework the Secretary must apply. The operative duties are:

• Duty to have regard to specified factors. For both hardship and serious hardship decisions, the Secretary "is to have regard to" the hardship factors set out in section 7 (cls 5(a), 6(a)). Those factors are identified and described in section 7 and include income benchmarks, potential avenues to reduce commitments, success in obtaining alternative financing, and any other factors the Secretary considers relevant, including health and employment (cl 7).

• Duty to apply the numerical thresholds. The Secretary is required to apply the numerical tests when deciding hardship or serious hardship: a more-than-30-per-cent-of-gross-weekly-income test for hardship (cl 5(b)), and a greater-than-100-per-cent-of-gross-weekly-income test for serious hardship (cl 6(b)). The tests differ for partnered and not‑partnered persons: partnered tests combine incomes and look at commitments on the couple’s principal home (cl 5(b)(i), 6(b)(i)); not-partnered tests look to the individual’s gross weekly income and the commitments on that person’s principal home (cl 5(b)(ii), 6(b)(ii)).

• Duty to consider specified categories of commitments and income. The Secretary must use the defined categories of "commitments on the home" and "income" as the primary inputs to the numerical comparisons, subject to the Secretary’s residual discretion to include other amounts if satisfied (cl 4). The instrument defines specific commitments (mortgage instalments, insurance, rates, body corporate fees, loan instalments for essential repairs) and specific income categories (salary, investment income, veterans’ and social security pensions, workers compensation, superannuation). It also expressly excludes certain items from income (dependent child allowances, philanthropic contributions, board from immediate family) (cl 4).

• Residual discretion. The Secretary may include an additional financial commitment or an additional amount as income if satisfied that it is extraordinarily high and justified to include (for commitments) or satisfied that it is income and justified to include (for income) (cl 4). That is a discretionary evaluative task requiring the Secretary to be "satisfied" of the appropriate factual matters before expanding the base calculations.

Rights implied by the instrument. The Guidelines do not create express statutory entitlements for applicants; rather they create procedural and substantive requirements binding on the Secretary when undertaking statutory decision-making under the Act. From the instrument alone, affected persons have the "right" to have the Secretary assess their case by reference to the defined categories and the specified hardship factors, and to have the Secretary apply the numerical thresholds where appropriate (cls 5-7). The Guidelines, by prescribing the matters that must be regarded to, constrain the Secretary from ignoring those listed factors.

Matters the Secretary must examine include avenues for reducing commitments. The Guidelines direct the Secretary to have regard to whether there are options such as renegotiating the loan repayment term or other means to reduce instalments, and whether attempts to obtain alternative financing have succeeded (cl 7(c)-(d)). Therefore the Secretary must at least consider the availability or prior use of such lender negotiations or alternative financing when forming a view.

Limits on discretion and uncertainty. The Guidelines contain multiple instances where the Secretary's subjective satisfaction is required before broadening the definitions (cl 4). The duties are phrased as "is to have regard to" rather than as binding formulae for outcomes, and they include residual, discretionary clauses. That establishes an administrative standard of consideration rather than a deterministic outcome.

In sum, the Secretary has a duty to assess hardship and serious hardship under the Act by applying the specified numerical tests and by considering the named hardship factors. Applicants have the de facto right to have their circumstances assessed against these rules, and the Secretary has discretion to include non-standard items where satisfied they are appropriately treated as commitments or income.

The Guidelines themselves do not create criminal offences, civil penalties, or an enforcement regime. The instrument is framed as guidance for the Secretary in performing statutory functions under the Defence Service Homes Act 1918 and does not prescribe sanctions or enforcement mechanisms in its text (cf. cl 3 and cls 5-7).

What the Guidelines do specify is the decision-making standard the Secretary must apply when determining whether a person is suffering financial hardship (for ss 20 and 23 of the Act) or serious financial hardship (for s 21 of the Act). Enforcement of the Guidelines’ requirements occurs through administrative application by the Secretary in exercising the functions conferred by the Act. The Guidelines accordingly operate as internal statutory guidance for administrative decision-making rather than as a penal instrument.

Practical enforcement mechanisms therefore derive from the Act and departmental processes, not from the Guidelines text. The instrument does not state appeal or review rights, nor does it prescribe procedural steps such as notice, evidence requirements, or timelines. Any remedies, review rights or enforcement consequences arising from the Secretary’s decisions would flow from the Defence Service Homes Act 1918 itself and from general administrative law, neither of which is restated in the Guidelines. The Guidelines do not identify sanctions for providing false information or for failing to cooperate.

Administrative compliance. The Guidelines impose an administrative obligation on the Secretary to "have regard to" the identified factors and to apply the numerical thresholds. Failure by the Secretary to take those matters into account when making a decision under the Act could be relevant in an administrative-law challenge or internal review, though the Guidelines do not specify remedies or review paths. The instrument’s command that the Secretary must have regard to particular matters provides a judicially reviewable standard insofar as the Act and administrative-law principles allow, but the Guidelines do not themselves elaborate enforcement procedures or penalties.

Discretionary expansions. The Guidelines give the Secretary discretion to include additional financial commitments or income items if satisfied they meet the specified tests (cl 4). There are no statutory sanctions for errors in exercising that discretion specified in the Guidelines; any challenge to such discretionary inclusions would be via the administrative and judicial review processes available under the general law and the Act.

In short, the Guidelines regulate the Secretary’s approach and inputs to hardship assessments but do not introduce a separate enforcement or penalty regime. Enforcement of the Guidelines is through their application by the Secretary within the statutory framework of the Act and through the administrative-law mechanisms that apply to public decision-making; the Guidelines themselves do not prescribe penalties or formal enforcement steps.

The Guidelines explicitly reference and incorporate other statutory instruments and regimes by definition and by cross-reference. They are made under the Defence Service Homes Act 1918 (cl 3) and operate to guide assessments for particular sections of that Act (ss 20, 21 and 23, as referenced in clauses 5 and 6). Interaction with other laws is therefore twofold: first, the Guidelines sit beneath and operate to interpret how provisions of the Defence Service Homes Act 1918 should be applied; second, the Guidelines expressly draw on other statutes and administrative frameworks when defining income.

Veterans’ affairs law. The Guidelines define "veterans’ affairs law" as an Act, or provision of an Act, that is administered by the Minister for Veterans’ Affairs in accordance with the Administrative Arrangements Order (cl 4). That definition imports, for the purposes of identifying income, the operation of other Acts administered by the Minister. Where a payment is a pension or other payment made under a veterans’ affairs law, the Guidelines treat it as income for the gross weekly income calculation (cl 4(d)). The effect is to include certain veterans’ payments within the income measure as recognised by the ministerial administrative arrangement.

Social Security Act 1991. The Guidelines explicitly include "a pension or other payment made under the Social Security Act 1991" as income (cl 4(e)). That is a direct interaction: social security payments are counted in the gross weekly income for the numerical tests unless specifically excluded by the instrument (and the instrument lists some exclusions). This means that the person’s entitlements under the Social Security Act (as recognised in the defined payments) feed directly into the determination of hardship under the Defence Service Homes Act via the Guidelines.

Comparison to average weekly earnings. The Guidelines require the Secretary to compare the applicant’s (combined) gross weekly income to the "average weekly earnings for an adult in full time employment in the State or Territory in Australia in which their principal home is located" as a hardship factor (cl 7(a)-(b)). That imports an external labour-market statistic or benchmark into the administrative assessment. The Guidelines do not specify the data source or method for identifying that benchmark, but they make it an explicit comparator for the Secretary to consider. Thus the Guidelines interact indirectly with the statistical frameworks (for example labour-force or earnings statistics) relied upon by the Department or other agencies, although the Guidelines themselves do not prescribe which particular dataset is to be used.

Administrative Arrangements Order. The definition of "veterans’ affairs law" expressly depends on what is administered by the Minister for Veterans’ Affairs "in accordance with the Administrative Arrangements Order" (cl 4). That ties the Guidelines to the machinery of executive government that allocates administrative responsibility, and it means that changes to the Administrative Arrangements Order could change which Acts count as "veterans’ affairs law" for the purposes of the income definition.

Excluded items with cross‑statutory significance. The Guidelines exclude certain receipts from the definition of income: dependent child allowances, philanthropic contributions, and board paid by immediate family members living in the principal home (cl 4(i)-(k)). The effective legal interaction here is that payments characterised by those labels under other laws or arrangements are not to be counted as income for the purposes of the numerical tests unless the Secretary exercises the residual discretion to include other amounts as income after being satisfied they qualify (cl 4).

Scope limits. The Guidelines are expressly limited to guiding assessments under ss 20, 21 and 23 of the Defence Service Homes Act 1918 (cl 3, cls 5-6). They do not amend other Acts, nor do they purport to vary the operation of the Social Security Act or the underlying entitlement rules of other laws. They simply set out which payments from those statutory regimes are to be treated as income in the Secretary’s administrative assessment under the Defence Service Homes Act.

In sum, interaction with other laws is concrete and textual: payments under veterans’ legislation and the Social Security Act are defined as income; the Administrative Arrangements Order determines what counts as "veterans’ affairs law"; and a labour-market earnings benchmark external to the Act is imported as a hardship factor. The Guidelines do not specify data sources or enforcement mechanisms beyond the Secretary’s administrative duties under the Act.

The instrument text provided contains the original instrument details: Instrument No. M13 of 2018, approved by the Minister for Veterans’ Affairs Darren Chester, dated 21 September 2018, and commencing 1 October 2018 (Instrument preamble and clauses 1-2). The Guidelines state they are made under subsections 20(4), 21(3) and 23(6) of the Defence Service Homes Act 1918 (cl 3).

No amendments are recorded within the text supplied. The instrument itself does not include any schedule of prior or subsequent amendments, transitional provisions, savings clauses or expiry provisions. The only temporal details contained in the instrument are the approval date (21 September 2018) and commencement date (1 October 2018) (Instrument preamble; cl 2).

Because the instrument defines particular concepts and prescribes decision-making obligations for the Secretary, any subsequent amendments that alter substantive content (for example, the percentage thresholds, the income or commitment inclusions/exclusions, or the hardship factors) would appear as an amending instrument or replacement Guidelines. The present text does not include any such amendments.

Where an amending history is required beyond the instrument text, that history would need to be sourced from consolidated legislative instruments or the department’s instruments register. The instrument itself does not reference prior versions of the Guidelines or indicate that it replaces earlier guidance. The instrument title identifies it as "Defence Service Homes (Hardship) Guidelines 2018" (cl 1), which suggests it is a stand-alone instrument from 2018, but the instrument does not state that it revokes or supersedes any prior instrument.

Therefore, based solely on the supplied instrument text, the amendment history is: Instrument No. M13 of 2018 made 21 September 2018, commenced 1 October 2018; no amendments are recorded in the provided text.

The provided instrument contains no reference to any litigation, case law, appeals or judicial review outcomes. It does not cite any judicial decisions, nor does it summarise court interpretation of its provisions. The text is a stand-alone administrative instrument prescribing decision‑making matters for the Secretary and does not include or reference litigation history.

Because the Guidelines are administrative directions for the Secretary in assessing hardship under particular sections of the Defence Service Homes Act 1918, any litigation relating to the application or interpretation of these Guidelines would arise from the Secretary’s exercise of discretion under the Act and from challenges under administrative law. The instrument itself does not record such challenges, and there are no cases named in the text.

Accordingly, based solely on the instrument as supplied, there is no litigation history to report. Any enquiry into judicial treatment of these Guidelines or of decisions made pursuant to them would need to examine the broader case law under the Defence Service Homes Act 1918 and records of judicial review proceedings, none of which are included in the instrument text.

The instrument’s compact text contains several discrete points that can produce practical pitfalls or points of interpretive friction. Each of the following follows from the express wording of the Guidelines and may have operational implications.

1. Discretionary expansion of the base measures. The definitions for both "commitments on the home" and "income" contain a residual clause allowing the Secretary to include other items if the Secretary is satisfied the item should be included (cl 4, last subparagraphs of each definition). That is a broad "satisfied"‑standard discretion. Applicants should note that amounts not listed may nevertheless be counted if the Secretary is persuaded they are extraordinarily high (for commitments) or are income. Conversely, the Secretary may exclude or decline to include certain items not expressly listed. The discretionary satisfaction test is an evidential hurdle the applicant may need to overcome.

2. Use of gross weekly income but partial definition of "income". The Guidelines use the phrase "gross weekly income" in the numerical tests (cls 5-6) but the definition of "income" lists particular streams and exclusions (cl 4). The instrument does not explicitly define how to convert those listed items into a "gross weekly" figure. For example, salaries, pensions or investment returns measured on different periodicities will need to be converted to a weekly gross amount for comparison. The Guidelines do not prescribe the conversion method or the time periods to be measured, leaving practical measurement to administrative practice.

3. Partnered calculation requires combined numbers and a principal home for the couple. For partnered applicants the Guidelines require the Secretary to compare combined gross weekly income with the couple’s weekly commitments on their principal home (cls 5(b)(i), 6(b)(i), 7(a)). That raises operational questions about what counts as "partnered" and how to treat situations where partners have separate homes or where only one partner is a party to the home loan. The instrument does not define "partnered" or detail how to allocate commitments when multiple residences or shared ownership are involved.

4. Geographic benchmark but no source specified. The hardship factors require comparison to the "average weekly earnings for an adult in full time employment in the State or Territory in which their principal home is located" (cl 7(a)-(b)). The Guidelines do not specify the statistical source, the frequency of updating, or the precise measure (median versus mean, full-time adult versus all employees). That leaves room for administrative discretion or dispute about which published series or dataset the Secretary should use.

5. The 30% and 100% thresholds are absolute numerics but do not account for affordability nuance. The Guidelines require a simple percentage test: more than 30% of gross weekly income for hardship, and exceeding gross weekly income for serious hardship (cls 5-6). However, the Guidelines also require the Secretary to consider other factors (cl 7). That creates possible tension: a person whose commitments are, say, 28% of income might still have other relevant factors, but the numerical test would not indicate hardship under the Guidelines. Conversely, persons crossing the threshold may still face other considerations that the Secretary must weigh in. The Guidelines do not specify the order of weight to be given to numerical thresholds and hardship factors beyond requiring the Secretary to have regard to both.

6. Exclusions from income. The Guidelines exclude payments for dependent children, philanthropic contributions and board paid by immediate family residing in the principal home (cl 4(i)-(k)). Applicants receiving these amounts should be aware they are not to be counted in the numerical gross weekly income calculation under the Guidelines, which may reduce measured income and produce a higher commitments-to-income ratio. The residual clause for "other amount ... if the Secretary is satisfied" could still capture atypical payments, but only subject to the Secretary’s satisfaction.

7. Requirement to consider lender negotiation and alternative financing. The Secretary must have regard to whether there are ways to reduce commitments such as negotiating with a lender, and whether attempts at alternative financing have been successful (cl 7(c)-(d)). This can be read as inviting the Secretary to assess whether an applicant has pursued or could pursue such avenues. Applicants who have not sought lender renegotiation or other finance may therefore be assessed less favourably unless they can justify why those avenues were unavailable or unsuitable.

8. Broad "other factors" clause. Section 7(e) allows the Secretary to have regard to "any other factors that the Secretary considers relevant" including health, employment situation, assets (other than the principal home) and financial commitments not relating to the principal home. This creates a catch-all that preserves wide discretion to consider personal circumstances. That increases uncertainty about which circumstances will be decisive.

9. The Guidelines do not set procedural forms or evidentiary standards. They set substantive considerations but do not specify what evidence applicants must produce or the process steps for decision-making. This places a burden on the administrative practice to develop forms, evidentiary checklists and internal procedures, and may lead to variability in outcomes if the department’s case-handling is inconsistent.

10. No penalties or remedies set out in the Guidelines. The instrument is silent as to remedies, appeal rights or penalties for non-disclosure. Any recourse must be sought under the Act, departmental internal review processes or general administrative law; the Guidelines themselves do not supply procedural redress mechanisms.

These are not evaluative conclusions but textually grounded operational points: the residual discretionary clauses, the defined inclusions and exclusions, the numeric thresholds, the requirement to consider lender negotiation and alternative financing, the geographic benchmark with no source specified, and the absence of procedural detail are all present in the instrument and are therefore practical "gotchas" for applicants and administrators.

Compliance for applicants and for the Department’s decision-makers requires focused preparation and record-keeping targeted at the factors and thresholds the Guidelines prescribe. The Guidelines do not mandate particular forms or documentary lists, but they make clear which subject-matter the Secretary must consider. The following steps follow directly from the text of the Guidelines and describe practical compliance actions grounded in those provisions.

For applicants (persons seeking a hardship or serious hardship finding under ss 20, 21 or 23 of the Act):

1. Identify the principal home and partnership status. The numerical tests hinge on whether the person is partnered and on the location of the principal home (cls 5-7). Applicants should be prepared to demonstrate which property is their principal home and whether they are partnered, because partnered applicants are assessed on combined income and the couple’s home commitments (cl 5(b)(i), cl 6(b)(i)).

2. Compile evidence of all "commitments on the home". The definition lists mortgage instalments, homeowner’s insurance, property rates, taxes, charges, body corporate or retirement village management fees, and instalments of loans for essential repairs (cl 4). Gather mortgage statements showing instalment amounts and schedules, insurance premium invoices, council rates notices, body corporate fee notices, and loan agreements for repair loans. Where an atypical commitment exists that might be "extraordinarily high", prepare documentary evidence and factual explanation to support a claim that the Secretary should include that item under the residual clause (cl 4).

3. Document income streams as defined. The Guidelines list salary and wages, other employment or business income, investment or rental income, veterans’ pensions, social security payments, workers compensation and superannuation as income (cl 4). Assemble pay slips, employment income statements, rental income records, statements of pension or social security payments, workers compensation notices and superannuation payment details. Remember the comparison is to "gross weekly income" so convert periodic payments to a weekly gross figure using a clear, consistent method, and be prepared to show the conversion calculation.

4. Note excluded receipts. If receiving dependent child allowances, philanthropic contributions or board from immediate family members residing in the principal home, recognise these are excluded from "income" under the Guidelines (cl 4(i)-(k)). Do not use these amounts in the gross weekly income calculation unless there is a basis for the Secretary to treat a particular contribution differently under the residual clause.

5. Prepare evidence of attempts to reduce commitments and alternative finance. The Secretary must have regard to whether there are avenues to reduce commitments and whether attempts to obtain alternative financing have been successful (cl 7(c)-(d)). Keep records of negotiations with lenders, correspondence seeking loan term extensions, applications for refinancing, and any responses from lenders. If attempts were not made, prepare a statement explaining why those avenues were unsuitable or unavailable.

6. Provide contextual evidence for other hardship factors. The Secretary is to have regard to other factors including health, employment situation and assets other than the principal home (cl 7(e)). Provide medical certificates, employment notices, redundancy letters, asset schedules, and statements of other financial obligations to substantiate claims about capacity to meet commitments.

7. Address the average weekly earnings benchmark. The Secretary must have regard to whether income is less than the average weekly earnings for a full‑time adult in the State or Territory of the principal home (cl 7(a)-(b)). Although the Guidelines do not prescribe a data source, applicants should identify the State/Territory location and, if possible, provide a relevant official earnings statistic or indicate willingness for the Department to obtain it.

For the Secretary and departmental officers conducting assessments:

1. Establish a consistent conversion method for gross weekly income. The Department will need an internal rule for converting various periodic payments to a weekly gross amount so that the numerical thresholds (30% and exceeding 100%) can be applied consistently (cls 5-6). Document and publish that conversion method in internal guidance or forms to reduce variability.

2. Adopt a transparent approach to residual inclusions. Because the definitions permit the Secretary to include additional commitments or income items only if "satisfied" they meet the relevant test (cl 4), establish evidentiary standards and decision templates explaining when such inclusions will be allowed. Ensure decisions record reasons for satisfaction so the decision‑making trail is clear.

3. Document consideration of the hardship factors explicitly. The Guidelines require the Secretary to "have regard to" the matters in section 7 when assessing both hardship and serious hardship (cls 5(a), 6(a)). Administrative files should include an explicit, itemised assessment against each factor: income relative to State/Territory average weekly earnings; whether avenues to reduce commitments exist; the history and result of attempts to obtain alternative financing; and relevant personal circumstances such as health and employment.

4. Record partnership determinations. Given different tests for partnered versus not partnered applicants, maintain a clear record of how partnership status was determined and how combined income and commitments were calculated (cls 5-7).

5. Identify the State/Territory earnings benchmark source. Although the Guidelines do not name a particular statistical series, choose and document a consistent source for "average weekly earnings for an adult in full time employment" for each State/Territory and note the date of the statistic used in each assessment (cl 7(a)-(b)).

6. Ensure applicants are informed of evidentiary expectations. Because the Guidelines do not define procedural forms or evidence lists, the Department should publish or provide to applicants a list of documents typically required to demonstrate income, commitments and attempts to renegotiate or obtain alternative finance. That will reduce administrative friction and support consistent application of the Guidelines.

7. Maintain decision records suitable for review. The Guidelines impose specific matters the Secretary must have regard to; incomplete consideration of those matters could form the basis for administrative review. Maintain complete decision records that show how numerical comparisons were made and how each hardship factor was considered (cls 5-7).

8. Training and quality assurance. Ensure staff are trained on the interplay between the inclusions and exclusions in the definitions, conversion to gross weekly income, and the exercise of the Secretary’s residual discretion. Implement quality assurance checks to ensure consistent application across cases.

Compliance is therefore a two-way process: applicants must present evidence addressing the specific items the Guidelines require the Secretary to consider, and the Department must adopt consistent evidentiary and decision‑recording practices to operationalise the Guidelines’ textual requirements.
