What it does
This Act creates a statutory, Commonwealth-level exemption from State and Territory road transport laws for certain defence‑related actors and activities, where those activities are performed in accordance with the Australian Defence Force Road Transport Exemption Framework (the Exemption Framework). The primary operative provisions are: an exemption for the Australian Defence Force, its members and defence civilians for actions done or omitted in connection with one or more defence‑related purposes where the thing is required or permitted by the Exemption Framework (s 5(1)); a limited exemption for defence contractors and defence employees operating a defence vehicle that has a specific engineering exemption and only to the extent of that exemption (s 5(2)); and an exemption for foreign armed forces and their members when acting in accordance with an arrangement approved by the ADF and in accordance with the Exemption Framework (s 6). The Act also defines the scope of “road transport law” to which those exemptions can apply, subject to Commonwealth regulations that can include or exclude particular State or Territory laws (s 4). The Exemption Framework itself is incorporated by reference and described as the Australian Defence Force Road Transport Exemption Framework referred to in clause 20 of the Intergovernmental Agreement, and it is explicitly stated to be published on the National Transport Commission’s website and amendable “from time to time” (s 3).
Mechanically, the Act does not create new Commonwealth road traffic offences or new regulatory regimes; it operates by removing the application of State and Territory road transport laws to particular actors and acts when the statutory conditions are met. The Act also preserves the Defence Act 1903 generally but limits the operation of subsection 123(1) of that Act to the extent stated (s 7). The Exemption Framework and any applicable Commonwealth regulations will therefore be decisive in identifying which State and Territory laws are displaced, which activities are permitted or required, and when a contractor or foreign force may rely on the exemption.
