What it does
This instrument, the Defence (Remote ILS/TACAN Site Beermullah Defence Aviation Area) Declaration 2018, declares a mapped area of land near Remote ILS/TACAN Site Beermullah in Western Australia to be a defence aviation area under the Defence Act 1903 (the Act). The Minister for Defence Personnel, Darren Chester, signed the declaration on 16 March 2018 (front page). The instrument is made under subsection 117AC(1) of the Act (s 3) and expressly states that the declared area is “the areas of land in the vicinity of Remote ILS/TACAN Site Beermullah in Western Australia that are depicted on the map” in Schedule 1 (s 5(2)). Areas shown as white space on the map are excluded from the declared area (s 5(3)).
The instrument also specifies that height restrictions apply to buildings, structures and objects (including trees and other natural obstacles) within the declared area for the purposes of subsection 117AC(3) of the Act (s 6(1)). The particular height restrictions are not set out in the body text; instead they are contained in the legend to the map in Schedule 1 and apply in the corresponding depicted areas (s 6(2)). The Schedule therefore performs two mechanical functions: (a) define the geographic boundaries by map rather than by coordinates, and (b) carry the legend that sets the height limits applicable to sub-areas within the map.
The instrument’s commencement is not simply “on signing”; it commences at the same time as the Defence Legislation Amendment (Instrument Making) Act 2017, Schedule 1, Part 2 (s 2). The instrument contains no standalone statement of enforcement, penalty, compensation or procedural approvals; it relies on the statutory power in s 117AC of the Act. The instrument also incorporates the Act’s definitions by reference (s 4), noting that expressions such as “defence aviation area” are defined in section 4 of the Act. In short, the instrument (a) declares a mapped defence aviation area, (b) attaches map-based height restrictions to it via the map legend, and (c) relies on the Defence Act for substantive effect and any enforcement mechanisms.
