41 Provisions relating to courts
(1) If, on any application to a court under this Part, any objection (based on the amount of principal or purchase money outstanding, or on the value of the matter at issue) is taken to the jurisdiction of the court, the court shall determine the objection summarily, but the decision of the court does not operate as an estoppel between the parties or their privies in any subsequent proceeding. (2) An order made by a court under this Part shall not be appealed against, questioned or reviewed in any manner whatsoever, or be restrained or removed by prohibition, injunction, certiorari or otherwise howsoever, by reason of any want of jurisdiction arising out of the amount of principal or purchase money outstanding, or the value of the matter at issue, as the case may be. (3) The regulations may make provision for or in relation to the taking by a court to which an application is made under this Part of evidence from a person who is not readily available to appear before, and give evidence orally to, the court and, in particular, may restrict the powers of the court to require such a person so to appear and give evidence.
