What it does
This instrument, the Defence (Payments to ADF Cadets) Determination 2023, establishes the statutory framework by which certain payments and expense reimbursements may be made in connection with participation in activities of the ADF Cadets. The instrument is made by the Chief of the Defence Force under subsection 62B(1) of the Defence Act 1903 (s 3). It commences on the day after registration (s 2) and repeals the earlier 2022 Determination (Schedule 1).
Mechanically, the Determination does four main things. First, it creates an application regime: an officer or instructor in the ADF Cadets may apply, in writing, to an authorised person for either a daily amount or for an expense that has been, or will be, incurred in respect of participation in ADF Cadets activities (s 6(1)). Second, it fixes who decides the size of payments: the amount payable for daily participation is set by the Chief of Personnel by notifiable instrument, and amounts for expenses are likewise limited to amounts approved by the Chief of Personnel by notifiable instrument (s 7(1)-(2)). Third, it provides recovery mechanics: if an amount is paid but the expense is not in fact incurred, the amount becomes a debt due to the Commonwealth and is recoverable in court (s 8). Fourth, it creates a separate exceptional‑circumstances route allowing a defined list of senior decision makers to authorise payments for cadets, officers or instructors, and other adult volunteers where they are satisfied that exceptional circumstances exist; amounts in that route are set by the decision maker (s 9(1)-(3)).
The Determination leaves several operational details to further instruments and internal processes. It defines basic terms used in the instrument (s 4), permits the Chief of Personnel to determine other matters relating to eligibility by notifiable instrument (s 6(4)), and allows the Chief of Personnel to authorise persons, by notifiable instrument, to approve applications under s 6 (s 10). The use of "notifiable instrument" for amounts and delegations embeds administrative discretion to set monetary levels and approve delegations without these figures appearing in the Determination text itself (s 7(1)-(2); s 10). The instrument therefore sets a statutory shell: entitlement and process, with substance delegated to notifiable instruments and to authorised decision makers identified in the Determination.
