Defence Forces Retirement Benefits (Pension Increases) Act 1973

The central concept is the prescribed percentage, defined by a two‑limb formula. The first limb is 1.4 times the CPI increase: (A - B) / B × 100, where A is the CPI for March quarter 1973 and B for June quarter 1971. That figure is then multiplied by 1.4. The second limb is the AWE increase: (C - D) / D × 100, where C is AWE for March quarter 1973 and D for June quarter 1971. The prescribed percentage is the lower of those two results. This structure means that if wage growth is lower than 1.4 times CPI growth, the wage growth cap operates; if wage growth is higher, the CPI‑based cap (1.4×) operates. The choice of 1.4 as the multiplier is arbitrary but ensures a degree of real wage catch‑up if prices have risen faster than wages. The rounding rule in section 4(4) adds a small fudge: fractions below 0.05 per cent are dropped, and fractions 0.05 per cent or above are rounded up to 0.1 per cent. Section 4(3) provides that if the Commonwealth Statistician later substitutes a revised index number for either reference quarter, the later publication is disregarded. This fixes the data to the originally published numbers, avoiding endless recalculations if series are revised.

A second key concept is the definition of pension in section 4(1): it means a pension payable under the DFRB Act immediately before 1 July 1973 in respect of the retirement or death of a contributor on or before 30 September 1972. The date limits exclude anyone who retired after 30 September 1972. This creates a cut‑off: even if someone retired in October 1972 and started receiving a pension before 1 July 1973, they get no increase under this Act. The policy rationale was likely that later retirees had less time for inflation erosion, but the Act does not state that.

The third concept is the adjustment of increase for recent retirements under section 7. If the pension is payable in respect of a retirement or death that occurred on or after 1 October 1971, or a section 82ZB pension that became payable on or after that date, the increase is prorated. The proportion is the number of complete months from the day after the retirement or death (or the date the pension became payable) to 30 June 1973, divided by 21. Those 21 months represent the period from 1 October 1971 to 30 June 1973. Practically, someone who retired in March 1973 would only get 3 or 4 months worth of the increase, not the full amount. Section 7(3) cuts off entitlement entirely if the pension became payable after 15 June 1973 - just 15 days before the reference date. This reflects the drafter’s intention to exclude anyone who had only just started receiving a pension, as inflation would have had negligible time to erode value.

Section 6 extends the increase to suspended pensions under section 53B of the DFRB Act. If a pension is suspended (for example, because the pensioner re‑enlisted or was otherwise not entitled to receive payments), it is treated as still payable for the purpose of calculating the increase, but the increase does not apply during the suspension period itself. That means when the suspension ends, the increased rate applies prospectively.

The primary affected group is former contributors to the Defence Forces Retirement Benefits scheme who retired or died on or before 30 September 1972, and who were receiving a pension immediately before 1 July 1973. This includes widows of deceased contributors, as section 4(5) deems a widow’s pension to be payable in respect of the contributor’s retirement. Widows are therefore entitled to the increase on the same terms as the contributor would have been. The Act explicitly excludes pensions payable to or in respect of an eligible child (section 5(1)), so children’s benefits are not increased by this legislation. That exclusion might reflect a view that children’s benefits were subject to different cost drivers or that the increase was intended only for those who had already reached adult retirement. Recipients of invalidity pensions under section 52 of the DFRB Act are within scope if their retirement date qualifies. Section 9 provides a special rule for when such a pensioner is reclassified after 1 July 1973: the rate payable after reclassification is calculated as if the reclassification had taken effect on the day immediately before 1 July 1973, using the increased rate. This ensures that the reclassification does not cause a loss of the inflation increase.

On the administrative side, the Act affects the Defence Force Retirement and Death Benefits Authority (under the DFRB Act) and the Commonwealth’s budget and finance departments. The increase is paid out of the Consolidated Revenue Fund (section 11), which means it is a direct charge on taxpayers, not funded from a specific trust account. Although the amount per pensioner may be modest, the aggregate cost depends on the number of eligible pensions and the prescribed percentage. The fund appropriation is open‑ended - section 11 simply says amounts are payable out of the CRF, which is appropriated accordingly. There is no cap on total expenditure. This introduces a fiscal risk if CPI or AWE movements are large, but in practice the government would have estimated the cost before introducing the Bill. The Act also affects banks or financial institutions that process pension payments, as they need to implement the increased amounts from 5 July 1973.

The Act does not affect serving members who had not retired by 30 September 1972, nor those who retired after that date. Those individuals were presumably covered by later pension increase acts (such as the Defence Forces Retirement Benefits (Pension Increases) Act 1974 or subsequent annual acts). The narrow scope means the Act has a diminishing relevance over time - as eligible pensioners die, the number of recipients falls. But for the original cohort, it provided a permanent increase to their base pension rate, which would then be carried forward into any future indexation.

The primary right created is the entitlement of an eligible pensioner to an increase in the annual pension under section 5(1). This right is unconditional upon the CPI and AWE conditions being satisfied - which they were in 1973, given the high inflation of that period. The pensioner does not need to apply; the administering authority must calculate and pay the increase automatically. Section 10 imposes important limitations on the right to commute the increased portion. Section 74 of the DFRB Act ordinarily allows a pensioner to commute a portion of their pension into a lump sum, but that authority does not extend to the increase granted by this Act. In other words, the increase cannot be commuted at all - it must remain as a stream of pension payments. If a pensioner commutes part of their ordinary pension after 1 July 1973, the increase is recalculated proportionally. Under section 10(2), the new increase is the same fraction of the full increase as the pre‑commutation pension that continued to be payable bears to the original pension. This prevents a pensioner from commuting the base pension and retaining the full increase, which would be windfall. The duty on the authority is to adjust the increase accordingly.

Section 7 imposes a duty on the authority to prorate the increase for pensions that began within the 21 months before 30 June 1973. The authority must calculate the number of whole months from the qualifying event to that date, applying the rounding rules in section 7(4) and (5). If the period is less than one month, it is treated as one month (so a very recent pension gets a minimal increase). If the period is a whole number of months plus a part month, the part is dropped if less than half a month, or counted as a full month if half or more. This duty requires careful record‑keeping of exact retirement or death dates.

The widow’s right under section 4(5) is to have her pension treated as arising from the contributor’s retirement, so she qualifies if the contributor’s retirement or death was on or before 30 Sep 1972. The authority must apply this deeming rule.

Under section 6, for suspended pensions, the authority must treat the pension as payable for calculation purposes but must not pay the increase for the period of suspension. When the suspension ends, the increased rate becomes payable. The duty is to track suspension periods accurately.

Section 11 imposes a duty on the Commonwealth to appropriate amounts from the Consolidated Revenue Fund. This is a right of the administering authority to draw funds, and a right of pensioners to have payments honoured.

The Act contains no specific penalty provisions. There are no criminal offences, no civil penalties, and no provisions for overpayment recovery. Enforcement is therefore limited to administrative and legal mechanisms that exist under general law or under the DFRB Act. If the administering authority fails to pay the correct increase, a pensioner could seek judicial review or a declaration that the entitlement has been wrongly denied. Given that the increase is formula‑based and mechanical, disputes would likely turn on questions of fact - whether the correct CPI or AWE figures were used, whether the rounding rules were applied correctly, or whether a particular pension fell within the temporal scope. The absence of penalty provisions does not mean there are no consequences for non‑compliance; the government would be exposed to breach of statutory duty and potential interest on arrears. However, the Act does not provide a statutory interest mechanism for delayed payments.

Overpayments are not addressed. If a pensioner receives an increase they were not entitled to - for example, because their retirement date was after 30 September 1972 but the error went undetected - the Act does not explicitly authorise recovery. The general law of restitution and the DFRB Act’s own overpayment provisions might apply, but this Act is silent. Similarly, underpayments are not dealt with; a pensioner would need to pursue a claim through administrative channels or the courts. The only enforcement lever available to the Commonwealth is the requirement that increases be paid out of the Consolidated Revenue Fund - if an overpayment occurs, it is a debt due to the Commonwealth and can be recovered under the Financial Management and Accountability Act (or its predecessors). But that is external to this Act.

The lack of a penalty regime suggests the drafters regarded the increase as a self‑executing entitlement that would be paid correctly by the bureaucracy. It also reflects the era when pension administration was less litigious. Modern readers should note that the Act’s simplicity may conceal enforcement gaps. If a pensioner’s record is lost, there is no prescribed time limit for claiming the increase. The Act does not impose a limitation period, so arguably the right to arrears could be asserted many years later. This creates latent liability for the Commonwealth, though in practice most pensioners would have claimed promptly.

By virtue of section 3, this Act is incorporated and read as one with the Defence Forces Retirement Benefits Act 1948‑1973. That means all definitions from the DFRB Act apply unless the contrary intention appears. For example, terms such as “contributor”, “eligible child”, and “section 82ZB pension” derive from that Act. The interpreter must refer to the DFRB Act to understand who is a contributor and what section 82ZB provides. The incorporation also means that any future amendments to the DFRB Act that apply to this Act would affect the increase provisions, unless expressly excluded. However, the 1973 Act is a standalone law; later pension increase acts (e.g., 1974, 1975) would operate separately, but may have their own incorporation clauses.

Section 8 explicitly modifies certain sections of the DFRB Act for the purposes of calculating widow pensions. When a widow is entitled to a pension under paragraph 55(1)(b) or 57(1)(b) (which refer to the widow’s share of a reversionary pension), the amount of the deceased contributor’s pension that is used in the calculation must include any increase under this Act. Without this modification, the increase might be disregarded, reducing the widow’s entitlement. Similarly, subsection (2) ensures that if a widow dies and a subsequent pension is payable to children, the increase is taken into account in the notional widow’s pension. Subsection (3) extends this to cases where a wife is divorced or dies. These modifications ensure that the increase flows through to derivative beneficiaries and does not become orphaned by technical provisions.

Section 10 restricts section 74 of the DFRB Act (commutation). The general commutation power does not extend to the increase. This creates a bifurcation: the base pension may be commuted, but the increase must remain as a pension. That interaction could complicate estate planning for pensioners. If a pensioner commutes a portion of the base pension, the increase is reduced proportionally under section 10(2). This ensures that the increase is not a free add‑on that survives commutation in full.

The Act does not interact with income tax legislation, superannuation guarantee laws, or social security laws directly. However, pension increases may affect a recipient’s assessable income under the Income Tax Assessment Act. That is an external interaction not addressed here. The Act also does not interact with the Defence Force (Retirement and Death Benefits) Act 1973, which replaced the DFRB scheme for new entrants from 1973 onward. This Act is a transitional measure for the old scheme.

The Act as reproduced appears to be the original version assented to on 19 June 1973. No amendment history is included in the source text. It was Number 85 of 1973. Over time, the DFRB scheme was replaced by subsequent schemes and the 1973 Increase Act would likely have been repealed or become obsolete once all eligible pensions ceased. However, the source does not indicate any repeals or amendments. In practice, the Act would have been amended by later parliamentary actions, such as the Defence Forces Retirement Benefits (Pension Increases) Act 1974 and others, which adjusted pensions for later years. Those later acts may have amended the definitions, formulas, or scope. Without the full statute history, we cannot confirm. The user’s source is the original enactment only.

The Act may have been repealed by the Statute Law Revision Act or by a consolidation act. However, given its narrow scope, it likely remains on the statute books as spent legislation, still applicable for any remaining pensioners from the 1972 cohort. The rounding rules and formula are fixed in time; they are not updated. Therefore, the Act is a product of its era - a one‑off rather than a continuing indexation code. Future governments could have repealed it without affecting current pensioners, because the increases were already incorporated into the DFRB Act’s benefit rates by subsequent amendments.

The Act also has a curious feature: it refers to “the estimate of the seasonally adjusted average weekly earnings per employed male unit throughout Australia published by the Commonwealth Statistician in respect of the March quarter of the year 1973”. This is a sex‑specific statistic, reflecting the employment composition of the early 1970s. Later indexation measures shifted to broader measures, but this Act is frozen.

The source text provides no information about any litigation arising from this Act. Without a legal database search, it is impossible to name specific cases. However, we can observe that the Act’s mechanical nature and precise definitions make it unlikely to generate much dispute. The main potential grounds for litigation would be:

• Whether a particular person is a “contributor” under the DFRB Act and whether their retirement or death occurred on or before 30 September 1972. These are questions of fact.
• Whether the CPI or AWE numbers used were the correct ones, especially with the substitution rule in section 4(3). If the Statistician published two series, the Act directs disregard of the later series. Disagreement could arise if the authority used an updated series.
• Whether the rounding rules were correctly applied to the prescribed percentage.
• Whether the increase was properly reduced under the prorating provisions of section 7, particularly the definition of “became payable” for section 82ZB pensions.

Given the age of the Act, any litigation would have been historical. The High Court may have considered the interpretation of similar pension increase acts in other contexts. But no specific case is cited in the Act itself. A diligent researcher would need to check Commonwealth Law Reports or AILR. For this deep dive, grounded in the source, we can only note the absence of any incorporated litigation reference.

The Act does not create any private right of action for non‑payment; any suit would be for mandamus or declaratory relief. The lack of enforcement provisions suggests the Commonwealth would have complied voluntarily.

Several traps emerge for the unwary administrator or pensioner. First, the increase is not the prescribed percentage of the full pension; it is the prescribed percentage of 77.5 per cent of the pension. This fractional multiplier can be overlooked. For example, if the prescribed percentage is 10 per cent, the increase is 7.75 per cent of the pension, not 10 per cent. A pensioner who expects a full CPI‑linked uplift will be disappointed. The reason for the 77.5 per cent is not given; it likely corresponds to the original benefit fraction. But it creates a permanent reduction in the real inflation catch‑up compared to a full‑pension indexation.

Second, the cut‑off date of 30 September 1972 for retirement or death is absolute. Someone who retired on 1 October 1972, even if they had served 30 years, receives nothing from this Act. That may seem harsh, but the Act’s scope is limited. Later increases may have applied, but this Act is silent.

Third, the increase does not apply to eligible children’s pensions. A family relying on a child’s pension gets no increase. The rationale could be that children’s benefits were adjusted separately, but the Act does not provide for that.

Fourth, the restriction on commutation in section 10 means the increase cannot be taken as a lump sum. This can trap pensioners who want to convert their pension into cash for medical or housing expenses. They may commute the base pension but are stuck with the increase as an ongoing payment. If they commute a portion of the base pension, the increase shrinks proportionally under section 10(2). That proportional reduction might not be obvious to a pensioner who thinks they can commute without affecting the increase.

Fifth, the prorating under section 7 can produce very small increases. Someone whose pension began on 1 June 1973 gets only one month of the 21‑month proportion (treated as one month per s7(4)), meaning an increase of about 1/21 of the full amount. And if the pension began after 15 June 1973, they get nothing. A pensioner who had just retired in late June 1973 would be excluded by the cut‑off, even though they are still in the same inflation period.

Sixth, the reliance on a single CPI and AWE data point (March quarter 1973 vs June quarter 1971) means that if there were temporary spikes or seasonal anomalies, the increase could be higher or lower than a smoother measure. The use of a fixed period approach is less sophisticated than ongoing indexation.

Compliance with this Act is primarily a matter for the administering authority (the Defence Force Retirement and Death Benefits Authority as it then was). The authority must first identify all pensions payable under the DFRB Act immediately before 1 July 1973 where the contributor retired or died on or before 30 September 1972. This requires accurate records of retirement and death dates. The authority must exclude pensions payable to or in respect of an eligible child (section 5(1)). For each eligible pension, the authority must obtain the relevant CPI and AWE statistics from the Commonwealth Statistician for March 1973 and June 1971, using the originally published figures (section 4(3)). It must then calculate the prescribed percentage using the two‑limb formula, rounding per section 4(4). The increase is that percentage of 77.5 per cent of the annual pension amount payable immediately before 1 July 1973.

For pensions that became payable on or after 1 October 1971, the authority must apply section 7 to prorate the increase. This involves counting the number of months from the day after the retirement or death (or the date the section 82ZB pension became payable) to 30 June 1973. Partial months are handled via section 7(5) and 7(4). If the period is less than one month, treat as one month. If the pension became payable after 15 June 1973, no increase is payable (section 7(3)). For section 69(1A) cases (re‑employed pensioners), section 7(6) makes the original retirement date the relevant date.

The authority must also handle suspended pensions under section 6: compute the increase as if the pension were payable, but do not pay the increase for the suspension period. When suspension ends, start paying the increased amount.

Section 8 requires the authority to include the increase in calculations of widow pensions under sections 55 and 57, and divorced wife pensions under section 58. This means the increase must be added to the notional pension of the contributor or the widow when computing derivative benefits.

Section 10 prohibits commutation of the increase portion. When a pensioner exercises commutation of the base pension after 1 July 1973, the authority must recalculate the increase under section 10(2). The new increase is the full increase times the ratio of the post‑commutation pension that would have been payable immediately before 1 July 1973 to the pre‑commutation pension. Practically, the authority needs to determine what the pension would have been if the commutation had occurred before 1 July 1973. This is an artificial calculation that may require administrative resources.

Section 9 applies if an invalidity pensioner is reclassified after 1 July 1973. The authority must compute the rate as if the reclassification had taken effect on the day immediately before 1 July 1973, using the increased rate. This avoids the reclassification wiping out the increase.

All increased amounts must be paid out of the Consolidated Revenue Fund (section 11). The authority must ensure proper appropriation is obtained. The increases take effect from the instalment due on 5 July 1973 (section 12). That means the first payment should reflect the increased amount.

For pensioners, compliance is passive: they must provide accurate personal details (especially dates) to the authority. They cannot commute the increase. They should check their pension statements to confirm the correct increase was applied. If the increase is not paid or is under‑calculated, they should contact the authority and if necessary seek review.

Given the Act’s age, compliance today is largely historical. Any remaining pensioners from the 1972 cohort would already have had the increase applied, and their current pension rates would have been built on that base. Modern administrators of defence pensions should be aware of this Act when reconstructing historical pension entitlements for legal or actuarial purposes.
