Defence Forces Retirement Benefits (Family Law Superannuation) Orders 2004

Scheme value (s 2.01): This is the value of the member spouse’s interest in the DFRB scheme for the purpose of calculating the transfer amount under the Family Law Act. The definition in section 80A of the Act merely refers to “orders made under this Act”, so these Orders supply the actual method. The method mirrors the approach used under the Family Law (Superannuation) Regulations 2001 (the FLS Regulations) by adopting the same “methodology and factors” framework from regulation 90MT, but then substituting factors nominated by an actuary for these Orders. This substitution ensures that the valuation reflects the specific actuarial assumptions appropriate to the DFRB scheme - a defined benefit scheme with unique benefit rules - rather than generic factors. The result is a scheme-specific valuation that may be higher or lower than the standard family law value.

Associate pension (s 2.02): The pension payable to a non-member spouse as an entitlement under section 80B of the Act. Its annual rate is derived by dividing the transfer amount (which is the non-member spouse’s share of the scheme value, determined under the Family Law Act) by a pension factor specific to the non-member spouse’s age and gender, as nominated by an actuary. The note in section 2.02 explicitly states that the associate pension “does not include a reversionary component,” meaning it is a personal, non-survivor pension. The factor is gender-based, which could raise issues of non-discrimination under other legislation, but the Orders were made in 2004 and rely on actuarial practice that still used gender-differentiated mortality tables.

Transfer amount: This term is defined in section 80A of the Act by cross-reference to the Family Law Act. It is the amount allocated to the non-member spouse from the member spouse’s superannuation interest under a splitting order or agreement. It acts as the numerator in the associate pension calculation.

Operative time: Also defined in section 80A of the Act, this is the time at which the superannuation splitting takes effect. The scheme value is assessed as at the operative time.

Reduction factor (s 2.06): A formula used to calculate the new annual rate of the member spouse’s standard pension after the split. The Orders do not disclose the formula. The reduction factor is applied by multiplying it by the annual rate of standard pension payable immediately before the operative time. Presumably the formula incorporates the proportion of the scheme value transferred or the associate pension amount, but the text is silent.

CPI indexation ratchet (ss 2.03, 2.05): Both the associate pension and the commutation threshold are indexed only when the latest quarterly CPI figure exceeds the highest CPI figure for any earlier half-year. This creates a ratchet effect: if CPI declines, payments are frozen at their existing level; if CPI then rises again, increases only occur after the previous peak is surpassed. This is more generous than simple annual indexation of a base year, because it effectively locks in past increases. The indexation rate is calculated as the percentage increase of the current CPI over that historic high (see s 2.03(4) and s 2.05(2)).

Prescribed half-year: A defined term in the Act (cross-referenced) that determines the indexation date: 1 January and 1 July each year.

The Orders directly affect three categories of natural persons. First, member spouses: current or former members of the Australian Defence Force who are participants in the Defence Forces Retirement Benefits Scheme (established under the Act) and who undergo a superannuation splitting under the Family Law Act. Their defined benefit pension is reduced by the amount necessary to provide the associate pension to the non-member spouse. The member spouse bears the cost of the split through a permanent reduction in their standard pension, calculated under section 2.06. Second, non-member spouses: former spouses of member spouses who obtain a superannuation splitting order or agreement. They receive an associate pension that is personal to them, non-reversionary, and indexed via the CPI ratchet. If the associate pension is small (below the indexed threshold of $1,303.03 as at 2004), they have a right to commute the pension to a lump sum under section 2.04. Third, actuaries: the Orders repeatedly refer to “an actuary nominated for these Orders” (ss 2.01, 2.02). This actuary is not defined in the Orders themselves; presumably the Minister or the scheme administrator nominates an actuary to provide the pension factors and substitute factors for scheme valuation. The actuary’s choices directly affect the quantum of both the scheme value and the associate pension rate. The Orders give significant discretion to this actuary, which introduces uncertainty for parties who cannot verify the assumptions used.

The Orders also affect institutional actors. The Commonwealth Superannuation Administrator (or the relevant administering authority under the Act) must implement the calculations, process indexation, and handle commutation requests. The Family Court of Australia and the Federal Circuit and Family Court of Australia may need to consider the Orders when making splitting orders for DFRB interests. Practitioners - family lawyers, accountants, and financial advisers - must understand the Orders to advise clients about the financial consequences of a divorce involving DFRB superannuation. Because the DFRB scheme is a defined benefit pension, the associate pension is a lifetime income stream for the non-member spouse, not a lump sum (unless commuted). This affects property settlement negotiations and spousal maintenance.

The Orders do not affect other military superannuation schemes (such as the Military Superannuation and Benefits Scheme established in 1991) or the general public. They are confined to the DFRB scheme, which applies only to members who enlisted before 1 October 1991. The cohort is shrinking and largely retired or approaching retirement. The Orders thus affect a closed, ageing population, but the financial impact per individual is not trivial because defined benefit pensions are often the largest asset in a military divorce.

Right of the non-member spouse to an associate pension: Under section 80B of the Act, once a transfer amount is determined, the non-member spouse becomes entitled to an associate pension calculated per section 2.02 of the Orders. The administrator must pay the pension at the annual rate derived from the division of the transfer amount by the nominated pension factor. This is a statutory right, not merely a contractual arrangement.

Right to commute a small associate pension: Section 80C of the Act allows commutation if the annual rate falls below a threshold. The Orders set that threshold at $1,303.03 as at commencement (s 2.04(1)), indexed thereafter. The non-member spouse can elect to receive a lump sum instead of the pension. The amount of the lump sum is not specified in the Orders; it would presumably be the commuted value of the pension according to actuarial principles. The right is elective: the non-member spouse is not forced to commute a small pension.

Right to indexation: The non-member spouse is entitled to CPI-linked increases to the associate pension, but only when the ratchet condition is met (s 2.03). The increase is calculated as a percentage of the relevant rate of associate pension. If the member’s pension started partway through a half-year, the indexation increase is pro-rated (s 2.03(5)(6)(7)). The administrator has a duty to apply the correct indexation formula.

Duty of the administrator to calculate the reduction of member’s pension: Under section 80D of the Act, the annual rate of the member’s standard pension must be reduced in accordance with section 2.06. The administrator must identify the pre-split rate and apply the reduction factor formula (which is not fully specified in the Orders themselves). This reduction is mandatory and permanent; the member’s pension does not later revert to the original amount.

Duty to use an actuary nominated for these Orders: Both the scheme value calculation (s 2.01 step 2) and the pension factor (s 2.02 step 2) require the use of factors nominated by an actuary specifically for these Orders, not the generic factors from the FLS Regulations. The administrator must engage or rely on that actuary. This creates a dependency on professional judgment not reviewable by the parties.

No reversionary rights: The note to section 2.02 expressly states the associate pension has no reversionary component. This means that if the non-member spouse dies, the pension ceases and does not pass to any widow, widower, or dependent. This is a significant limitation compared to the member spouse’s pension, which typically includes a reversionary benefit for a surviving spouse. The non-member spouse cannot nominate a beneficiary for the associate pension.

No right to a lump sum on default: The Orders do not give the non-member spouse a right to demand a lump sum instead of an associate pension unless the pension is below the small-pension threshold. For larger associate pensions, payment must be as an income stream.

The Orders themselves do not create any offences or penalties. They are subordinate legislation that sets out calculation methods; enforcement mechanisms flow from the governing Acts. If the administrator fails to pay the correct associate pension or applies the wrong indexation, the non-member spouse can seek enforcement under the Act or under the Family Law Act. Section 80B of the Act creates the obligation to pay the associate pension once the transfer amount is determined. A breach of that obligation would likely be enforced through proceedings in the Federal Court or the Family Court for an order to pay arrears and interest. The Superannuation Industry (Supervision) Act 1993 does not apply because the DFRB scheme is a public sector scheme outside that regime.

For the member spouse, non-compliance is less relevant because the reduction to their pension happens automatically upon the operative time. If the administrator applies the reduction incorrectly, the member spouse could seek review under the Administrative Appeals Tribunal Act 1975 (since decisions under the Act are reviewable by the AAT) or in the courts. The Orders do not provide for any internal dispute resolution mechanism.

The indexation provisions (ss 2.03, 2.05) impose a duty on the administrator to increase payments when the CPI ratchet conditions are met. Failure to do so would be a breach of statutory duty. The remedy would be damages for underpayment, plus interest. There is no criminal penalty for non-compliance under these Orders, but the Act itself may include offences for false statements or fraud. The Family Law Act contains provisions for orders to enforce superannuation splitting, including the power to require the trustee (the Commonwealth) to pay the transfer amount or to make the associate pension.

Because the DFRB scheme is administered by the Commonwealth, enforcement may involve the Crown. The Crown is bound by the Act, but there may be limitations on garnishment or enforcement against the Commonwealth. Typically, the appropriate remedy is a declaration and order for payment. The costs of enforcement fall on the parties, which may be disproportionate for small associate pensions.

The Orders sit at the intersection of four statutory regimes. The foundation is the Defence Forces Retirement Benefits Act 1948, which establishes the DFRB scheme and under which these Orders are made. Sections 80A to 80D of the Act, inserted by the Superannuation Legislation Amendment (Family Law and Other Matters) Act 2004, provide the enabling provisions for superannuation splitting. The Orders fill in the gaps left by those sections by prescribing the calculation methodologies.

The Family Law Act 1975, particularly Part VIIIB (sections 90MA to 90MZ), governs the splitting of superannuation interests between spouses. The Orders directly reference the Family Law Act in section 1.03, and section 2.01 step 1 cross-references section 90MT of that Act. The FLS Regulations, made under the Family Law Act, provide the default methodology and factors for valuing superannuation interests. However, the Orders deliberately depart from the FLS Regulations factors by substituting actuary-nominated factors. This means that for DFRB scheme interests, the family law value used in property settlements may be different from the scheme value used for the actual split. This creates a potential mismatch: the court may use one value for the overall property division, but the actual associate pension is calculated from a different scheme value derived from the Orders. Parties need to be aware of this.

The Superannuation Legislation Amendment (Family Law and Other Matters) Act 2004 is the amending Act that introduced the splitting provisions into the DFRB Act. The Orders are taken to have commenced on the commencement of that Act’s Schedule 1 (s 1.02). That Act also amended other superannuation schemes to allow family law splitting, but the Orders are specific to DFRB.

The Consumer Price Index is incorporated by reference as the indexation benchmark. The Orders rely on the CPI figures published by the Australian Statistician for the weighted average of eight capital cities. This is a public official statistic. The use of a “highest ever” ratchet means the indexation history resets only when a new peak is reached. This interacts with the broader Commonwealth policy of periodic CPI indexation of pensions.

The Actuaries Act 2002 or common law professional standards govern the actuary who provides the factors. The Orders do not specify qualifications; “an actuary nominated for these Orders” implies a person appointed by the relevant Minister or scheme administrator. That actuary must be a Fellow of the Institute of Actuaries of Australia or equivalent.

The Administrative Appeals Tribunal Act 1975 likely provides a mechanism for review of decisions made under the Act, such as a decision about the correct associate pension rate. The Orders themselves are legislative and cannot be challenged on the merits, only their application.

The Orders were originally made as Statutory Rules 2004 No. 100, notified in the Gazette on 20 May 2004, and commenced on 18 May 2004 (retrospectively, as per s 1.02). The sole subsequent amendment shown in the compilation is Statutory Rules 2004 No. 409, notified on 24 December 2004. The amendment table indicates that sections 2.04 and 2.05 were amended by SR 2004 No. 409. The schedules to that instrument are not provided, but the amendment likely updated the small-associate-pension commutation amount from its original figure to the $1,303.03 shown in section 2.04(1), and may have adjusted the indexation base date in section 2.05(1) from 1 January 2004 to something else. The date of effect of the amendment is given: sections 1-3 and Schedule 1 commenced on 1 July 2004, and the remainder on 24 December 2004. This suggests that the amending instrument contained multiple schedules, and the amendments to sections 2.04 and 2.05 may have taken effect from 1 July 2004, before the instrument was actually notified. This retrospective operation is common in superannuation indexation amendments.

The compilation date is 24 December 2004. There is no evidence of any later amendment in the source material. However, given that CPI indexation of the commutation threshold occurs every six months (s 2.04(3)), the threshold amount of $1,303.03 would have been indexed upwards over time. The Orders as published may have been updated subsequently, but the source provided stops at the 2004 compilation. A practitioner would need to check the Federal Register of Legislation for the current version.

The original Orders (SR 2004 No. 100) likely contained the same basic structure but possibly with different numerical values. The amendment table shows that sections 2.04 and 2.05 were originally in No. 100 and were amended by No. 409. No other provisions were amended. The Orders have remained structurally unchanged since that single amendment, at least until the compilation date. This suggests that the family law splitting provisions for DFRB have been stable since their introduction, unlike the more frequently amended civilian superannuation regulations.

The source text includes no references to any court cases. The Orders themselves are a legislative instrument rarely litigated directly; disputes arise under the parent Act or the Family Law Act. A search of reported Australian case law (which cannot be conducted here but is comment) would likely reveal cases dealing with the valuation of DFRB interests in property settlements, and possibly challenges to the actuarial factors used. However, the Orders delegate key calculations to an actuary nominated for these Orders, which may insulate them from judicial challenge because the factor selection is a matter of actuarial judgment, not a legal determination. Courts may accept the scheme value produced by the Orders as the value to be used for splitting, but they could also consider the underlying assumptions if a party argues that the factor selection was irrational or discriminatory.

The gender-based pension factor (s 2.02 step 2) could potentially be challenged under the Sex Discrimination Act 1984 or the Australian Human Rights Commission Act 1986. Using gender in a pension factor may be permissible if actuarially justified, but it could also be seen as discriminatory against men or women depending on the mortality assumptions. No such challenge appears in the source, but it remains a vulnerability. The note to section 2.02 that the associate pension has no reversionary component could lead to disputes if a non-member spouse dies shortly after the split and the pension ceases; the estate would have no claim.

Because the DFRB scheme is closed to new members and the cohort is ageing, litigation is likely to diminish over time. Most potential plaintiffs would be retirees or near-retirees with defined benefit pensions that are relatively easy to value. The complexity of the indexation formulas in sections 2.03 and 2.05 may generate administrative errors rather than court challenges. Overall, the litigation history for these specific Orders is minimal, but the source does not provide any case names or judgments.

Several features of the Orders can trap the unwary. The most obvious is that the reduction factor formula in section 2.06 step 2 is not set out in the text. The source simply says “Calculate a reduction factor using the formula” without providing the formula. The reader must consult the Act or other regulations to find the formula. This is a drafting deficiency that creates uncertainty for both administrators and parties trying to verify the reduction.

The scheme value under section 2.01 may differ from the family law value used in the court proceedings. The court will typically consider the family law value (under the FLS Regulations) when determining the overall property split. But the scheme value under the Orders uses a different “actuary nominated” factor, so the actual associate pension may be based on a different number. This can lead to unexpected outcomes where the non-member spouse receives a pension based on a value that is not the same as the value the court thought it was splitting. Practitioners should request the scheme value calculation from the scheme administrator early to avoid surprises.

The indexation ratchet in sections 2.03 and 2.05 means that if CPI stays flat or declines, the associate pension amount remains frozen. That is not unusual; but the ratchet also means that if CPI falls and then rises again, no increase occurs until the new CPI exceeds the previous all-time high. This can result in extended periods without any increase even though CPI has risen from a trough. The indexation also uses the highest CPI for the first quarter of any earlier half-year, not just the preceding half-year. This further delays increases if there was a CPI spike years ago.

The gender-based pension factor (s 2.02 step 2) introduces a potential discrimination issue. A male non-member spouse would have a different factor from a female non-member spouse of the same age, resulting in a different annual pension for the same transfer amount. This seems inconsistent with modern anti-discrimination principles, but the Orders were made in 2004 when such differentials were still accepted in insurance. The actuary nominated for these Orders could mitigate this by using unisex factors, but the text does not require it.

The small-pension commutation threshold ($1,303.03 in 2004, indexed) is not inflation adjusted from the start; it was a fixed dollar amount that becomes more valuable in real terms only when CPI rises. The indexation only starts from the first indexation date (1 January 2005). So a threshold set in May 2004 was not indexed until January 2005, meaning it was eroded by inflation for about eight months.

The actuary’s discretion is not checked by any published factors. The Orders do not require the actuary’s factors to be publicly disclosed or tabled in Parliament. This creates a black-box element: neither the member spouse nor the non-member spouse can independently verify the scheme value or the pension factor. They must rely on the administrator’s calculations. If the actuary changes over time, the factors may change, leading to non-comparable values for different splits.

The associate pension has no reversionary benefit. If the non-member spouse dies, the pension stops and no lump sum is paid to the estate. This contrasts with most defined benefit pensions that have a reversion to a surviving spouse. The non-member spouse may not realise this until it is too late to purchase alternative insurance.

The part-year indexation pro‑rata rules in section 2.03(5)(6)(7) are complex. A partial month is disregarded if it is less than half a month, but treated as a whole month if more than half. This can produce minor anomalies, but for low pensions the impact is small.

For the scheme administrator (the Commonwealth acting through the relevant department), compliance involves following the precise steps in Part 2 of the Orders. When a splitting order or agreement is received, the administrator must first determine the scheme value under section 2.01. This requires identifying the methodology from the FLS Regulations for section 90MT of the Family Law Act, then substituting factors nominated by an actuary for these Orders. The administrator must ensure the actuary is appropriately appointed and that the factors are on file. The scheme value is then used to determine the transfer amount (which is determined under the Family Law Act, not the Orders). Next, the associate pension annual rate is calculated under section 2.02: divide the transfer amount by the pension factor (age and gender specific, nominated by the actuary). The resultant amount is the annual pension payable to the non-member spouse. The administrator must then reduce the member spouse’s standard pension under section 2.06, using the reduction factor formula (which must be sourced from the Act or other regulations). The administrator should document all calculations and retain the actuary’s factor documentation for audit.

Indexation must be applied every half-year (1 January and 1 July). For the associate pension, the administrator must compare the latest March-quarter CPI (for 1 July indexation) with the highest March-quarter CPI on record. If the current CPI exceeds that historic high, the associate pension is increased by the percentage difference (s 2.03(4)). The increase is applied to the rate payable immediately before the prescribed half-year. For part-year pensions (where the member spouse’s pension started during the preceding half-year), the pro‑rata formula in s 2.03(5) must be used. The commutation threshold (s 2.04) must also be indexed on the same schedule, using the method in section 2.05: compare the latest December-quarter or June-quarter CPI with the highest such CPI since 1 January 2004, and increase the threshold proportionally. The administrator should publish the updated threshold each half-year for transparency.

For the non-member spouse, compliance is passive: they must ensure they receive the correct pension and should monitor indexation notices. If the associate pension is below the indexed threshold, they may apply for commutation under section 80C of the Act. The application should be in writing to the administrator. The amount of the lump sum is not specified by the Orders; the administrator should provide the calculated commutation amount.

For the member spouse, compliance is also passive: their pension will be automatically reduced. They should verify that the reduction factor was correctly applied. They can request a statement of the calculation from the administrator and, if dissatisfied, seek review through the AAT or the courts.

For family lawyers, compliance means ensuring that the scheme value used in the Orders is understood and, if necessary, obtained from the administrator before finalising property orders. The lawyer should recognise that the Orders produce a different value from the standard family law value, and should advise clients accordingly. The lawyer should also inform the non-member spouse that the associate pension is non-reversionary and that commutation is only possible if the pension is small.

For the actuary nominated for these Orders, compliance involves providing factors that are reasonable and actuarially sound. The actuary should document the methodology and bases for the factors, and should review them periodically to ensure they remain appropriate. The actuary should also ensure that the factors are consistent across splits for different individuals to avoid arbitrary discrimination. While the Orders do not require public disclosure, the actuary should be prepared to explain the factors to the administrator or to a court if challenged.
