Defence Force Retirement and Death Benefits Regulations 2017

This instrument is short and computational. Its main legal and operational concepts are definitional and mechanistic rather than substantive policy-making. The following concepts structure the regulations and recur through the instrument:

• Annual rate of pay / annual pay applicable: The regulations supply an operative rule for the “annual rate of pay” notion used by the Act. For members whose pay is set by the Remuneration Tribunal, the annual pay is simply the annual rate of remuneration determined by the Remuneration Tribunal under subsection 7(3) of the Remuneration Tribunal Act 1973 (s6(1)). For other members, annual pay is a sum of two components sourced from determinations under Part IIIA of the Defence Act: the annual rate of salary under the relevant determination and, where applicable, the annual rate of any service allowance provided by those determinations (s6(2)(a)-(b)).

• Treatment of differential service bands: When Part IIIA determinations specify different salary rates according to years of service, the regulation directs that, for pay purposes under paragraph 6(2)(a), the applicable rate is taken to be the rate that applies to the longer or longest service period specified in the determination for that rank (s6(3)). This converts multi-band determinations into a single rate for the Act’s purposes.

• Rank definition mapping: The regulation makes clear that references to “rank” for purposes of reading Part IIIA determinations are to be understood as if the term had the meaning given by subsection 3(1) of the Act (s6(4)). This aligns the pay computation to the Act’s rank definitions.

• Chaplains: Chaplains have a specialised rule. For them, the applicable annual rate of salary is the highest annual rate of salary applicable on the day under a Part IIIA determination for the classification applicable to the chaplain (s6(5)). This departs from direct reliance on a single classification rate and instead adopts the highest applicable rate.

• Prescribed spouse pension rate and indexation: The regulation prescribes an initial monetary amount, $1,779.02, for the purposes of subsection 6BA(3) of the Act (s7(1)). It sets an indexation mechanism that reviews CPI movements over specified six month periods and increases the prescribed rate only where the later CPI number exceeds the earlier CPI number; increases are applied semi-annually on 1 January and 1 July as relevant (s7(2)-(4)). The formulae apply the proportional CPI change to the then-current prescribed rate (s7(3)-(4)). Rounding and CPI publication rules are specified (s7(5)-(7)). The regulation defines “CPI number” and the two quarterly reference terms used in the indexation calculations (s7(8)).

• Lump sum conversion using Family Law factors: For lump sum payments to spouses under subsection 6BA(3) of the Act, the regulation prescribes a formula (set out in the instrument) and specifies that the age factor in that formula is to be taken from the “Spouse pension Single life” column in Table 4B (for female spouses) or Table 4A (for male spouses) of Part 4 of Schedule 1 to the Family Law (Superannuation) Approval 2003 (s8). The regulation further defines “rate of pension” in relation to subsection 6BA(2) of the Act.

• Repeal of earlier instruments: The regulation removes the 1979 and 1973 Defence Force Retirement and Death Benefits regulations in full (Schedule 1), thereby consolidating calculation rules in this 2017 instrument.

Collectively, these concepts determine the numeric inputs and the conversion methods administrators must apply when administering retirement and death benefits under the Act. The instrument ties these inputs to external sources: tribunal determinations under the Remuneration Tribunal Act, Part IIIA determinations under the Defence Act, CPI numbers published by the Australian Statistician, and age factors in a specified Family Law Approval instrument. The regulation therefore functions as a translation layer linking benefit rules in the Act to specific pay and indexation metrics.

The regulations affect a narrow set of actors by changing how certain numeric calculations are performed and what reference sources administrators must use. The principal affected parties and roles, and how they are affected, are:

• Members of the Defence Force: All categories of Defence Force members are affected for the purpose of determining the “annual rate of pay” that feeds into benefit calculations under the Act. The distinction in the text is between (a) members whose remuneration is determined by the Remuneration Tribunal (s6(1)) and (b) other members whose pay and any service allowance are set by determinations under Part IIIA of the Defence Act (s6(2)). For members subject to Part IIIA determinations, the regulation alters how multi-band service steps are mapped to a single annual rate for benefit calculation by prescribing that the longer or longest service step is used where the determination lists different rates by years of service (s6(3)).

• Chaplains serving in the Defence Force: Chaplains have a specific rule: the applicable annual rate for a chaplain is the highest annual rate applicable on that day under a Part IIIA determination for the chaplain’s classification (s6(5)). This affects the pay input used to calculate entitlements.

• Spouses in post‑retirement marital or couple relationships: The regulation directly addresses benefits for spouses covered by subsection 6BA(3) of the Act. It prescribes a dollar pension rate ($1,779.02) that applies to those spouse pension calculations and establishes the indexation schedule for that prescribed rate (s7(1)-(4)). It also prescribes the method for calculating a lump sum payment for such spouses and ties the age factor to specified Family Law tables (s8).

• Administrators and pay officers: Those administering the Act’s benefits, departmental officers, superannuation administrators, payroll staff or other officials (not named in the instrument),must apply the definitions, retrieve the specified Tribunal or Part IIIA determinations, apply the CPI-based indexation computations, round amounts to the nearest cent and use the external age-factor tables for lump sum conversions (ss6-8). The regulation changes the computational approach these officers must follow, and it replaces prior calculation rules (Schedule 1).

• The Remuneration Tribunal and Part IIIA decision-makers: The instrument relies on determinations by these bodies for the numerical inputs that flow into the Act’s calculations. For members whose remuneration is fixed by the Remuneration Tribunal, the regulation treats the Tribunal’s annual rate as the annual pay applicable for that day (s6(1)). For other members, the regulation depends upon Part IIIA determinations for salary and service allowance rates (s6(2)).

• Users of Family Law valuation tables: The regulation binds calculation of lump sum spouse payments to age factors found in specified tables in the Family Law (Superannuation) Approval 2003 (s8). That creates a dependence on an instrument outside the Defence pensions framework and affects whoever must obtain those factors to perform the conversion.

• Entities and processes reliant on prior instruments: By repealing the 1973 and 1979 regulations in full (Schedule 1), the instrument affects any administrative or legal materials built on those earlier instruments. All parties using the older regulations for legacy matters must switch to the 2017 rules.

The instrument does not itself create new categories of beneficiaries or new substantive entitlements beyond what the Act provides. Its effects are computational and administrative: which input sources determine the monetary figure used to calculate benefit amounts, how those figures are indexed, how lump sums are derived and which prior instruments are superseded.

The regulations primarily impose duties on administrators and create definitional rights (in the sense of entitlement calculations) for members and spouses under the Act. The key duties, rights and decision points established by the regulation are:

• Duty to use Tribunal-determined remuneration for public office holders: Where a member’s remuneration is determined by the Remuneration Tribunal under subsection 7(3) of the Remuneration Tribunal Act 1973, administrators must use the Tribunal’s annual rate of remuneration on that day as the annual pay applicable to the member for the purposes of the Act (s6(1)). That is a direct duty to treat Tribunal outputs as authoritative numeric inputs.

• Duty to aggregate salary and service allowance for other members: For members not subject to Tribunal determination, administrators must compute annual pay as the sum of two components supplied by Part IIIA determinations: (a) annual rate of salary under a Part IIIA determination, and (b) if payable, the annual rate of any service allowance under a Part IIIA determination (s6(2)(a)-(b)). This establishes a required aggregation process.

• Duty to select the longest service step when determinations specify multiple service bands: Where Part IIIA determinations set different salary rates according to years of service for a given rank, administrators must, for the Act’s purposes, take the applicable annual rate to be the rate that applies to the longer or longest period of service specified in the determination for members who hold or are taken to hold that rank (s6(3)). This is a prescriptive rule for resolving multi-step salary schedules.

• Duty to treat “rank” as defined by the Act: The regulation requires that references to annual rates under Part IIIA determinations be read as if “rank” had the meaning given by subsection 3(1) of the Act (s6(4)). This duty ensures internal consistency between the Act and the Defence Act determinations.

• Duty to use the highest applicable chaplain rate: For chaplains, administrators must take the applicable annual rate of salary as the highest annual rate applicable on that day under a Part IIIA determination for the classification applicable to the chaplain (s6(5)). That is a distinct duty for this class of member.

• Right to the prescribed spouse pension rate and indexed increases: The regulation prescribes a set monetary rate ($1,779.02) relevant to subsection 6BA(3) of the Act (s7(1)). It imposes a duty on administrators to apply the semi-annual indexation process when the CPI-based conditions are met (s7(2)-(4)), including rounding to the nearest cent (s7(5)). The indexed increase is conditional: increases are applied only if the latest CPI number is greater than the earlier CPI number for the relevant six month period, which means the prescribed rate will not be reduced if CPI falls during a relevant period (s7(3)-(4)).

• Duty to use specified CPI numbers and to manage publication anomalies: Administrators must use the All Groups Consumer Price Index number for the eight capital cities as published by the Australian Statistician and follow the specified rules when a CPI number is later substituted or when the Australian Statistician changes the index reference period (s7(6)-(8)). This creates duties for handling published CPI data.

• Duty to compute lump sums using prescribed age factors: For lump sums under subsection 6BA(3), administrators must apply the specified formula (s8) and obtain the age factor from the spouse pension single life column in Table 4A or 4B of Part 4 of Schedule 1 to the Family Law Approval 2003, depending on the spouse’s sex (s8). The “rate of pension” used in that formula is the rate worked out under subsection 6BA(2) of the Act. This creates a duty to use external tables for actuarial conversion.

• Right to consistency with external determinations: Members and spouses obtain the practical right that their benefit calculations will mirror particular external determinations and indices rather than leaving those matters to discretionary administrative interpretation. The instrument specifies the external sources whose outputs determine benefit numerics (Remuneration Tribunal, Part IIIA determinations, Australian Statistician’s CPI, Family Law Approval tables).

• Absence of penalty rules in the instrument: The regulations do not specify penalties or enforcement provisions. Any enforcement mechanism therefore remains within the Act or other applicable law (see s3 for authority). Administrators must therefore follow the duties imposed for operational compliance, but the instrument itself does not set out sanctions.

In sum, the regulations allocate computational duties to administrators, specify which external instruments and indices determine financial inputs, and thereby define the numeric rights of members and spouses under the Act. The critical decision points for administrators are: which determinations apply (Tribunal or Part IIIA), how to interpret multi-step salary schedules, when and how to index the prescribed spouse rate, and how to convert pension entitlement to a lump sum using external age factors.

The Defence Force Retirement and Death Benefits Regulations 2017 do not contain express penalty provisions, enforcement mechanisms or criminal sanctions. The instrument is primarily a set of computational and definitional rules implemented under the authority of the Defence Force Retirement and Death Benefits Act 1973 (s3). That context yields the following enforcement and penalty observations, drawn exclusively from the instrument’s text:

• No penalties in the regulations themselves: The text contains no sections that create offences, fines, or enforcement powers. Sections 6-8 set out how to calculate pay, prescribe a spouse pension rate and indexation method, and prescribe lump sum conversion mechanics, but they do not specify consequences for non-compliance with those provisions. Consequently, the regulations rely on the statutory architecture of the Act for any remedial or enforcement action.

• Enforcement therefore sits with underlying Act or administrative processes: Because the regulations are made under the Act (s3), any enforcement, correction of errors, appeals, review mechanisms, or penalties will be those provided by the Act or by general public law processes applicable to administrative action. The regulations themselves do not specify such pathways.

• Administrative obligations implied by calculation rules: Even in the absence of penal provisions, administrators are required by the instrument to apply particular methods (for example, compute annual pay as specified in s6, index the prescribed rate as specified in s7, use Family Law age factors per s8). Failure to follow those methods would be an administrative error subject to correction or challenge under administrative law or the Act’s processes, but the regulation does not create or describe investigatory or sanctioning powers.

• Dependency on external publishers and bodies without regulatory penalty clauses: The instrument depends for indexation on the Australian Statistician’s CPI numbers (s7(8)), on remuneration determinations of the Remuneration Tribunal and determinations under Part IIIA of the Defence Act (s6(1)-(2)), and on tables in a Family Law Approval instrument (s8). The instrument does not create enforcement avenues against those external bodies; it simply prescribes that their outputs are to be used.

• Repeal operation has no penalty component: Schedule 1 repeals earlier instruments in whole. The schedule does not specify transitional penalties or enforcement consequences; it simply repeals the documents.

Practically, the absence of penalties in the regulations means that non-compliance is likely to be treated as an error to be remedied under administrative correction procedures, statutory review or dispute resolution under the Act or general administrative law. The instrument imposes clear administrative duties (for example, how to aggregate salary components or how to index a prescribed rate), so an administrator’s failure to follow those duties would be a matter of administrative rectification rather than a statutory offence created by these regulations.

The instrument is explicitly tethered to multiple external legal instruments and statistical publications. The interaction is functional: it designates certain external outputs as authoritative inputs for the benefit computations under the Act. The principal interactions in the text are:

• Defence Force Retirement and Death Benefits Act 1973: The regulation is made under that Act (s3) and is intended to supply particulars referenced in the Act, including what is to be treated as the annual rate of pay for members and the prescribed rate relevant to subsection 6BA(3). The regulation therefore operates as subordinate legislation filling in computational and definitional detail required by the Act.

• Remuneration Tribunal Act 1973: For members whose pay is determined by the Remuneration Tribunal under subsection 7(3) of the Remuneration Tribunal Act 1973, the regulation directs that the annual rate of remuneration determined by the Tribunal is the annual pay applicable for the Act’s purposes (s6(1)). The regulation therefore imports Tribunal determinations into the Act’s payment calculations and makes those determinations directly operative.

• Defence Act 1903, Part IIIA determinations: For members not covered by Tribunal determinations, the regulation requires use of determinations under Part IIIA of the Defence Act as the basis for annual salary and service allowance inputs (s6(2)). When Part IIIA determinations specify multiple service-point salary rates, the instrument requires the longer/longest service step be taken for the calculation (s6(3)). Also, for chaplains the regulation specifies use of the highest applicable classification rate under Part IIIA (s6(5)). Thus, the regulation instructs administrators how to read and apply Part IIIA determinations in the context of the Act.

• Family Law (Superannuation) (Methods and Factors for Valuing Particular Superannuation Interests) Approval 2003: The lump sum calculation for spouse payments under subsection 6BA(3) is cross-referenced to specific actuarial factors in that Approval. The age factor is to be taken from the “Spouse pension Single life” column in Table 4B (female) or Table 4A (male) of Part 4 of Schedule 1 to the Approval 2003 (s8). Consequently, the calculation of lump sum payments under the Act depends on values produced in a Family Law instrument external to the Defence pensions framework, creating an intersection between superannuation valuation methods used in family law contexts and Defence benefit conversions.

• Australian Statistician’s Consumer Price Index publications: The indexation mechanics for the prescribed spouse pension rate depend on the All Groups Consumer Price Index number (weighted average of the eight Australian capital cities) as published by the Australian Statistician (s7(8)). The regulation specifies which quarterly CPI numbers are “earlier” and “latest” for the semi-annual review periods and sets rules for handling substituted CPI numbers and changes to the index reference period (s7(3)-(7)).

• Repeal interaction with earlier Defence regulations: Schedule 1 repeals two earlier Defence Force Retirement and Death Benefits regulations (1979 and 1973) in their entirety. That interaction replaces previously applicable subordinate legislation and consolidates computational rules in the 2017 instrument.

• Interaction with the Act’s subsection references: The regulation repeatedly refers to specific subsections of the Act (for example, subsection 3(1) for rank, subsection 6BA(3) for spouse entitlements and subsection 6BA(2) for rate of pension). Administrators must therefore read the regulation alongside those Act provisions; the regulation supplies only the numerical and procedural specifics required to implement the Act’s entitlement rules.

These interactions create a web of dependencies. Administrators must access and reconcile outputs from Tribunal determinations, Part IIIA Defence determinations, CPI publications and Family Law Approval tables to calculate entitlements. Changes in any of those external instruments or publications will affect the computations under the Act without amendment to these regulations, except where the regulations themselves are updated. The regulation provides limited transitional or substitution rules (notably for substituted CPI numbers and for changes to CPI index reference periods, s7(6)-(7)), but otherwise relies on contemporaneous external outputs.

The instrument itself records a narrow amendment and commencement history in its text. The elements visible in the regulation are:

• Date made and registration context: The instrument is dated 24 August 2017 and is stated to be made by the Governor-General with the advice of the Federal Executive Council. The commencement table states that the whole instrument commenced the day after registration, recorded as 29 August 2017 (s2 and commencement table). The instrument’s note clarifies that the commencement table relates only to the provisions as originally made and will not be amended to reflect later amendments.

• Repeals of earlier instruments: Schedule 1 expressly repeals in their entirety the Defence Force Retirement and Death Benefits (Annual Rates of Pay) Regulations 1979 and the Defence Force Retirement and Death Benefits Regulations 1973 (Schedule 1 items 1 and 2). Those repeals are total: "The whole of the Regulations" of each earlier instrument are repealed. The practical effect is that the 2017 regulations replace those prior subordinate instruments as the operative regulatory code for the matters they cover.

• No subsequent amendments recorded in the instrument: The text supplied does not include any amendment items beyond the Schedule 1 repeals. The instrument’s commencement table contains a note that it will not be amended to deal with later amendments; there are no in-text amendment entries. Therefore, within the confines of this instrument as supplied, the only recorded legislative history is its making on 24 August 2017, commencement on 29 August 2017, and the repeal of the two earlier regulations.

• Definitions and transitional notes: The instrument includes a standard provision stating that items in a Schedule operate to amend or repeal instruments specified in that Schedule (s4). There is also a standard note in the commencement table about column 3 information not being part of the instrument and subject to editing in published versions; that is an editorial footnote about published forms rather than a substantive amendment (s2(2)).

• No in-instrument retrospective amendments or savings clauses: The instrument does not include explicit savings or transitional provisions dealing with actions taken under the repealed instruments. The Schedule 1 repeals are stated as simple repeals; any transitional arrangements would therefore be governed by the Act, general legal principles, or separate transitional instruments if any were later made. None appear in the provided text.

• Authority for future amendment: The instrument is made under the Defence Force Retirement and Death Benefits Act 1973 (s3). Future amendments to the regulations would follow the Act’s enabling processes and standard legislative procedures for subordinate instruments.

In short, the 2017 regulations replaced prior regulations, commenced in late August 2017, and contain no further amendment history inside the document supplied. The instrument records no subsequent variations or later commencement modifications in the text provided.

The Defence Force Retirement and Death Benefits Regulations 2017 text supplied contains no litigation history, case references, or judicial interpretations. The regulation:

• Contains no reference to any judicial decisions, appeals, or disputes. The text is purely regulatory and computational, and it does not record cases or legal challenges.

• Does not supply transitional dispute-resolution provisions that would point to litigation outcomes. Schedule 1 repeals prior instruments without attaching savings or transitional litigation directions.

• Does not cite or reference any tribunal or court determinations that interpret its provisions. The instrument relies on external determinations (Remuneration Tribunal, Part IIIA Defence determinations, Australian Statistician CPI numbers and Family Law Approval tables) as inputs, but no judicial interpretation of those interactions is recorded in the instrument.

If litigation or administrative review has arisen in relation to the application of these regulations, no such material is contained in the instrument text provided. Any case law, appeals, litigation histories, or judicial decisions interpreting or applying these regulations therefore lie outside the document. Users seeking litigation history must consult case law databases, tribunal decisions, or administrative law records beyond the instrument itself. The instrument, as supplied, documents only the regulatory mechanics and not any judicial engagement with those mechanics.

The regulation is short but contains several technical traps and dependency points that administrators, legal advisers and affected persons should note. These are mechanical features that can change outcomes or create administrative complexity:

• Distinct sources for pay depending on remuneration regime: The regulation draws a bright line between members paid under the Remuneration Tribunal and those paid under Part IIIA Defence determinations. Administrators must correctly identify which legal instrument governs a member’s pay. Using the wrong source will change the annual pay input (compare s6(1) and s6(2)). The regulation does not supply guidance on how to make that governance determination; administrators must refer to the relevant statutory instruments and employment arrangements.

• Aggregation of salary and service allowance: For members paid under Part IIIA determinations, the annual pay applicable for the Act’s purposes is the sum of the annual rate of salary and any service allowance under Part IIIA (s6(2)). If an administrator overlooks a payable service allowance, benefit calculations will be understated.

• Use of the longest service step where determinations vary by years of service: If Part IIIA determinations specify ascending rates by years of service for the same rank, the regulation directs that, for the Act’s purposes, the rate to be used is that which applies to the longer or longest period of service for that rank (s6(3)). This is counterintuitive in some payroll contexts where pay is normally based on actual years served. Here, the regulation converts multi-step schedules into a single, higher long-service rate. The text does not explain whether that applies even for members with less actual service, so administrators must follow the regulation’s prescriptive language.

• Chaplain highest-rate rule: Chaplains are to be assigned the highest annual rate applicable under Part IIIA for their classification (s6(5)). This may produce a higher annual pay input than would follow from ordinary step progression rules. Payroll and benefits personnel must identify chaplain classifications and the highest applicable rate.

• Conditional indexation for the prescribed spouse rate: Indexation of the prescribed rate ($1,779.02) occurs only if the “latest CPI number” is greater than the “earlier CPI number” for the relevant six month period (s7(3)-(4)). This means that if CPI falls or is unchanged over a six month review period, no downward adjustment is applied; the rate is increased only when CPI increases. Administrators must therefore implement a one‑way indexation mechanism that ignores negative CPI changes.

• Semi-annual application and precise CPI references: The instrument prescribes two six month review periods with different CPI quarter references: July‑to‑December reviewed against the prior March and the September quarter; January‑to‑June reviewed against the prior September and the March quarter (s7(3)-(4)). Administrators must correctly identify which quarters are the “earlier” and “latest” CPI numbers for each review to compute increases correctly.

• Rounding rule and CPI publication anomalies: Any calculated increased rate must be rounded to the nearest cent with 0.5 cents rounded upwards (s7(5)). If the Australian Statistician later publishes a substituted CPI number for a quarter that had an earlier published CPI, that substituted number is to be disregarded for these indexation calculations (s7(6)). However, if the Australian Statistician changes the CPI index reference period, the regulation requires reliance only on CPI numbers published under the new index reference period going forward (s7(7)). Administrators must track not only CPI values but also whether the Statistician has issued substituted numbers or changed reference periods.

• Dependence on external Family Law factors for lump sums: The lump sum formula depends on an “age factor” taken from specific tables in the Family Law Approval 2003 (s8). If those tables are amended, updated or replaced by a later instrument, the calculation could change; the regulation specifies the 2003 Approval’s tables as the source. Administrators must have ready access to that Family Law instrument and apply the correct table and column depending on the spouse’s sex (s8).

• Ambiguity in the lump sum formula presentation: The instrument refers to a formula for the lump sum in s8 and defines its components, but the formula itself is reproduced in the text as an image. Where that image is not retrievable in particular digital presentations, implementers must refer to the published regulation as printed or to the authoritative legislative database to obtain the exact formula. The text does, however, specify that “rate of pension” in the formula is the rate worked out under subsection 6BA(2) of the Act (s8).

• Interaction with the Act’s definitions: The regulation requires that the term “rank” in Part IIIA determinations be interpreted as if it had the meaning given by subsection 3(1) of the Act (s6(4)). Administrators must consult subsection 3(1) of the Act to resolve rank-based issues rather than relying on a separate Defence Act definition.

• Repeal of earlier regulations without transitional detail: Schedule 1 repeals two earlier instruments in full. The regulation does not include express savings or transitional provisions. Administrators dealing with cases spanning the repeal may need to establish whether the Act or other legal principles supply savings or transitional measures, because the regulation does not do so.

• No penalty provisions or enforcement detail in the instrument: There are no penalty or enforcement clauses in these regulations. Any enforcement, correction or dispute resolution will be under the Act or other applicable legal frameworks; the regulation does not provide procedural guidance for appeal or rectification.

These “gotchas” are practical points where a mechanical oversight or misreading of the cross-references can produce materially different benefit calculations. Implementers must therefore ensure robust administrative processes for identifying which determinations apply, for sourcing the correct CPI figures and Family Law factors, and for applying the prescribed rounding and substitution rules.

Compliance with these regulations is an exercise in correct data sourcing, accurate arithmetic in accordance with the prescribed formulae, use of the correct external reference instruments, and record-keeping sufficient to demonstrate the methods used. The compliance tasks and recommended operational checklist, tied to specific provisions of the instrument, are:

1. Establish the governing pay determination for each member (s6(1)-(2))

   • For each member whose benefit is being assessed, determine whether their remuneration is set by the Remuneration Tribunal under subsection 7(3) of the Remuneration Tribunal Act 1973 or by a Part IIIA determination under the Defence Act 1903.
   • If the Remuneration Tribunal determines the member’s pay, use the Tribunal’s annual rate for that day as the annual pay applicable (s6(1)).
   • If the member is governed by Part IIIA determinations, collect the relevant determination(s) and extract the annual rate(s) of salary and any service allowance payable (s6(2)(a)-(b)).

2. Aggregate salary and allowances accurately (s6(2))

   • Sum the annual salary rate and any applicable service allowance to produce the annual pay input to the Act’s calculations.
   • Ensure that the service allowance used is the annual rate under the applicable Part IIIA determination; do not substitute non-determinative allowances or ad hoc payments.

3. Apply the longest service step rule where relevant (s6(3))

   • Where a Part IIIA determination specifies different salary rates according to years of service for a given rank, apply the rate specified for the longer or longest period of service for that rank, per s6(3).
   • Document how the determination was read and which service band was selected.

4. For chaplains, use the highest classification rate (s6(5))

   • Identify chaplains and apply the highest annual rate applicable under the relevant Part IIIA determination for their classification.
   • Retain documentation showing how “highest applicable rate” was identified on the relevant date.

5. When computing spouse pension prescribed rate and indexation, follow the CPI procedure precisely (s7)

   • Start from the prescribed rate of $1,779.02 as the baseline (s7(1)).
   • On 1 January 2018 and on each subsequent 1 July and 1 January, assess whether an increase is due by comparing the specified “earlier CPI number” and “latest CPI number” for the relevant six month review period (s7(2)-(4)).
   • If latest CPI > earlier CPI, compute the increase using the formula set out in the regulation: multiply the prescribed rate by (latest CPI / earlier CPI) as specified in the applicable subsection (s7(3)-(4)). If latest CPI is not greater, do not reduce the prescribed rate.
   • Round the computed amount to the nearest cent, with 0.5 cents rounded upwards (s7(5)).
   • If the Australian Statistician publishes a substituted CPI number for a quarter, disregard that substituted number for the purposes of these calculations (s7(6)).
   • If the Australian Statistician changes the CPI index reference period, for calculation after the change, rely only on CPI numbers published under the new reference period (s7(7)).
   • Use the All Groups CPI weighted average of the eight Australian capital cities as the CPI number source (s7(8)).

6. Compute lump sum payments using the prescribed formula and Family Law age factors (s8)

   • Obtain the “rate of pension” as worked out under subsection 6BA(2) of the Act; this is a necessary input to the lump sum formula (s8).
   • Determine the spouse’s sex and age; select the relevant age factor from the Family Law Approval 2003 tables: Table 4B, Part 4, Schedule 1 for female spouses and Table 4A for male spouses, using the “Spouse pension Single life” column (s8).
   • Apply the lump sum formula set out in the regulation text. Where the formula is presented as an image in a particular published copy, refer to the authoritative legislative database or printed instrument to obtain the exact mathematical expression.
   • Retain records of the Family Law table version consulted and the age-factor selected.

7. Maintain records and provenance for auditing

   • Keep copies or citations of the Remuneration Tribunal determination, the Part IIIA determinations, the specific Australian Statistician CPI publications used, and the Family Law Approval 2003 tables consulted.
   • Record the calculation steps, rounding actions, and the date on which the rates were applied.
   • If a substituted CPI number has been published by the Australian Statistician, record the decision to disregard it for the purposes of s7(6) with supporting references.

8. Transition from repealed regulations

   • Replace any computation processes based on the Defence Force Retirement and Death Benefits (Annual Rates of Pay) Regulations 1979 or the 1973 regulations with procedures implementing the 2017 regulation, as Schedule 1 repeals those instruments in whole.
   • Where cases span the repeal date, document which regulatory rules were applied for calculations taking place before and after 29 August 2017.

9. Develop a verification and quality control regime

   • Put in place double-checking of source determinations and CPI figures before finalising pension amounts or lump sum conversions.
   • Ensure that payroll or benefits systems are updated to apply the longest-service or chaplain highest-rate rules where applicable.

10. Consult the Act for definitions and entitlement scaffolding

• The regulation frequently references subsections of the Act (for example subsection 3(1) for rank, and subsection 6BA(2)-(3) for pension and lump sum entitlements). Administrators must read the Act alongside the regulation to ensure the inputs are applied in the correct statutory context.

Following this checklist will align operational practice with the regulation’s textual requirements. Because the instrument does not itself set out dispute resolution or penalty processes, compliance is primarily demonstrated by correct application of the specified external determinations, accurate CPI sourcing and arithmetic, and by robust record-keeping showing the provenance of all numeric inputs used in benefit calculations.
