Defence Force Retirement and Death Benefits (Pension Increases) Act 1974

The Defence Force Retirement and Death Benefits (Pension Increases) Act 1974 is a specialised Australian statutory instrument enacted to provide retrospective and prospective increases to certain pensions and pension benefits. These pensions are payable under two distinct military superannuation schemes: the legacy scheme established under the Defence Forces Retirement Benefits Act 1948-1973 (DFRB) and the scheme established under the Defence Force Retirement and Death Benefits Act 1973-1974 (DFRDB). The Act operates as an indexation adjustment measure, designed to preserve the real purchasing power of military retirement and death benefits during a period of high inflation.

Mechanically, the Act establishes a formula-based adjustment process. The operation of the Act is deemed to have commenced on 1 July 1974, as specified in section 2. The financial increases authorised by the Act apply to pension instalments falling due on the pension pay-day of 4 July 1974, as well as all subsequent instalments, under sections 13 and 22. Rather than providing a flat-rate increase or relying on an ongoing discretionary indexation mechanism, the Act calculates a single, specific adjustment percentage (referred to as the "prescribed percentage") based on economic data from the March quarter of 1973 and the March quarter of 1974.

The cost of these pension increases is met directly by the public purse. Section 4 of the Act contains a standing appropriation that authorises the payment of all increased pension amounts directly out of the Consolidated Revenue Fund. By establishing this direct appropriation, the Act bypasses the need for annual budget allocations to cover these specific indexation increases, ensuring that the statutory entitlements of eligible veterans and their survivors are paid directly from central government funds.

Defence Force Retirement and Death Benefits (Pension Increases) Act 1974

No. 21, 1977

An Act to provide for Increases in certain Defence Force Retirement and Death Benefit Pensions

[Assented to 28 Nov 1974]

The Parliament of Australia enacts:

Part I—Preliminary

1 Short title

This Act may be cited as the Defence Force Retirement and Death Benefits (Pension Increases) Act 1974.

2 Commencement

This Act shall be deemed to have come into operation on 1 July 1974.

3 Interpretation

(1) For the purposes of this Act, the prescribed percentage is whichever is the lower of:

(a) 1.4 times the percentage that represents A—B expressed as a percentage of B; or

(b) the percentage that represents C—D expressed as a percentage of D;

where:

A is the all groups consumer price index number for the weighted average of the 6 State capital cities published by the Statistician in respect of the March quarter of the year 1974;

B is the all groups consumer price index number for the weighted average of the 6 State capital cities published by the Statistician in respect of the March quarter of the year 1973;

C is the estimate of the seasonally adjusted average weekly earnings per employed male unit throughout Australia published by the Statistician in respect of the March quarter of the year 1974; and

D is the estimate of the seasonally adjusted average weekly earnings per employed male unit throughout Australia published by the Statistician in respect of the March quarter of the year 1973.

(2) If, at any time, whether before or after the commencement of this Act, the Statistician has published in respect of the March quarter of the year 1974 or the March quarter of the year 1973, an all groups consumer price index number for the weighted average of the 6 State capital cities or an estimate of the seasonally adjusted average weekly earnings per employed male unit throughout Australia in substitution for an index number or estimate previously published by him in respect of that quarter, the publication of the later index number or estimate shall be disregarded for the purposes of this Act.

(3) If the prescribed percentage for the purposes of this Act is or includes a fraction of one‑tenth of 1 per centum:

(a) if that fraction is less than one‑half of one‑tenth—that fraction shall be disregarded; and

(b) if that fraction is not less than one‑half of one‑tenth—that fraction shall be treated as one‑tenth.

(4) A reference in this Act to the Statistician shall be read as a reference to the Commonwealth Statistician.

4 Increases to be paid out of Consolidated Revenue Fund

Amounts by which payments of pensions, or pension benefits, are increased by virtue of this Act are payable out of the Consolidated Revenue Fund, which is appropriated accordingly.

Part II—Increases in certain pensions payable under Defence Forces Retirement Benefits Act 1948‑1973

5 Incorporation with the Defence Forces Retirement Benefits Act

This part is incorporated, and shall be read as one, with the Defence Forces Retirement Benefits Act 1948‑1973.

6 Interpretation

In this Part, unless the contrary intention appears:

Defence Forces Retirement Benefits Act means the Defence Forces Retirement Benefits Act 1948‑1973, and includes any other Act relating to retirement benefits for members of the Defence Force that came into operation before 1 October 1972 and that modifies or affects the provisions of the Defence Forces Retirement Benefits Act 1948 or that Act as amended and in force from time to time.

pension means a pension payable under the Defence Forces Retirement Benefits Act.

7 Increase in certain pensions

If:

(a) the all groups consumer price index number for the weighted average of the 6 State capital cities published by the Statistician in respect of the March quarter of the year 1974 exceeds the all groups consumer price index number for the weighted average of the 6 State capital cities published by the Statistician in respect of the March quarter of the year 1973; and

(b) the estimate of the seasonally adjusted average weekly earnings per employed male unit throughout Australia published by the Statistician in respect of the March quarter of the year 1974 exceeds the estimate of the seasonally adjusted average weekly earnings per employed male unit throughout Australia published by the Statistician in respect of the March quarter of the year 1973;

a person to whom a pension (not being a pension payable to or in respect of an eligible child) was payable immediately before 1 July 1974 is entitled to an increase, as ascertained in accordance with section 8 or 9, in the annual amount of that pension.

8 Amount of increase in certain pensions

(1) Where, immediately before 1 July 1974, a pension was payable to a person:

(a) being a pension that became payable to the person before 1 July 1973; or

(b) being a pension that became payable, on or after 1 July 1973, to the person as a widow by reason of the death of a contributor who retired before 1 October 1972;

this section applies to the person.

(2) The increase provided for by section 7 in the annual amount of the pension payable to a person to whom this section applies is the prescribed percentage of an amount equal to the annual amount of the pension payable immediately before 1 July 1974 less:

(a) in the case of a pension referred to in paragraph (1)(a):

(i) subject to subparagraph (ii) or (iii)—22.5 per centum of the annual amount of the pension payable immediately before 1 July 1973;

(ii) if the pension is payable to the person under section 52 of the Defence Forces Retirement Benefits Act 1948‑1973 and the person has been re‑classified under section 53 of that Act on or after 1 July 1973 but before 1 July 1974 and his classification immediately before 1 July 1974 is different from his classification immediately before 1 July 1973—22.5 per centum of the annual amount of the pension that would have been payable to the person immediately before 1 July 1973 if his classification immediately before 1 July 1974 had been his classification on 30 June 1973; or

(iii) if a portion of the person’s pension has been commuted, or several portions of the person's pension have been commuted, on or after 1 July 1973 but before 1 July 1974—22.5 per centum of the annual amount of the pension that would have been payable to the person immediately before 1 July 1973 if that portion or those portions of his pension had been commuted on 29 June 1973; or

(b) in the case of a pension referred to in paragraph (1)(b)—22.5 per centum of the annual amount of the pension that would have been payable to the widow immediately before 1 July 1973 if her husband had died on 29 June 1973.

(3) Where a pension would, but for its suspension under section 53B of the Defence Forces Retirement Benefits Act 1948‑1973, have been payable to a person immediately before 1 July 1973 or immediately before 1 July 1974, that pension shall, for the purposes of this section, be deemed to have been payable to that person immediately before whichever of those dates is relevant, but any increase in that pension by virtue of this section does not take effect in respect of any part of that period of suspension.

9 Amount of increase in certain pensions to which section 8 does not apply

Where, immediately before 1 July 1974, a pension was payable to a person in accordance with section 82ZB of the Defence Forces Retirement Benefits Act 1948‑1973 (not being a pension that became payable after 15 June 1974) and:

(a) if the pension became payable to the person otherwise than as a widow—it became payable on or after 1 July 1973; or

(b) if the pension became payable to the person as a widow:

(i) if a pension in accordance with that section was not payable to the person’s husband immediately before his death—the pension became payable on or after 1 July 1973; or

(ii) if a pension in accordance with that section was payable to the person’s husband immediately before his death—the husband’s pension became payable on or after 1 July 1973;

this section applies to the person.

(2) Subject to the succeeding provisions of this section, the increase provided for by section 7 in the annual amount of the pension payable immediately before 1 July 1974 to a person to whom this section applies is an amount that bears to the amount determined in accordance with subsection (3) the same proportion as the number of months in the period that commenced on the day on which the pension referred to in paragraph (1)(a), or subparagraph (1)(b)(i) or (ii), as the case may be, became payable and ended on 30 June 1974 bears to 12.

(3) The amount to be determined in accordance with this subsection in relation to the pension payable to a person to whom this section applies is the prescribed percentage of 77.5 per centum of an amount equal to the annual amount of the pension immediately before 1 July 1974.

(4) If the period referred to in subsection (2) is less than 1 month, that period shall be treated as 1 month.

(5) If the period referred to in subsection (2) consists of a number of whole months and a part of a month:

(a) where the number of days in that part of a month is less than one‑half of the number of days in that month—that part of a month shall be disregarded; and

(b) where the number of days in that part of a month is not less than one‑half of the number of days in that month—that part of a month shall be treated as a whole month.

10 Modifications of certain sections of Defence Forces Retirement Benefits Act

(1) In calculating, for the purposes of pension payable under paragraph 55(1)(b) or 57(1)(b) of the Defence Forces Retirement Benefits Act 1948‑1973, the amount of the annual rate of the pension, being a pension under paragraph 55(1)(a) or 57(1)(a) of that Act, that is, or is to be deemed, by virtue of subsection 55(3) or 57(5) of that Act, to be, payable to a widow, any amount by which that amount is, or would have been, increased by virtue of the operation of this Part shall be taken into account.

(2) In calculating, for the purposes of pension payable under subsection 55(2) or 57(4) of the Defence Forces Retirement Benefits Act 1948‑1973, the amount of the annual rate of the pension, being a pension under paragraph 55(1)(a) or 57(1)(a) of that Act, that, but for the death of a widow, would have been payable, or would, by virtue of subsection 55(3) or 57(5) of that Act, have been deemed to have been payable, to the widow, any amount by which that amount would have been increased by virtue of the operation of this Part shall be taken into account.

(3) In calculating, for the purposes of pension payable under subsection 58(1) of the Defence Forces Retirement Benefits Act 1948‑1973, the amount of the annual rate of the pension, being a pension under paragraph 55(1)(a) or 57(1)(a) of that Act, that, but for the death or divorce of the wife of a contributor or pensioner, would have been payable to the wife, any amount by which that amount would have been increased by virtue of the operation of this Part shall be taken into account.

11 Rate of invalidity pension payable on re‑classification

Where, on or after 1 July 1974, a person to whom pension is payable under section 52 of the Defence Forces Retirement Benefits Act 1948‑1973 and who is entitled to an increase in the rate of his pension under this Part is re‑classified under section 53 of that Act, the rate at which pension is payable to him on and after the date from which the re‑classification has effect is the rate at which pension would have been payable to him on 1 July 1974 if he had been so re‑classified with effect on and from 30 June 1974.

12 Commutation of pensions on and after 1 July 1974

(1) Section 74 of the Defence Forces Retirement Benefits Act 1948‑1973 does not authorize the commutation of a pension in so far as the pension has been increased by virtue of this Part.

(2) Where, on or after 1 July 1974, a portion of the pension of a person who is entitled to an increase in the rate of his pension under this Part is commuted, then, as from the date on which that portion of his pension is so commuted, the annual amount of his pension shall be reduced to such amount as would, on 1 July 1974, have been the annual amount of the pension if he had commuted that portion of his pension on 29 June 1974.

13 Date of effect of increases

Where a pension benefit would, but for its suspension under section 35 of the Defence Force Retirement and Death Benefits Act 1973‑1974, have been payable to a person immediately before 1 July 1973 or immediately before 1 July 1974, that pension benefit shall, for the purposes of this Part, be deemed to have been payable to that person immediately before whichever of those dates is relevant, but any increase in that pension benefit by virtue of this Part does not have effect in respect of any part of that period of suspension.

20 Rate of invalidity pension benefit payable on re‑classification

Where, on or after 1 July 1974, a person to whom pension benefit, being invalidity pay, is payable under the Defence Force Retirement and Death Benefits Act 1973‑1974 and who is entitled to an increase in the rate of his pension benefit under this Part is re‑classified under section 34 of that Act, the rate at which pension benefit is payable to him on and after the date from which the re‑classification has effect is the rate at which pension benefit would have been payable to him on 1 July 1974 if he had been so re‑classified with effect on and from 30 June 1974.

21 Commutation of pension benefits on and after 1 July 1974

(1) Section 24 of the Defence Force Retirement and Death Benefits Act 1973‑1974 does not authorize the commutation of a pension benefit in so far as the pension benefit has been increased by virtue of this Part.

(2) Where, on or after 1 July 1974, a portion of the pension benefit of a person who is entitled to an increase in the rate of his pension benefit under this Part is commuted, then, as from the date on which that portion of his pension benefit is so commuted, the annual amount of his pension benefit shall be reduced to such amount as would, on 1 July 1974, have been the annual amount of his pension benefit if:

(a) he had commuted that portion of his pension benefit on 29 June 1974; and

(b) in a case where an anniversary of his birth occurs after 30 June 1974 and on or before the date of commutation—he had, on 29 June 1974, attained the age that is his age on the date of commutation.

Defence Force Retirement and Death Benefits (Pension Increases) Act 1974

No. 105, 1974

An Act to provide for Increases in certain Defence Force Retirement and Death Benefit Pensions

Contents

4 Increases to be paid out of Consolidated Revenue Fund

Part II—Increases in certain pensions payable under Defence Forces Retirement Benefits Act 1948‑1973

5 Incorporation with the Defence Forces Retirement Benefits Act

6 Interpretation

7 Increase in certain pensions

8 Amount of increase in certain pensions

The central mathematical engine of the Act is the "prescribed percentage" defined in section 3(1). This percentage is calculated as the lower of two alternative values. The first value is 1.4 times the percentage increase in the consumer price index (CPI) between the March quarter of 1973 and the March quarter of 1974. The second value is the percentage increase in seasonally adjusted average weekly earnings per employed male unit (AWE) over the same period. The formula uses the "weighted average of the 6 State capital cities" for the CPI component and the "seasonally adjusted average weekly earnings per employed male unit throughout Australia" for the wages component, as published by the Commonwealth Statistician.

To ensure administrative certainty and prevent ongoing recalculations, section 3(2) dictates that any subsequent revisions or substitutions of these indices published by the Statistician after the commencement of the Act must be entirely disregarded. Section 3(3) provides specific rounding rules, stating that if the prescribed percentage includes a fraction of one-tenth of 1 percent, any fraction less than one-half of one-tenth must be disregarded, while any fraction of one-half of one-tenth or more must be rounded up to the nearest one-tenth.

Another key concept is the distinction between geographical and operational full-year and part-year pensions. Under sections 8 and 17, full-year pensioners (those whose pensions became payable before 1 July 1973) receive an increase based on the entire prescribed percentage, subject to certain offsets. For Part II (DFRB) pensions, the base of the increase is the pension amount payable immediately before 1 July 1974, minus 22.5 percent of the pension payable as at 1 July 1973. For Part III (DFRDB) pensions, the base is restricted to 71.43 percent of the pension benefit payable immediately before 1 July 1974.

Part-year pensioners (those whose benefits commenced on or after 1 July 1973 but before 15 June 1974) receive a pro-rata increase calculated under sections 9 and 18. This pro-rata amount is determined by multiplying the base percentage (77.5 percent for DFRB and 71.43 percent for DFRDB) by a fraction representing the number of months the pension was active during the financial year divided by 12.

The Act directly affects several distinct classes of individuals and entities within the Australian defence and public administration sectors. The primary beneficiaries are retired Defence Force personnel and their eligible dependants who were receiving pensions or pension benefits immediately before 1 July 1974.

Specifically, under Part II, the Act affects retired military personnel receiving invalidity or retirement pensions under the Defence Forces Retirement Benefits Act 1948-1973 (DFRB) that commenced prior to 1 July 1973. It also affects widows of DFRB contributors who retired before 1 October 1972, whose widow pensions commenced on or after 1 July 1973 (section 8(1)(b)). Additionally, transferred or deferred contributors receiving pensions under section 82ZB of the DFRB Act who retired during the 1973-1974 financial year are affected by the part-year adjustment provisions of section 9.

Under Part III, the Act affects recipients of pension benefits under the newer Defence Force Retirement and Death Benefits Act 1973-1974 (DFRDB) scheme. This includes retirees whose pension benefits became payable before 1 July 1973, as well as widows and eligible children whose benefits commenced on or after 1 July 1973 due to the death of a member who retired before 1 July 1973 (section 17(1)). It also captures members who retired or died on or after 1 July 1973 who were contributing members on 30 June 1973 (section 18(1)).

Beyond individual recipients, the Act affects the Commonwealth Statistician, who is responsible for providing the baseline CPI and AWE figures under section 3. It also affects the administrative officers within the Defence Force retirement authorities who must perform the calculations and implement the adjustments. Finally, it affects the Commonwealth Department of Finance and the Treasury, which must administer the standing appropriation out of the Consolidated Revenue Fund under section 4.

The Act establishes clear statutory rights for eligible pensioners and corresponding duties for the administrators of the defence retirement schemes. Eligible individuals have a legally enforceable right to receive the calculated increase in their annual pension or pension benefit starting from the pension pay-day on 4 July 1974 (sections 13 and 22). This right is absolute, provided that the underlying statistical thresholds in sections 7 and 16 are met (namely, that the March 1974 CPI and AWE figures exceed the March 1973 figures).

The administrative administrators of the DFRB and DFRDB schemes have a duty to correctly apply the statutory formulas to compute the "prescribed percentage" and the resulting increases. They must accurately distinguish between the legacy DFRB pensions under Part II and the DFRDB pension benefits under Part III, as these parts contain different deduction thresholds (22.5 percent of the 1973 pension for DFRB under section 8, compared to a flat 71.43 percent base for DFRDB under section 17).

Administrators are also under a duty to apply the pro-rata formulas for part-year retirees under sections 9 and 18. This involves determining the precise start date of the pension, calculating the active months, and applying the rounding rules for parts of a month (disregarding periods under half a month, and rounding up to a full month for periods of half a month or more).

Crucially, the Act limits the rights of pensioners regarding commutation. Under sections 12(1) and 21(1), the Act explicitly provides that the statutory provisions allowing for the commutation of pensions (section 74 of the DFRB Act and section 24 of the DFRDB Act) do not authorise the commutation of the increased portion of the pension granted under this Act. If a pensioner commutes a permissible portion of their pension on or after 1 July 1974, the administrators have a duty to reduce the annual pension to an amount that would have been payable if the commutation had occurred on 29 June 1974, which prevents pensioners from capitalising the indexation increase.

Because the Defence Force Retirement and Death Benefits (Pension Increases) Act 1974 is an appropriating and rate-adjusting statute rather than a regulatory or criminal act, it does not contain any civil or criminal penalty provisions. There are no fines, administrative penalties, or terms of imprisonment established under this Act for non-compliance.

Instead, enforcement of the Act is achieved through public law mechanisms and administrative law oversight. If the administrating authority fails to pay the increased pension amounts, or miscalculates the prescribed percentage, affected pensioners can seek administrative review of the decision. Under the incorporated parent Acts (the DFRB Act and the DFRDB Act), decisions regarding the rate of pension payable are subject to formal internal review and external merits review processes.

From the perspective of public administration, compliance with the Act is enforced through financial auditing. The Australian National Audit Office (ANAO) has the authority to audit the accounts of the defence retirement schemes to ensure that all payments made out of the Consolidated Revenue Fund under the section 4 appropriation comply strictly with the statutory formulas. Any overpayment or underpayment resulting from a failure to properly apply the CPI and AWE formulas, or from a failure to enforce the commutation exclusions under sections 12 and 21, would constitute a breach of public finance legislation and would be highlighted in audit reports to Parliament.

The Act is designed to operate in close integration with existing defence superannuation legislation. It does not stand alone as an independent regulatory framework. Instead, Part II of the Act is explicitly incorporated, and must be read as one, with the Defence Forces Retirement Benefits Act 1948-1973 (section 5). Similarly, Part III of the Act is incorporated, and must be read as one, with the Defence Force Retirement and Death Benefits Act 1973-1974 (section 14). This means that all definitions, administrative powers, and review mechanisms contained in the parent Acts apply to the calculations and payments made under this Act.

The Act also directly modifies the operation of specific provisions within those parent Acts. For example, section 10 of the Act modifies paragraphs 55(1)(b), 57(1)(b), 55(2), 57(4), and subsection 58(1) of the DFRB Act. These provisions relate to the calculation of derivative pensions payable to widows and dependants upon the death of a pensioner or contributor. Section 10 ensures that any indexation increases granted to the primary pensioner under Part II are fully taken into account when calculating the derivative pension rate for their survivors.

Similarly, sections 11 and 20 of the Act interact with the invalidity reclassification provisions of the parent Acts (section 53 of the DFRB Act and section 34 of the DFRDB Act). If a pensioner is reclassified on or after 1 July 1974, these sections dictate that their new pension rate must be calculated as if the reclassification had taken effect on 30 June 1974, ensuring that the indexation increases are applied correctly to the updated classification level.

Furthermore, the Act interacts with federal statistical and public finance laws. The calculation of the prescribed percentage relies directly on data published by the Commonwealth Statistician under the Census and Statistics Act 1905. The funding mechanism in section 4 operates as a standing appropriation under the Australian Constitution, bypassing the standard annual appropriation bills to ensure automatic payment of the indexed increases.

The Defence Force Retirement and Death Benefits (Pension Increases) Act 1974 is a historical piece of legislation designed to address a specific economic circumstance, namely the rapid inflation experienced in Australia between 1973 and 1974. Because its primary operational provisions were tied to a single adjustment date (1 July 1974) and a specific pair of quarters (the March quarters of 1973 and 1974), the Act has a very limited amendment history.

The text of the statute contains a reference to "No. 21, 1977" under the main title. This reflects a subsequent amending Act, the Defence Force Retirement and Death Benefits Amendment Act 1977, which made minor administrative and consequential adjustments to the consolidated statutory framework governing defence pensions.

Unlike modern indexation provisions, which are typically embedded permanently within parent Acts and operate automatically every year, this 1974 Act was a standalone legislative intervention. During the 1970s, the Australian Parliament frequently passed separate, specific-purpose pension increase Acts to adjust defence pensions in response to prevailing economic conditions. Consequently, the historical significance of this Act lies in how it adjusted the baseline pension rates for veterans of that era. These adjusted rates then formed the foundation for all subsequent indexation adjustments enacted in later years. The Act remains on the statute book as an active historical component of the cumulative legislative framework that determines the current pension rates for long-term DFRB and DFRDB recipients.

There are no judicial decisions or legal cases named in the source text of this legislation. Because the Act relies on highly prescriptive, mathematical formulas rather than discretionary administrative powers, it has not generated a significant body of direct litigation.

Disputes involving defence pensions from this era typically center on the provisions of the underlying parent Acts (the DFRB Act and the DFRDB Act) rather than the indexation mechanism itself. For example, litigation frequently arises over invalidity classifications under section 53 of the DFRB Act or section 34 of the DFRDB Act, where medical evidence and administrative interpretation can lead to differing conclusions. Because this Act incorporates those parent Acts, any judicial interpretation of classification terms directly affects how the indexation increases are applied under sections 11 and 20 of this Act.

Furthermore, the strict drafting of section 3(2) of this Act serves to block potential litigation regarding statistical revisions. By declaring that any subsequent revisions of CPI or AWE published by the Statistician must be disregarded, the legislature removed any legal grounds for pensioners to sue the Commonwealth for retrospective back-payment if the underlying economic statistics were later found to be inaccurate or were revised upward. This statutory finality protects the Commonwealth from retrospective liability and simplifies the administration of the pension funds.

A significant pitfall for individuals under this Act is the "lower-of" indexation mechanism established in section 3(1). While pensioners might assume that their benefits are fully indexed to inflation, the "prescribed percentage" is capped by whichever is lower: 1.4 times the percentage increase in CPI, or the percentage increase in average weekly earnings (AWE). If wages grow rapidly but CPI is low, or if CPI rises dramatically but wage growth is sluggish, the pension increase is restricted to the lower resulting figure. This double-threshold test can result in pension adjustments that do not fully match the actual cost-of-living increases experienced by veterans.

Another operational risk is the exclusion of statistical revisions under section 3(2). If the Commonwealth Statistician publishes an incorrect index number or wage estimate for the March quarter of 1973 or 1974, and later publishes a corrected, higher figure, the corrected figure is legally irrelevant. Pensioners have no statutory right to demand a recalculation or back-payment based on the corrected economic data.

The commutation rules in sections 12 and 21 also contain significant traps. While veterans have a right under the parent Acts to commute a portion of their pension into a lump sum, they cannot commute any portion of the pension that represents an indexation increase granted under this Act. This creates a split pension benefit where the base pension is commutable but the indexation component is not.

Furthermore, under sections 12(2) and 21(2), if a pensioner commutes any portion of their pension on or after 1 July 1974, their annual pension is retrospectively reduced to the amount that would have been payable if the commutation had occurred on 29 June 1974. Under section 21(2)(b), this retrospective reduction is compounded if the pensioner has a birthday between 30 June 1974 and the date of the actual commutation, as they are deemed to have attained their older age on 29 June 1974. This can result in a permanent, unexpected reduction in the ongoing pension rate.

Finally, suspended pensions are subject to a strict penalty under sections 8(3) and 19. If a pension is suspended (for example, due to re-employment or failure to comply with administrative requirements), the pensioner is deemed eligible for the indexation increase upon the resumption of the pension, but they are explicitly barred from receiving any indexation payments for the period of the suspension. The increase is completely forfeited for the duration of the suspension.

For individual pension recipients, compliance with the Act is largely passive, as the calculations and adjustments are performed automatically by the government administrators of the DFRB and DFRDB schemes. Pensioners do not need to submit formal applications or proof of entitlement to receive the increases. However, pensioners must comply with the commutation restrictions. Before attempting to commute any portion of their pension under the parent Acts, a pensioner must consult with the administering authority to ensure they do not attempt to liquidate the indexation increases granted under this Act, which are strictly non-commutable.

For administrative officers, compliance requires meticulous adherence to the statutory steps set out in the Act. First, administrators must calculate the "prescribed percentage" by obtaining the official CPI and AWE figures for the March quarters of 1973 and 1974 from the Commonwealth Statistician. They must apply the formula in section 3(1) and determine which of the two calculations yields the lower percentage. Any subsequent corrections published by the Statistician must be actively ignored in accordance with section 3(2).

Second, administrators must apply the rounding rules in section 3(3) to the prescribed percentage, rounding any fraction of one-tenth of a percent up or down based on the 0.05 threshold.

Third, administrators must segregate the pension pool into DFRB and DFRDB recipients. For DFRB recipients under Part II, they must apply section 8 or section 9. For section 8, they must subtract 22.5 percent of the pension payable as at 1 July 1973 from the pension payable as at 1 July 1974 before applying the prescribed percentage. For section 9 (part-year pensions), they must calculate the pro-rata fraction based on the active months and apply the 77.5 percent base rate.

Fourth, for DFRDB pension benefits under Part III, administrators must apply section 17 or section 18. This requires applying the prescribed percentage to exactly 71.43 percent of the annual pension benefit payable immediately before 1 July 1974. For part-year recipients under section 18, the pro-rata fraction must be calculated using the active months and the 71.43 percent base rate, applying the mid-month rounding rules in subsections 18(5) and (6).

Fifth, administrators must monitor all commutation requests on or after 1 July 1974. They must ensure that no indexation increase is commuted. If a permissible commutation occurs, they must recalculate the remaining pension rate retrospectively as if the commutation had occurred on 29 June 1974, applying the age adjustment rule in section 21(2)(b) where applicable.

Sixth, if an invalidity pensioner is reclassified under section 53 of the DFRB Act or section 34 of the DFRDB Act on or after 1 July 1974, the administrator must recalculate the pension rate as if the reclassification had taken effect on 30 June 1974, ensuring the indexation percentage is applied to the newly determined rate. All increased payments must be drawn directly from the Consolidated Revenue Fund under the standing appropriation in section 4. Finally, administrators must ensure that no increases are paid to pensioners during any period of pension suspension, in compliance with sections 8(3) and 19.
