Defence Force Retirement and Death Benefits (Family Law Superannuation) Orders 2004

The Orders rest on a handful of recurring technical concepts that govern how family law splits are operationalised in the DFRDB Scheme. These include scheme value, transfer amount, associate pension, small associate pension commutation, indexation base and procedure, operative time and pre‑/post‑split entitlements, and reduction factors. Each concept is defined or given procedural effect in the Orders and ties back to the Act or the Family Law Act.

Scheme value. The Orders tell administrators how to calculate the scheme value for a member spouse (s 2.01). Step 1 instructs use of the methodology and factors used to determine family law value under s 90MT of the Family Law Act. Step 2 requires substituting the family law factors with those nominated by an actuary for these Orders. Step 3 requires applying the identified methodology with the actuary‑nominated factors to obtain the scheme value. The Orders therefore separate methodology (court or regulation‑approved approach) from numeric factors (actuary‑supplied).

Transfer amount and associate pension. The transfer amount appears in the Act (see cross‑reference to s 49B(2)). The Orders prescribe in s 2.02 that the annual rate of an associate pension payable to a non‑member spouse is the transfer amount divided by a pension factor nominated by an actuary for the Orders. The Orders note that the associate pension excludes a reversionary component. Practically, this links a lump transfer figure to an annual pension by an actuarial conversion factor.

Small associate pension commutation. The Orders set a monetary threshold for commutation. Section 2.04 fixes the commutation amount at $1,303.03 and prescribes indexation mechanics from 1 January 2005 onwards using the CPI method in s 2.05. The Orders therefore establish when an associate pension can be commuted to a lump sum and how that threshold moves with inflation.

Indexation mechanics and dates. The Orders use the all groups consumer price index for the weighted average of the eight capital cities as published by the Australian Statistician. Indexation comparisons use the CPI number for the first quarter of specified half‑years (s 1.03 definitions of first quarter and prescribed half‑year; s 2.03 and s 2.05). For associate pensions, the relevant comparison looks at the CPI for the first quarter of the half‑year immediately preceding a prescribed half‑year against the highest earlier first‑quarter CPI for any earlier half‑year (s 2.03(1), (4)). For the small associate pension amount, the indexation comparison excludes half‑years earlier than the half‑year that commenced 1 January 2004 (s 2.05(1)). Indexation uses percentage increases expressed as A - B over B (s 2.03(4) and s 2.05(2)).

Operative time and reduction of later benefits. The Orders provide detailed stepwise calculations to reduce future pensions and lump sums payable to the member spouse in respect of an original interest after the operative time (ss 2.06-2.10). They separate the indexed and non‑indexed components of pensions and reversions, apply a reduction factor (the Orders include the formula in the text) and then adjust for indexation between the operative time and the later pension commencement by reference to Part XA of the Act. The orders therefore operationalise how an earlier split affects benefits that only become payable later.

Role of actuary, Statistician and Attorney‑General. The Orders repeatedly delegate numeric decisions to an actuary who nominates pension and valuation factors (s 2.01 step 2; s 2.02 step 2; multiple reduction steps require factors identified by the Actuary). The Orders rely on CPI data published by the Statistician (s 1.03 and s 2.03). The Orders reference family law methodology that may include Attorney‑General approved methodologies under s 90MT(3) of the Family Law Act (s 2.01 note). Thus the instrument is a coordination of judicial/regulatory valuation methodology, actuarial numeric inputs, and official CPI data.

Timing definitions and rounding rules. The Orders define first quarter relative to half‑years and prescribe rounding rules for partial months when calculating indexation pro‑rata amount where the member spouse’s pension first became payable part way through a preceding half‑year (s 2.03(5)-(7)). They define “prescribed half‑year” as the half‑year commencing 1 January 2002 or any subsequent half‑year (s 1.03). These timing rules materially affect the quantum of indexation owed.

Together these concepts form a mapping from the family law valuation outcome (family law value and payment split) to the Scheme’s actuarial and payment outcomes, using CPI, nominated actuarial factors and procedural dates as inputs.

The Orders affect multiple classes of actors directly and indirectly. Primary affected persons are DFRDB Scheme member spouses, non‑member spouses (former partners receiving family law transfers), Scheme administrators and actuaries engaged to supply factors, and the Departmental official responsible for implementing reductions, indexation and commutations. The Orders also implicate courts and family law practitioners in that they rely upon family law valuation processes under s 90MT of the Family Law Act and the Family Law (Superannuation) Regulations 2001.

Member spouses. The Orders change how future Scheme payments to a member spouse are reduced when a family law payment split affects an original interest and the member spouse’s standard pension or lump sum becomes payable after the operative time. Sections 2.06 and 2.07 show how pre‑split retirement percentages and hypothetical entitlement at the operative time are used to calculate reductions in later standard pension rates and lump sums. Sections 2.08-2.10 give stepwise reductions for pensions and reversionary pensions that are payable later or under s 38 of the Act. Practitioners advising members must be prepared that post‑split payments will be calculated using actuarial factors and an indexation framework specified by the Orders.

Non‑member spouses. Non‑member spouses are affected because their transfer amount and any associate pension are given a specific conversion and indexation treatment. Section 2.02 prescribes calculation of an associate pension by dividing the transfer amount by an actuary‑nominated pension factor. Section 2.03 sets out indexation rules for associate pensions in prescribed half‑years. Section 2.04 fixes the threshold for commutation (initially $1,303.03) and mandates indexing for that threshold (s 2.05). The Orders explicitly state that the associate pension does not include a reversionary component, which affects survivor benefits.

Scheme administrators and actuaries. Administrators implement the mechanical steps: identify the family law methodology and family law value; substitute actuarial factors; compute scheme value (s 2.01); determine transfer amounts and convert to pensions or commutations (ss 2.02-2.05); and apply reduction and indexation algorithms for later entitlements (ss 2.06-2.10). The actuary has recurring decision power: the Orders require the actuary to nominate factors for conversion and valuation. This produces an ongoing dependency on the actuary’s inputs and methodology choices designated for these Orders.

Courts and family law practitioners. The Orders require use of the family law valuation methodology identified in s 90MT of the Family Law Act (s 2.01 step 1). Any family law splitting order or consent order that produces a family law value or transfer amount will therefore feed into these Orders’ processes. Legal advisers must therefore understand both the family law valuation regime (including methodology and any Attorney‑General approved methodologies under s 90MT(3)) and the Orders’ requirement to substitute actuary factors.

Government agencies and data providers. The Orders rely on the Australian Statistician’s CPI publications for specified quarters, which places a compliance dependency on that data path. The Attorney‑General’s prior approvals of methodology under the Family Law Act are referenced. Departments responsible for the DFRDB Scheme must ensure alignment with the Act and the Orders, apply amendments (for example those made in 2004 and 2012) and maintain records necessary to compute indexed amounts and reductions.

Indirectly affected persons. Beneficiaries with reversionary rights, heirs, financial advisers and accountants who model retirement incomes will be affected because the Orders shape future cash flows and the presence or absence of reversionary components. For instance, the Orders instruct how to compute reductions in indexed and non‑indexed components separately, an outcome that affects income projections and taxation profiles.

The Orders therefore allocate financial consequences across parties: non‑member spouses receive value converted using actuarial factors and CPI indexing; member spouses have later benefits reduced by actuarial‑determined proportions and indexation adjustments; administrators and actuaries bear the implementation burden and the need to coordinate CPI and Part XA indexation mechanics.

The Orders set out duties for administrators and actuarial roles and confer entitlements to indexation and commutation for recipients. The instrument primarily translates family law outcomes into Scheme adjustments, so duties and rights are operational rather than normative.

Duties of administrators and actuaries. Administrators must apply the multi‑step calculations in Part 2 for each affected original interest. Specific duties include:

• Determine scheme value by following the family law methodology in s 90MT of the Family Law Act and substituting actuary‑nominated factors for the family law factors, as required by s 2.01. This duty binds administrators to consult the family law valuation method and the actuary’s nominated factors.
• Calculate the annual rate of associate pension for a non‑member spouse by dividing the transfer amount by the pension factor nominated by an actuary for these Orders (s 2.02). The administrative duty is to obtain and apply the correct pension factor corresponding to the non‑member spouse’s age and gender.
• Apply indexation adjustments to associate pensions when the CPI test in s 2.03(1) is met, and compute pro‑rata increases where the member spouse’s pension first became payable part way through the preceding half‑year using the formula in s 2.03(5)-(7).
• Maintain and index the small associate pension commutation threshold initially set at $1,303.03 (s 2.04) and index it from 1 January 2005 and thereafter on each 1 January and 1 July as provided (s 2.04(2)-(3)), using the CPI method in s 2.05.
• For pensions and lump sums becoming payable after the operative time, compute reductions according to the stepwise procedures set out in ss 2.06-2.10. This includes separating indexed and non‑indexed components, applying reduction factors, applying Part XA indexation for indexed components between operative time and later commencement, and computing current values at the later pension start date.

Duties around recordkeeping, timing and CPI. Administrators must track operative times, the dates pensions become payable, the relevant prescribed half‑years and the CPI first quarter figures relied upon (s 1.03 definitions and ss 2.03, 2.05). The Orders mandate specific rounding rules for partial months when computing pro‑rata increases (s 2.03(7)), which must be applied.

Rights of recipients. Non‑member spouses have an entitlement under the Act to receive an associate pension where the Act provides, and s 2.02 prescribes the calculation rule for the annual rate. Section 2.03 grants a right to receive an increase in the rate of an associate pension at the commencement of a prescribed half‑year if the CPI test is met. Section 2.04 creates the right to commute a small associate pension where the pension falls at or below the order’s amount; the threshold is itself indexed over time by ss 2.04-2.05. Member spouses have a right to a post‑split pension or lump sum that reflects the pre‑split entitlements less reductions calculated under the Orders. Where reversionary pensions are in play, the Orders set the right to adjusted indexed and non‑indexed reversionary pensions post‑split (ss 2.08-2.10).

Delegated decision roles. The Orders give the actuary a recurring role to nominate factors for conversion and valuation (s 2.01 step 2; s 2.02 step 2; multiple steps referencing factors identified by the Actuary). The Orders also specify that CPI data is to be taken from the Statistician’s publications (s 1.03). An Attorney‑General approved methodology under s 90MT of the Family Law Act is noted as a possible basis for family law value determination that the Orders must take as the methodological starting point (s 2.01 note). These are not discretionary rights but delegated decision inputs which must be obtained and applied.

Interaction with the Act. The Orders implement duties that flow from the Act’s family law splitting provisions by providing the arithmetic to satisfy statutory hooks in ss 49A-49E. The Orders do not confer novel entitlements beyond implementing the Act’s requirements; they prescribe how statutory concepts (scheme value, transfer amount, operative time, associate pension) are quantified for the DFRDB Scheme.

In short, administrators must obtain actuarial inputs, apply family law valuation methodology adapted to scheme factors, compute pensions and commutations using CPI data, and reduce future benefits according to explicit formulas. Recipients have enforceable monetary entitlements whose quantum will be determined by these prescribed steps.

The Orders themselves do not create criminal or civil penalties within their text. They are subordinate regulations that prescribe calculation methods and indexation rules; enforcement of those methods rests through the Act’s administrative and remedial structures rather than by separate offences in the Orders. The Orders reference and implement provisions in the Defence Force Retirement and Death Benefits Act 1973, which will contain the substantive enforcement and dispute resolution mechanisms for scheme entitlements and administrative compliance (the Orders refer to the Act in s 1.03 and throughout Part 2).

Administrative compliance and correction. Because the Orders set binding procedures for calculating monetary amounts (for example, scheme value, associate pension rates, commutation thresholds and reductions of pensions and lump sums), failure by administrators to apply those procedures correctly will produce administrative error for which remedies under the Act may be available. The Orders’ stepwise calculations provide an objective standard against which an administrator’s calculations can be tested. The Act will be the instrument through which errors are corrected, by recalculation, adjustment to payments, or other remedies the Act permits.

Dispute resolution and court review. The Orders themselves do not confer a novel dispute forum. Any dispute over the application of the Orders will therefore be litigated or resolved within the framework the Act supplies and within the family law processes that generated the initial family law value or transfer amount. The Orders repeatedly reference family law valuation methodology (s 2.01) and rely upon definitions from s 49A of the Act (s 1.03(2)). A party dissatisfied with the use of factors or with indexation or reduction calculations would need to pursue remedies available under the Act, or seek a judicial review or court declaration on the correct application of the Act and these Orders where available under Commonwealth administrative law.

Enforcement via actuarial inputs and administrative practice. The Orders confer recurring operational duties on actuaries and administrators. While the Orders do not specify penalties for an actuary nominating inappropriate factors, the practical enforcement mechanism is professional accountability of the actuary, administrative review, and potential legal challenge by affected parties. For example, incorrect nomination of pension factors that leads to an incorrect associate pension rate could expose the administrator to corrective liability under the Act if challenged.

Indexation and timing errors. Because the Orders tie indexation to specific CPI publications and to precise quarter definitions, errors in sourcing the Statistician’s figures, misidentifying the “first quarter” applicable to a half‑year, or misapplying the “highest earlier” CPI test could produce material miscalculations. The Orders therefore create an administrative enforcement risk in the sense that staff and systems must faithfully implement CPI retrieval and the specified comparisons; incorrect implementation will not be excused by the Orders and will be corrected through the Act’s ordinary mechanisms.

Amendments and retrospective application. The Notes identify amendments (2004 No. 408; 2012 No. 1). The Orders specify commencement rules (s 1.02). Any retrospective application of amended calculation rules would be governed by the Act and any saving or transitional provisions noted in the Orders’ amendments (see the Notes table for commencement and application information). The Orders themselves do not impose separate fines, but their correct application is enforceable by the State via the Act’s remedies and by affected persons via legal challenge.

In summary, enforcement is administrative and corrective through the Act rather than penal via these Orders. The Orders provide objective calculation standards which are enforceable through the Act’s compliance, correction and dispute mechanisms.

The Orders are explicitly cross‑referential and dependent on several statutory instruments and statutory definitions. The instrument interacts mechanically and legally with:

• the Defence Force Retirement and Death Benefits Act 1973 (the Act), under which the Orders are made, and which contains the substantive family law splitting provisions and definitions the Orders operationalise (see s 1.03(1) references to the Act and s 1.03(2) referencing s 49A definitions);
• the Family Law Act 1975, in particular section 90MT and associated regulations and approvals, which supply the family law valuation methodology the Orders must use as their starting point for scheme value calculations (s 2.01 step 1 and the accompanying Note referring to s 90MT of the Family Law Act);
• the Family Law (Superannuation) Regulations 2001 (FLS Regulations), which are quoted in the Orders as setting out how family law value is determined (s 2.01 note indicates the family law value is determined in accordance with the FLS Regulations made for paragraph 90MT(2)(a) of the Family Law Act);
• Part XA of the Defence Force Retirement and Death Benefits Act 1973, which is referenced for indexation of indexed pension components when computing increases between the operative time and the later pension commencement (ss 2.09(1) step 6(a) and 2.10 step 5(a));
• Australian Bureau of Statistics publications, via the Australian Statistician’s CPI figures for the weighted average of the eight capital cities, which the Orders use as the indexation data source (s 1.03 definition of Statistician and s 2.03, s 2.05 indexation rules).

Operational dependency on Family Law valuation. The Orders assume the family law framework supplies a family law value or transfer amount (s 2.01 step 1 and s 2.02 step 1). The Orders then overlay scheme‑specific actuarial factors nominated by an actuary for conversion into scheme terms. Thus the Orders are not a substitute for family law valuation; they are contingent on family law outcomes and designed to ensure the Scheme gives effect to those outcomes in its own benefit framework.

Actuarial inputs and regulatory convergence. The Orders require actuary‑nominated factors to be used instead of the general pension factors in Schedule 4 to the FLS Regulations (s 2.02 note). That creates a site of interaction between superannuation regulation under family law and scheme‑specific actuarial practice, and it requires practitioners to reconcile family law regulatory standards with the Scheme’s actuarial practice. The Attorney‑General’s approval power under s 90MT(3) of the Family Law Act is acknowledged as potentially relevant to the methodology used in family law valuations (s 2.01 note).

Indexation and national statistical law. The Orders explicitly rely on CPI figures published by the Australian Statistician. This ties scheme indexation to national statistics and to the timing and definition of CPI quarters. Because the Orders choose the “first quarter” CPI for the half‑year in question rather than a headline quarterly movement or average, the choice engages the CPI publication schedule and its definitional content. That selection may have consequences vis‑à‑vis other statutory indexation regimes which use different bases or periods.

Interaction with amendments and commencement rules. The Notes set out commencement and amendment details (see the Notes table). Administrators and advisers must therefore interpret these Orders in light of the amendments listed (2004 No. 408; 2012 No. 1) and the commencement dates set in the Notes. The Orders’ operation may therefore be layered over transitional provisions in the Act or in the amending instruments.

In sum, the Orders are heavily interdependent with family law valuation rules (Family Law Act and FLS Regulations), the Defence Force Act’s own indexation regime (Part XA), published ABS CPI data, and actuarial practice. Practitioners must be fluent in all these regimes to apply the Orders correctly.

The compilation supplied includes an explicit Notes section that records the Orders as a 2004 instrument (Statutory Rules 2004 No. 99) and identifies later instruments that affected the Orders. The key items in the Notes are:

• Defence Force Retirement and Death Benefits (Family Law Superannuation) Orders 2004, Statutory Rules 2004 No. 99, notified 20 May 2004 and commenced 18 May 2004 (see Note: Table of Instruments in the Notes).
• An amendment instrument, Statutory Rules 2004 No. 408, notified 24 December 2004, with parts commencing 1 July 2004 for ss 1-3 and Schedule 1, and remainder commencing 24 December 2004. The Notes table indicates that s 2.04 and s 2.05 were amended by 2004 No. 408 (see Table of Amendments lines for S.2.04 and S.2.05 marked "am. 2004 No. 408").
• A later amendment, Defence Force Retirement and Death Benefits (Family Law Superannuation) Amendment Order 2012 (No. 1), F2012L01662, notified 7 August 2012 and commencing 1 January 2008 (Notes table). The 2012 instrument is recorded as having added s 2.09 and s 2.10 or otherwise as “ad. 2012 No. 1” in the Table of Amendments (see entries for S.2.09 and S.2.10).

The Notes also identify that the Orders were compiled on 8 August 2012 taking into account amendments up to the 2012 Amendment Order No. 1. The Table of Instruments and the Table of Amendments in the Notes give specific instrument numbers and dates of notification and commencement for traceability. The Notes show that Part 2 (the substantive calculation rules) has been the subject of amendment activity.

The Orders themselves specify commencement as the commencement of Schedule 1 to the Superannuation Legislation Amendment (Family Law and Other Matters) Act 2004 (s 1.02). The Notes table gives granular dates for various amendment commencements for those instruments.

Practitioners should therefore be attentive to:

• the initial 2004 instrument as the primary text for Part 2 calculations;
• the 2004 No. 408 amendments, which changed s 2.04 and s 2.05 dealing with the small associate pension amount and its indexation; and
• the 2012 No. 1 amendment, which added or adjusted ss 2.09 and 2.10 to expand or clarify reductions for later reversionary and standard pensions payable under s 38 of the Act.

The Orders’ Notes make clear that amendment history is recorded in the compilation’s Tables. The Orders as presented must therefore be read together with the amendments listed in the Notes to ensure application of the current law. The Orders themselves do not include text about how the amendments operate beyond the ordinary commencement and application entries recorded in the Tables, so administrators will need to ensure they are working from the consolidated version that includes the 2004 and 2012 changes referenced.

The compilation provided contains no cases, judicial decisions or litigation history. The Orders’ text and the accompanying Notes do not list judicial determinations, appeals or decisions that have interpreted these Orders. The Orders themselves reference relevant statutory provisions in the Defence Force Retirement and Death Benefits Act 1973 and the Family Law Act 1975 but do not report case law applying them.

Because this compilation contains no litigation history, two practical consequences arise for practitioners:

• The Orders’ wording and prescribed formulas stand as the primary guidance for calculation unless and until courts have interpreted particular provisions. Absence of recorded litigation in the compilation means there are no settled judicial glosses reported within this instrument’s Notes.
• If disputes arise in practice about actuarial factors, the proper application of reduction factors, the treatment of indexed versus non‑indexed components, the correct CPI figure for a prescribed half‑year, or the meaning of “operative time” in a particular factual matrix, those disputes will have to be litigated or resolved administratively without statutory guidance from any reported decisions in the text provided.

Practitioners should therefore anticipate that the Orders will be the site of factual and technical disputes susceptible to judicial review or family law contest, but this compilation does not record any such cases. Where parties litigate the interpretation or application of these Orders, decisions would appear in external case law databases and would need to be located separately. The Orders do make frequent cross‑references to definitions in s 49A of the Act and to family law valuation regimes under s 90MT of the Family Law Act; any litigation is likely to require integrated consideration of those statutory contexts as well as actuarial evidence.

In the absence of litigation history in the Orders compilation, it is prudent for practitioners to treat areas of technical discretion as high‑risk for dispute. Such areas include the actuary’s nominated factors, determination of hypothetical entitlement at the operative time, application of the indexation “highest earlier” CPI rule, pro‑rata calculations for partial months (s 2.03(5)-(7)), and the application of Part XA indexation when working out reductions for later pensions (ss 2.09-2.10). Those are the points that would, in practice, generate contested expert evidence if a dispute arose, but no decisions are recorded in the Orders compilation to indicate how courts might resolve contested technical points.

The Orders contain a number of technical features and drafting choices that create practical pitfalls. These are operational risks and points where incorrect application will change payment outcomes materially. The following items are concrete “gotchas” drawn from the Orders themselves.

Actuary‑nominated factors replace family law factors. The Orders require substitution of family law factors with factors nominated by an actuary for the Orders (s 2.01 step 2). Section 2.02 notes that Schedule 4 to the FLS Regulations sets out general pension factors but that those are not specific to Act benefits. Practitioners must not assume the FLS Regulations’ factors apply to DFRDB calculations; instead they must obtain the actuary’s nominated factors. Failure to do so will produce an incorrect scheme value or associate pension.

“First quarter” is quarter of the half‑year, not calendar quarter. The Orders’ definition of first quarter depends on whether the half‑year begins 1 January or 1 July (s 1.03). For a half‑year beginning 1 January, the relevant first quarter is the March quarter; for a half‑year beginning 1 July, the relevant first quarter is the September quarter. Misidentifying which quarter to use for CPI comparisons will change indexation outcomes in ss 2.03 and 2.05.

Prescribed half‑year date base. “Prescribed half‑year” is defined as the half‑year commencing 1 January 2002 or a subsequent half‑year (s 1.03). Section 2.03 and 2.05 only operate in relation to prescribed half‑years. Practitioners should note that earlier half‑years are excluded, and that s 2.05 explicitly excludes half‑years earlier than the half‑year commencing 1 January 2004 for its CPI comparison (s 2.05(1)). Using an incorrect base period will distort indexation.

Associate pension excludes reversionary component. The Orders note that the associate pension “does not include a reversionary component” (s 2.02 note). This matters for survivors: a non‑member spouse receiving an associate pension under these rules does not obtain a reversionary component via the associate pension itself. Practitioners must therefore track any separate reversionary entitlements under the Act.

CPI comparison uses highest earlier first quarter. The indexation test in s 2.03(1) and the computation in s 2.03(4) compare the CPI for the first quarter of the half‑year immediately preceding a prescribed half‑year with the highest first‑quarter CPI of any earlier half‑year. This is not a simple year‑on‑year comparison. Administrators must find the highest earlier first‑quarter CPI, not merely the immediately preceding matching quarter or the earliest quarter. This “highest earlier” rule can produce zero increases if the latest CPI does not exceed the earlier highest figure.

Pro‑rata rounding rules for partial months. When computing pro‑rata indexation for associate pensions that first became payable part way through a preceding half‑year, the Orders provide rules treating periods under one month as one month (s 2.03(6)) and instruct a half‑month rounding rule based on whether the number of days in the part month is less than or more than half the days in that month (s 2.03(7)). Common sense rounding may differ from this rule; the Orders’ explicit rounding must be followed.

Small associate pension threshold fixed and indexed from January 2005. Section 2.04 fixes the initial commutation amount at $1,303.03 and mandates indexation on 1 January 2005 and each subsequent 1 January and 1 July using s 2.05 procedures. Administrators must ensure the correct indexed threshold is in force on those indexation dates. The initial dollar number is not adjustable except via the prescribed CPI procedure.

Indexed and non‑indexed components treated separately. The reductions in later pensions and reversionary pensions require separation of indexed and non‑indexed components, multiplication by the reduction factor and then indexation of the indexed component via Part XA between operative time and later commencement (see ss 2.08-2.10). Failure to segregate components or to apply Part XA indexation correctly will misstate reductions.

Operative time dependency. Many calculations are anchored to the operative time as defined in s 49A of the Act (s 1.03(2)). Determining the operative time correctly is critical; the Orders’ reductions and hypothetical entitlements at operative time must use that date. Where family law splitting occurs by consent, the operative time may be set by agreement or the court, and practitioners must record it precisely.

Complexity where member still serving. Notes in ss 2.06 and 2.07 state that these sections apply where the member’s benefit was in the growth phase at the time of the split (member still serving or had a deferred benefit). This changes how hypothetical entitlements and pre‑split retirement percentages are to be determined using actuary factors. The growth‑phase context increases actuarial complexity compared with mature pensions.

Interplay with Part XA. Parts 2.09 and 2.10 instruct administrators to use Part XA of the Act for indexation of indexed components in the period between operative time and later pension commencement. Practitioners must be familiar with Part XA to compute the indexation factor required in those steps.

Amendments to watch. The Orders were amended in 2004 (No. 408) and in 2012 (No. 1) which added or altered s 2.09 and s 2.10. Administrators must ensure they use the consolidated text and apply amendments from the correct commencement dates (see Notes table).

These concrete points are the areas that in practice will cause calculation errors or disputes if not precisely observed.

Compliance requires administrators to adopt precise processes, ensure actuarial inputs are available and documented, and implement CPI indexing and reduction computations exactly as set out. The following practical checklist aligns steps to the Orders’ provisions.

1. Maintain authoritative references. Hold current consolidated copies of:

   • the Defence Force Retirement and Death Benefits Act 1973 (to obtain s 49A definitions and Part XA indexation rules),
   • these Orders (ss 1.03 and Part 2),
   • the Family Law Act 1975 s 90MT and the Family Law (Superannuation) Regulations 2001 (FLS Regulations) to establish the family law methodology used as a starting point (s 2.01 step 1 and s 2.01 note),
   • any Attorney‑General approved methodology under s 90MT(3) referred to in s 2.01 note,
   • records of amendment instruments (2004 No. 408; 2012 No. 1) and their commencement dates (Notes table).

2. Identify operative time and original interest. For each family law split, document the operative time as defined in s 49A of the Act (see s 1.03(2)) and the original interest to which the split applies. The operative time is the anchor for hypothetical entitlements and reductions (see ss 2.06-2.10).

3. Engage an actuary and document nominated factors. The Orders repeatedly require factors nominated by an actuary for these Orders (s 2.01 step 2; s 2.02 step 2; ss 2.06-2.10 references to factors identified by the Actuary). Ensure:

   • the actuary provides written nomination of pension and valuation factors, including age and gender specific pension factors for associate pension conversion,
   • factors are dated and referenced to avoid later disputes,
   • any methodology choices by the actuary are recorded and consistent with the Orders’ requirement to substitute family law factors with actuary factors.

4. Compute scheme value. Apply the family law methodology used to determine family law value under s 90MT of the Family Law Act, but substitute the actuary‑nominated factors as required by s 2.01. Document each step: methodology identified, factors substituted, and final scheme value.

5. Calculate transfer amount and associate pension. Identify the transfer amount in relation to the non‑member spouse as required by s 2.02 step 1. Obtain the pension factor nominated by the actuary (s 2.02 step 2) and divide the transfer amount by that factor to obtain the annual rate of the associate pension (s 2.02 step 3). Note that the associate pension excludes any reversionary component (s 2.02 note).

6. Apply CPI indexation for associate pensions. For prescribed half‑years (s 1.03 definition), determine whether the CPI test in s 2.03(1) is met by comparing the first quarter CPI for the half‑year immediately preceding the prescribed half‑year with the highest earlier first‑quarter CPI for any earlier half‑year. If the test is met, compute the prescribed percentage as (A − B)/B where A and B are the CPI figures described in s 2.03(4). If the associate pension became payable in relation to a member spouse’s pension that first became payable on or before 16 June or 16 December in the preceding half‑year, apply the pro‑rata formula in s 2.03(5) and the month rounding rules in s 2.03(6)-(7). Maintain clear records of CPI figures used and the rounding applied.

7. Manage small associate pension commutation. Use the dollar amount in s 2.04(1) as the initial threshold ($1,303.03) and apply indexation on 1 January 2005 and subsequently on 1 July and 1 January using s 2.05 indexation rules. For s 2.05, ensure the CPI comparison excludes half‑years earlier than 1 January 2004 as stated in s 2.05(1). Maintain a schedule of indexed thresholds and dates.

8. Compute reductions for later pensions and lump sums. When a standard pension or lump sum becomes payable to a member spouse after the operative time, follow the stepwise procedures:

   • For later standard pensions, follow s 2.06 steps to identify pre‑split retirement percentage, hypothetical percentage entitlement using actuary factors, establish non‑member spouse percentage, subtract and multiply by the member’s salary on retirement.
   • For later lump sums, follow s 2.07 steps to identify pre‑split retirement amount and hypothetical entitlement, establish non‑member spouse amount and subtract to obtain the reduced lump sum.
   • For reductions involving indexed and non‑indexed components and reversionary pensions, use the procedures in ss 2.08-2.10, including calculation of the reduction factor and use of Part XA indexation for indexed components between operative time and later commencement. Document the separation of components and the indexation factor used.

9. Keep CPI and Part XA indexation records. For indexation steps that require Part XA adjustments (ss 2.09 and 2.10), document how Part XA was applied to the indexed component of the pre‑split pension for the relevant period. Ensure CPI figures for first quarters and Part XA calculations are auditable.

10. Archive calculations and communications. Because the Orders set out precise mechanical steps, keep an auditable trail: actuarial factor documentation, family law valuation methodology references, CPI dates and figures, calculation worksheets showing each step from the Orders, communications to member and non‑member spouses and any administrative decisions about commutation or pension conversion.

11. Legal review and governance. Because the Orders interact with the Family Law Act, FLS Regulations and the Act, ensure legal review of calculation methodologies and governance over actuarial inputs. Given the absence of litigation history in the Orders compilation, document the reasoning behind actuarial choices to reduce the risk of later legal challenge.

12. System and staff training. Implement IT systems and staff training to handle the multi‑step calculations, CPI retrieval, rounding rules for partial months and separation of indexed and non‑indexed components. Test the systems with sample cases, including scenarios where the member is still serving (growth phase) because the Orders explicitly note different application in that context (ss 2.06-2.07 notes).

Following these practical steps, and keeping documentary evidence aligned with the Orders’ specific section references, will assist administrators and advisers to comply with the procedural and calculation duties imposed by the Orders.
