#### 40 Protection and immunity of members of Tribunal and of certain other persons (1) A member of the Tribunal, a person appointed under paragraph (a) of subsection (1) of section 31 to receive evidence on behalf of the Tribunal, a special commissioner to whom a question is referred under paragraph (d) of that subsection and a person appointed under paragraph (e) of that subsection to act as assessor have, in the exercise of their respective powers and the performance of their respective functions under this Act, the same protection and immunity as a Justice of the High Court. (2) A barrister or solicitor appearing before the Tribunal has the same protection and immunity as a barrister has in appearing for a party in proceedings in the High Court. (3) An appellant appearing before the Tribunal has the same protection and immunity as a person who has been convicted of an indictable offence and has appealed to the High Court against the conviction has in appearing before the High Court on the appeal. (4) Subject to this Act, a witness summoned to attend or appearing before the Tribunal has the same protection, and is, in addition to the penalties provided by this Act, subject to the same liabilities in any civil or criminal proceedings, as a witness in proceedings before the High Court.
