56AFailure to comply with requirement to notify change in circumstances

56A  Failure to comply with requirement to notify change in circumstances  (1) A defence member or a defence civilian (the recipient) commits an offence if:  (a) the recipient receives a benefit arising out of, or based on, the recipient’s membership of, or service in or in connection with, the Defence Force; and  (b) the recipient is required as a condition of receiving that benefit to notify a person of a change in circumstances relating to the recipient’s entitlement to the benefit; and  (c) the recipient fails to comply with that requirement.  (2) Strict liability applies to paragraph (1)(c).  (3) For the purposes of subsection (1), benefit:  (a) means:  (i) a grant; or  (ii) a payment; or  (iii) an allotment of money; or  (iv) an allowance; or  (v) a leave of absence; or  (vi) any other benefit or advantage; and  (b) is not limited to property.
