Members of the Australian Defence Force: The primary legal objects affected are ADF members subject to the Conditions of service 2016/19. The reunion travel regime in Schedule 2 applies only to members performing duty within Australia who have dependants who do not accompany them, and to members with dependants posted to a seagoing ship or seagoing submarine (s 9.3.29). The regime distinguishes between members on a standard service determination and those on a flexible service determination; the latter face a different crediting calculation under s 9.3.31 and must record patterns of duty so percentage of full-time duty may be calculated (s 9.3.31.4).
Dependants: Dependants of eligible members are beneficiaries of the Commonwealth-funded door-to-door travel benefit in s 9.3.33. Benefits may be used by dependants to travel to the member’s duty location or by the member to travel to dependants, and the rules distinguish whether Defence books travel or the travel is arranged privately, in which case reimbursement rules apply (s 9.3.33.1-2).
Specific occupational cohorts: Schedule 3 enumerates a list of pay grades and employment categories that are eligible for salary non-reduction. These lists are precise and varied, covering named roles in the Navy, Army and Air Force. For example, the Air Force entries in Annex 3.2.B include Network Technician Supervisor (Tier A) pay grade 6 from 25 June 2020 to 24 June 2025 (Annex 3.2.B Part 1 item 11), and multiple Network Technician entries in Part 2 (Annex 3.2.B Part 2 items 28-36). Annex 3.2.D specifies officer pay grades and named specialist employment categories (for example Management Executive Tier 1 Specialist at pay grade 4 between 30 June 2020 and 29 June 2025, Annex 3.2.D item 3). Members who match those pay-grade/employment category combinations on the specific dates stated will be within the salary non-reduction protection during the enumerated period.
Acting and higher-duty members: Schedule 1 affects members who are directed to act at a star rank or perform higher duties of a star rank, by setting temporal thresholds for executive vehicle allowance entitlement (substituted paragraph 4.6.6.2.b-c). Members engaging in these acting or higher-duty arrangements should check whether their periods meet the continuous four weeks or three months thresholds respectively.
Members affected by evacuation orders: Schedule 1 and the transitional Schedule 4 affect members who were evacuated from Defence establishments. Under substituted s 7.11.3.1, eligibility for evacuation assistance attaches to the start time in the evacuation order, or alternatively to the time the evacuation order was issued. Schedule 4 makes those evacuated between 12 December 2019 and commencement eligible as if Schedule 1 section 2 applied.
Command decision-makers and administrators: The Chief of the Defence Force (CDF) retains decision-making roles under the new provisions. The CDF can be required to be satisfied about Service reasons for credit extensions (s 9.3.32.3), and to approve use of multiple credits as reasonable (s 9.3.33B(a)). Administrative officers tasked with payroll and travel booking must implement the substituted salary non-reduction tables and the new travel benefit rules.
Payroll and budgeting units: The salary non-reduction Annexes set definite start and end dates for preserved salary levels, creating explicit payroll obligations for the Commonwealth for listed members across specific temporal windows. Defence finance and HR units are affected operationally because the Annexes update or remove prior transition arrangements and add new categories with time-bound protections.
Those not affected: The reunion travel Division expressly excludes members on certain conditions or depends on service location; the crediting rules also exclude members separated from dependants for two months or less from receiving a credit (s 9.3.30.3). Members not matching the Annex pay grade/category combinations are not included in the salary non-reduction protections.
