What it does
This instrument amends the Defence Determination 2016/19, Conditions of service, under the rule-making power in section 58B of the Defence Act 1903. It commences on 16 May 2019 and is the 12th amendment determination for 2019. Schedule 1 alters how the cost of living adjustment (COLA) and the cost of posting allowance (COPA) are calculated and paid to Australian Defence Force members posted overseas long-term. It introduces a new stand-alone definition of salary (section 1.3.69A) that refers exclusively to salary paid or payable under DFRT Determination No. 2 of 2017, Salaries, and it deletes the previous salary definition from section 3.5.89. The COLA calculation in subsection 15.2A.12.2 is changed: Step 1 now requires subtracting PAYG tax and any applicable levies (such as the Medicare levy, temporary budget repair levy or flood levy) from the member’s fortnightly salary plus any higher duties allowance and any salary non-reduction supplement provided under section 3.2.56. Critically, the step states that no other allowances are to be included. The COPA rate structure in section 15.2A.15 is wholly replaced with a system that sets both a minimum and a maximum amount expressed as a percentage of the salary of a Major (pay grade 1, increment O4-0) and a Colonel (pay grade 10, increment O6-1) respectively. For an accompanied member the rate is 28% of the member’s salary including any salary non-reduction supplement, but if that percentage yields less than 28% of the Major’s salary the floor applies; if it yields more than 28% of the Colonel’s salary the cap applies. Unaccompanied members receive 18% of salary, with floors and caps calculated on the same basis. The dual Commonwealth benefit rule in section 15.2A.9 remains applicable. Schedule 2 replaces Division 7 of Part 3 Chapter 15, which governs travel when a long-term overseas posting is extended or when a member receives a second consecutive long-term posting overseas. Three new provisions are inserted: section 15.3.37 states the purpose; section 15.3.38 provides return travel between the overseas location and the member’s normal Australian home if the posting is extended for 12 months or more, but only if the travel is taken within a window starting three months before and ending three months after the expected end date, and the member must be on approved leave during any absence from duty (dependants are not subject to that leave requirement). The Chief of the Defence Force may approve travel outside that period based on the reason the member could not travel within it, the welfare of the member and dependants, the member’s future work commitments over six months, and financial implications. No rest periods or accommodation, meal and incidental costs are provided for this travel, though excess baggage provisions apply if the posting location is a hardship location. Section 15.3.39 covers travel for a member who is posted to a second long-term overseas location. It entitles the member and dependants to business class travel from the first overseas location to a place in Australia and then on to the second overseas location, provided the second posting is for at least 12 months. The maximum benefit is capped at the cost of travel to and from the member’s normal Australian home location. The member must be on approved leave during absence; dependants travelling separately are not required to be on leave. The member’s travel must be taken after the end of the first posting and before the start of the second; dependants have a window of three months before the end of the first posting until departure, or three months after the start of the second posting until the member’s arrival, unless they travel separately under section 14.4.17. Again, accommodation and meal costs are not covered. Rest periods under Chapter 14 Part 4 Division 3 apply only for travel from Australia to the second location, and excess baggage provisions under section 14.4.11 apply. Section 15.3.40 allows dependants’ travel costs (or reimbursement if already paid personally) when the member is on unaccompanied long-term posting or short-term duty overseas and that posting or duty is extended or the member receives a second long-term posting order, provided the member becomes eligible to be accompanied. Schedule 3 is a transitional provision that applies to members who were on a salary non-reduction provision between 1 July 2017 and the commencement date. It entitles them to the difference between the COLA and COPA they actually received in that period and what they would have received had the new rules been in force from 1 July 2017. The effect is a back-payment obligation for Defence, calculated over nearly 23 months.
