What it does
This instrument amends the Defence Determination 2016/19 (Conditions of service) to change eligibility, definition and payment rules for the executive vehicle allowance. It is titled Defence Determination, Conditions of service Amendment (Executive vehicle allowance) Determination 2019 (No. 35), made under section 58B of the Defence Act 1903 (see Authority, section 3). The Determination was made on 11 December 2019 and commenced on 12 December 2019 (sections 1-2).
Mechanically, the instrument:
- Rewrites section 4.6.2 (who the Part applies to), adding express application to members who hold a “star rank” and, separately, to members who are directed to perform the duties of a star rank (Schedule 1, item 1).
- Replaces the definition table at section 4.6.3 to define “star rank” by reference to table items 1 to 5 in section 1 of Schedule 1 to the Defence Act (Schedule 1, item 2).
- Replaces section 4.6.6, the operative executive vehicle allowance provision, setting eligibility rules, dollar rates, payment frequency and certain calculation notes (Schedule 1, item 3).
- Adds a transitional provision that entitles certain members to retrospective payments equivalent to amounts they would have received for the period from 17 December 2018 to commencement, where they were eligible but did not receive payment under the Principal Determination (Schedule 2).
Key numerical changes are explicit in the amended section 4.6.6: for continuous full-time service the annual rates are $25,208 for Brigadiers and $26,928 for Major Generals; for Reserve service the rates are $69.06 a day for Brigadiers and $73.78 a day for Major Generals (s 4.6.6(3) table and accompanying notes). The Determination also excludes members holding the rank of Lieutenant General or higher from s 4.6.6 entirely (s 4.6.6(1)). The instrument states that the allowance is paid fortnightly in addition to salary, calculated on a 14-day fortnight and does not count as salary for superannuation purposes (notes to s 4.6.6(3)).
