What it does
This Determination inserts a new Part into the Defence Determination 2016/19, titled "Part 3: Bonuses", and repeals several existing divisions and annexes concerned with reserve capability at short notice. The instrument is made under section 58B of the Defence Act 1903 (see the Authority clause) and commenced on 1 July 2023 (see Commencement). The new Part establishes a statutory framework for offering two discrete types of monetary bonuses to Australian Defence Force (ADF) members: category A and category B. It prescribes how offers must be made and accepted (valid offer, valid acceptance), defines the concept of effective service for different forms of service (continuous full-time, flexible service, Reserve service), sets eligibility rules, fixes maximum monetary caps ($200,000 for category A; $100,000 for category B), sets minimum and maximum agreed periods of service depending on category and member type, prescribes the permissible bonus conditions, and sets out payment timing, cessation and repayment obligations (see sections 3.3.1-3.3.22).
Mechanically, a valid offer must be on an approved form and must specify the bonus type (retention or completion), a bonus condition, a bonus amount not exceeding the relevant cap, an agreed period of service within the permitted range for the category, an indicative commencement day and, if to a Reservist, the pattern of Reserve service, and a date by which the offer must be accepted (section 3.3.4). A valid acceptance likewise must be on an approved form, made by the acceptance date, and must include an election as to whether the bonus is paid in one lump sum or two instalments (section 3.3.5).
The Determination imposes precise mechanical rules for counting effective service. For continuous full-time members, paid days count as days of effective service and unpaid leave counts until the 21st day (section 3.3.6). Members subject to a flexible service determination use a formula to convert pattern-of-service days into an effective service tally for each fortnight, capped at 14 days (section 3.3.7). Reserve members not on continuous full-time service have each day of Reserve service counted as one effective day (section 3.3.8). The instrument excludes days in which a member is in custody, detention or imprisoned from effective service counting (sections 3.3.6(3), 3.3.7(3), 3.3.8(3)).
