What it does
This instrument amends the Defence Determination 2016/19, Conditions of service, by making targeted changes to allowances, overseas location naming, and transitional arrangements. It is an administrative determination made under section 58B of the Defence Act 1903 and signed by the Assistant Secretary, People Policy and Employment Conditions on 21 February 2023 (preamble). Mechanically the instrument (a) repeals a specified higher duties allowance table item that applies to a Sub Lieutenant performing duties at the rank of Lieutenant (Schedule 1, paragraph 4.1.4.d table item 5); (b) replaces multiple textual references to “Turkey” with “Türkiye” across several annexes and table items, and substitutes or updates an overseas table entry (Schedule 2, items 1-7); and (c) inserts transitional provisions that preserve or clarify certain entitlements and adjustments for affected members for limited historical periods (Schedule 3).
Commencement mechanics are explicit. Sections 1 to 4 and any part of the instrument not otherwise scheduled commence on the day the instrument is registered; Schedules 1 to 3 commence on 2 March 2023 (Commencement table). One amendment in Schedule 2 (paragraph 14.4.11.2A.b) changes a date within the underlying Determination from 1 March 2023 to 1 March 2024 (Schedule 2 item 3), thereby postponing the effect of that specific provision within the Conditions of service. The instrument gives no statutory penalties or criminal sanctions; it operates by amendment to the Defence Determination and by administrative effect on leave, allowances and overseas benefits.
The instrument is brief and narrowly focused. It does not introduce new categories of benefit beyond amendments to existing items in the Defence Determination; instead it removes or renames enumerated items and provides short-term transitional arrangements for affected personnel. The administrative authority who made the instrument is identified in the preamble (Fiona Louise McSpeerin, Assistant Secretary, People Policy and Employment Conditions, Defence People Group), and the statutory power relied on is section 58B of the Defence Act 1903 (preamble; section 3 Authority). The changes therefore operate as internal Defence employment-condition adjustments rather than primary legislation.
