What it does
This instrument amends the principal Defence Determination 2016/19, Conditions of service, which is the delegated legislation governing pay, allowances, housing, removal, education assistance and other conditions for Australian Defence Force members. It is made under section 58B of the Defence Act 1903 and commences in stages: Schedule 1 and Schedule 3 on 7 December 2023; Schedule 2 on 4 January 2024. The amendments are not a standalone act but a modification of an existing regime, so readers must cross-reference the amended provisions in the principal Determination.
Mechanically, the changes fall into four categories. First, Schedule 1 makes miscellaneous amendments that tighten or expand definitions and eligibility criteria across housing, removal allowances, remote location allowances, school tuition reimbursement, and dependant status. For example, item 4 adds a new ground for a child to qualify as a dependant: where the child has joined the member’s household in anticipation of a permanent care order from a court or statutory authority. Items 19 and 20 replace the old “is resident family of the member” test for dependants (for overseas conditions purposes) with a “normally lives with” test, and impose three cumulative conditions for a child to be a dependant: under 18, dependent on the member, and normally living with the member. Item 6 modifies table item 1 in section 4.4.12 to clarify that the remote location allowance continues during long service leave only if the member or at least one resident family continues to live at the remote location, and also adds unpaid maternity leave and unpaid parental leave as new categories. Items 7 and 8 update the names of leave types in that table: “compassionate” becomes “personal leave for a compassionate reason”, and “absence from duty while ill or in hospital” becomes “medical absence from duty”. Items 10 to 12 tighten removal allowance eligibility by repealing table item 1A and restricting removal before ceasing continuous full-time service to specific grounds: medical illness of a resident family member, unavailability of suitable accommodation, no suitable secondary or higher education, being on a transition location (medical) agreement for over 12 months, or exceptional reasons. Item 13 replaces section 7.3.2 to limit home purchase assistance to members who, at the time of purchase, are expected to continue serving in their primary service location for another 12 months. Item 14 extends the application of certain provisions to “other recognised persons” in addition to resident family. Items 16 to 18 overhaul school tuition reimbursement: the section heading changes from “Reimbursement of tuition and accommodation” to “Tuition and accommodation costs”; direct payment to the school is now permitted if the member is experiencing financial hardship, as determined by specified decision makers; and the reimbursement is reduced by other government assistance (total value) and by half the value of textbook/equipment assistance. Item 23 removes the word “Afghanistan” from section 16.8.2, likely reflecting a change in operational posting allowances. Item 25 repeals section 17.2.2 entirely.
