What it does
This instrument is a delegated legislative amendment to the Defence Determination 2016/19, Conditions of service, made under section 58B of the Defence Act 1903. It is the twelfth such amendment determination of 2023 and commenced on 12 October 2023. The instrument makes 24 miscellaneous amendments in Schedule 1 and provides a transitional provision in Schedule 2.
The amendments adjust the eligibility criteria for payment instead of long service leave. The previous wording in section 5.5.25 is replaced with a more detailed framework that sets out five separate pathways to eligibility: general long service leave credits, early termination for medical unfitness or redundancy, reaching retirement age (including where the member has been permitted to serve beyond that age), receipt of a special benefit under Chapter 2 Part 3 Division 3, and terminal illness (subject to the Chief of the Defence Force’s satisfaction). A new provision at subsection 5.5.25(3) explicitly allows a member of the deceased member’s recognised family or legal personal representative to receive the payment.
The instrument also changes removal entitlements for dual-member couples. Paragraph 6.5.6.a is repealed and replaced to clarify that when both members of a couple are eligible for a removal to the same location, only one member qualifies for the removal (covering the member and their resident family and other recognised persons). This eliminates duplicate entitlements and reduces government expenditure on removals.
Several amendments address housing and rent allowance provisions. The definition of “location” for rent ceiling purposes is revised in sections 7.8.9 and 7.8.10 to account for members on flexible housing trials, members with unaccompanied resident family, and members whose housing benefit location has been extended under section 1.3.11. A new section 7.8.47 replaces the previous provision on rent paid before a member moves in, setting maximum reimbursement periods of six weeks (if furniture is in transit) or three weeks (in other circumstances), and requires that the pre-payment result in Defence savings on removal and temporary accommodation costs.
