What it does
This instrument, the Defence Determination, Conditions of service Amendment Determination 2023 (No. 03), is an administrative amendment to the Defence Determination 2016/19, made by the Assistant Secretary, People Policy and Employment Conditions, under section 58B of the Defence Act 1903 (see "Authority"). It was signed 31 January 2023 (Dated 31 January 2023) and phases into effect according to the commencement table in clause 2: sections 1-4 and anything not otherwise tabled commence the day after registration; Schedules 1 and 3 commence on 2 February 2023; Schedule 2 commences on 2 March 2023 (Commencement table, clause 2).
Mechanically, the instrument does four types of change to the Defence Determination 2016/19:
- It replaces the post-index rule for specified post index locations (substituting a new text for subsection 12.3.14A.1) so that the post index equals "the standard figure provided to Defence by a data service provider" for the location listed in Annex 12.3.B (Schedule 1, item 1).
- It inserts a temporary Part 4 into Chapter 14A (entitled "Effect of travel restrictions in China"), which: states purpose (s14A.4.1); defines the persons the Part applies to (s14A.4.2); creates an eligibility right to daily costs of accommodation, meals and incidentals (s14A.4.3) where the member is in Australia on temporary absence and either required to isolate before returning to China or unable to return due to ongoing restrictions or lockdowns in China; and sets a cessation date of 30 June 2023 for that Part (s14A.4.4) (Schedule 1, item 2).
- It inserts a new section, 15.6.15A, providing a limited, time‑bound reimbursement entitlement for additional education support costs for members posted to China: up to 10 days' costs for organised programs or tutoring at the posting location, reimbursed as the lesser of actual cost or AUD 135 × (post index/100); this section ceases 31 August 2023 (Schedule 1, item 3).
