What it does
This instrument amends the principal Defence Determination 2016/19, Conditions of service, across three schedules. Mechanically, it does three things. First, Schedule 1 repeals and replaces subsection 4.12.2, which defines which members are covered by Part 4.12 - the Operation COVID-19 ASSIST allowance. The new provision replaces whatever eligibility criteria existed previously with a three‑pronged test: the member must be named on the operational staffing document for Operation COVID-19 ASSIST, have been issued a Headquarters Joint Operations Command (HQJOC) deployment order for that operation, and have an operations log entry for Operation COVID-19 ASSIST in PMKeyS (the Defence personnel management system). It also expands the definition of “member” for that Part by expressly including former members and deceased members (with the note that benefits payable to a deceased member go to the estate). Schedule 1 also inserts a new section 4.12.4, which provides that the allowance is payable from a day set by a notifiable instrument made by the Director Drafting and Engagement in the Department of Defence, and that different days may be specified for different classes of members. This creates a discretionary commencement date for the allowance rather than a fixed statutory date.
Second, Schedule 2 adds a new table item 3A to subsection 17.7.6.1 of the Determination, which lists overseas operations and the daily deployment allowance rate for each. Item 3A covers Operation LILIA - the Australian Defence Force deployment to the Solomon Islands - and sets the allowance rate at AUD 93.69 per day for duty in “the land, territorial waters and superjacent airspace of the Solomon Islands”. This is the same rate that applies to many other regional operations listed in the table (the instrument does not state whether this is an increase or a new operation). The effect is to formalise the deployment allowance for personnel on that operation within the standing allowance framework.
