What it does
This amending determination modifies the Defence Determination 2016/19 (Conditions of service) in three substantive areas plus transitional arrangements. First, it overhauls the career transition framework (Part 2.2) for ADF members leaving service or changing service category. The amendments expand eligibility for transition benefits, including training costs up to $5,320 (lifetime cumulative) and professional financial advice up to $1,000 (lifetime cumulative). It extends eligibility to former members for up to two years after their last day of service. It caps approved absence for transition activities at 23 days, with no more than 3 days for administration. Training must align with post-transition employment or meaningful engagement, cannot be a capital investment in a business, and is not available if the member has already secured employment or meaningful engagement related to those goals. The determination also replaces the definition of member to include former members for the purposes of Part 2.2. Second, it extends the Army dental officer professional development scheme from 30 June 2020 to 30 June 2023, with a transitional provision allowing retrospective reimbursement for eligible officers who would have qualified between those dates. Third, it amends evacuation assistance provisions in Chapter 7 Part 11. It adds a new rule that if an evacuation order does not specify an end time, the Senior ADF Officer at the establishment sets the time. It clarifies that accommodation assistance is not available if an evacuation centre has been established, with three exceptions: the centre is full, the member was in living-in accommodation and other living-in accommodation is available, or the Senior ADF Officer decides there are special circumstances. For members in Service residences, assistance covers reasonable accommodation costs for the member and dependants. For members in living-in accommodation, it offers living-in accommodation at another base within 50 km, or if unavailable, reasonable costs of other accommodation. The instrument commenced on 14 October 2021 and was made under section 58B of the Defence Act 1903.
