What it does
This instrument is a subordinate legislative amendment under section 58B of the Defence Act 1903. It inserts new provisions into the Defence Determination 2016/19, Conditions of service, creating temporary COVID-19-related financial benefits for Australian Defence Force members and their dependants on long-term overseas postings. Mechanically, it adds five new benefit categories and broadens one existing travel rule. First, section 14A.2.7 establishes a quarantine accommodation assistance payment for members or dependants who travel privately from their overseas posting to Australia and must complete a mandatory quarantine period. The fixed rate is AUD 1,000 per week for an individual or AUD 1,500 per week for a family group; the provision sunsets on 30 June 2022. Second, a new Part 3 in Chapter 14A introduces a travel restriction payment , a one-off, regionally graded lump sum payable after the posting ends , for members on long-term postings ending before 30 June 2022 who could not use assisted leave travel during the pandemic. The amounts range from AUD 750 (Pacific or South East Asia) to AUD 2,500 (Africa). Third, the instrument substitutes a new section 15.3.39 to expand the additional travel benefit for members on back-to-back long-term postings to a second overseas location, allowing dependants to travel up to three months before departure or after arrival, and granting decision makers discretion to extend the travel period during COVID-19. A new section 15.3.39A adds excess baggage and rest period benefits for those using that additional travel, but explicitly excludes accommodation, meals and incidentals. Fourth, section 15.6.17B provides up to AUD 135 per day for 10 days of education support (tutoring or summer schooling) for a child who is already eligible for other education assistance, ceasing on 30 June 2022. Fifth, section 16.4.11A grants accommodation assistance , up to AUD 1,200 per seven-day period and AUD 200 per extra day , for members who offset their assisted leave travel to travel in-country; this benefit applies only once and sunsets on 31 December 2021. Finally, Schedule 2 contains transitional provisions that retrospectively apply these benefits from 1 July 2021 for members who would have been eligible had the provisions been in force. The instrument therefore creates new entitlements funded by the Commonwealth, targeted at compensating for pandemic-related travel disruptions, but imposes various eligibility gates, fixed per diem rates, and sunset dates that limit the fiscal exposure and duration of the scheme.
