What it does
This Determination (Defence Determination, Conditions of service Amendment Determination 2020 (No. 3)), made under section 58B of the Defence Act 1903, amends the Defence Determination 2016/19 (Conditions of service). It is dated 4 March 2020 and commences on 5 March 2020 (see the instrument cover, ss 2-3). Mechanically the instrument operates by a schedule-by-schedule amendment model: each Schedule to the instrument makes targeted insertions, substitutions and repeals to the base Conditions of service Determination (see s 4).
Key mechanical changes are:
-
Schedule 1 removes a discrete Air Force higher duties rate and related references. It deletes section 4.1.28 (Rate for higher duties , Air Force officer acting as a Commanding Officer) and removes the exception that referenced it (Schedule 1, items 2-3). The instrument preserves existing recipients of that allowance via a savings clause in Schedule 6 (see Schedule 1 and Schedule 6).
-
Schedule 2 inserts new travel-cost entries for Mali into Annex 13.3.A Part 1 and Part 2, adding item 46A with currency XOF and numeric amounts (Part 1: Mali, XOF, 55,110 and 13,103; Part 2: Mali, XOF, 46,625 and 13,103). The text inserts those rows immediately after item 46 in each Part (Schedule 2, items 1-2).
-
Schedule 3 redesigns eligibility, payment commencement and cessation rules for hardship allowance and location allowance. It replaces prior subsections and substitutes a set of new definitions (for example 16.2.3A and 16.2A.3A), eligibility rules (16.2.3B and 16.2A.3B) and payment/cessation rules (16.2.4, 16.2.6, 16.2A.4 and 16.2A.6). Those provisions (as substituted) set a common approach: a qualifying period defined as the lesser of 28 continuous days or a period determined by the Chief of the Defence Force (CDF); qualifying location to include hardship locations and locations for which the member received deployment allowance; payment starting on the day the member entered the hardship location; specified absence exceptions (for long-term posted members, deployment allowance overlap, short-term absences); and rules for when eligibility ends (earlier of ceasing posted or location ceasing to be qualifying) (Schedule 3, items 1-5, and the substituted clauses 16.2.3A-16.2A.6).
