What it does
This instrument amends the Defence Determination 2016/19, Conditions of service, by making a set of targeted changes to pay protection for a small class of Air Force officers, to the rules for overseas reunion travel during the COVID-19 period, and to a large number of textual "Contents" entries across the Determination. It is made under section 58B of the Defence Act 1903, was signed on 4 June 2020 by an Assistant Secretary, and commences on 11 June 2020 (see Authority and Commencement: items 3 and 2). The instrument is expressly structured as a set of schedules that either amend or repeal specified parts of the earlier Defence Determination 2016/19 (see Schedule statement, item 4).
Mechanically, the amendments do three substantive things:
- Create a new salary non-reduction entitlement limited to a narrowly defined cohort of Air Force Flight Test Engineers who meet a set of conditions tied to rank, qualifications, posting and past pay grade (Schedule 1 inserts new subsection 3.2.52A).
- Change the overseas reunion travel rules by replacing the subsection that defines the class of members to whom the reunion travel rules apply, by permitting, in defined circumstances, reunion travel before the standard three month period where a specified decision maker considers it reasonable, by defining who the "decision maker" is for this purpose, and by providing a COVID-19 specific prohibition on using reunion travel to bring a dependant to an overseas posting (Schedule 2, amendments to subsections 14A.1.23.1, 14A.1.23.2, new 14A.1.23.2A, and substituted 15.3.13.3).
- Remove a large number of "Contents" sections that appear in the 2016/19 Determination, by omitting the listed sections (Schedule 3 lists numerous "Omit the section" instructions).
The instrument also includes a limited transitional authorisation. Members who were on long-term overseas posting and received an earlier benefit to return to Australia after 13 May 2020 but before the Determination commenced are treated as having been authorised for that benefit up to the value they would have received under Chapter 15 Part 3 had it applied at the time (Schedule 4, items 1-2).
