What it does
This instrument, the Defence Determination, Conditions of service Amendment (COVID-19 response) Determination 2020 (No. 9), amends the principal Defence Determination 2016/19, Conditions of service, under the authority of section 58B of the Defence Act 1903. It was made on 29 April 2020 and commences the day after registration. It responds to the COVID-19 pandemic by adjusting financial assistance, allowances and leave rules for Australian Defence Force members and their families.
The amendments are organised into three schedules. Schedule 1 deals with domestic conditions. Item 1 changes a food allowance eligibility trigger: it substitutes “15” for “14” in paragraph 7.9.11.1.e, which prescribes when a member is not eligible for food allowance. Item 2 omits paragraph 11.4.9.2.a (funeral costs). Item 3 inserts a new section 11.4.10A that creates financial assistance for memorial services when a member’s funeral occurred while COVID-19 control measures were in force. The assistance is capped at the lesser of the memorial service cost or $14,000 less any amount already paid under existing funeral provisions. The cap can be exceeded in exceptional circumstances with Director General approval. Item 4 amends subsection 11.4.11.1 and 11.4.11.2 on travel and accommodation for funerals and memorial services. It restricts eligibility for travel and two nights’ accommodation to domestic funerals or memorial services, and provides for an additional night only for funerals (not memorial services) where travel requirements and timing necessitate it.
Schedule 2 addresses overseas conditions. Item 1 inserts a new paragraph in section 14.5.5.4 so that the settling in/settling out allowance continues even when a member must isolate due to COVID-19 control measures at the overseas posting. Item 2 inserts section 14A.1.6A, providing transit accommodation and meals for persons whose evacuation flights require an overnight stay in a third location. Item 3 inserts section 14A.1.17A which stops the accrual of additional recreation leave from the day a member ceases to receive hardship or location allowance during an evacuation period, but ceases to apply at the end of the evacuation period. Items 4 to 6 insert definitions for “COVID-19 control measure” and “beneficiary” and amend funeral assistance for members and dependants who die overseas. The new provisions allow financial assistance for memorial services held within 12 months after control measures end, with caps of $14,000 less any funeral payment. All overseas funeral assistance now requires approval by the Director General Defence Community Organisation.
