What it does
This Determination amends the Defence Determination 2016/19, Conditions of service, by changing several provisions that govern compassionate travel, who may be paid benefits under the Division, and the list of approved clubs. It is made under section 58B of the Defence Act 1903 and is dated 31 May 2019, with commencement on 13 June 2019. The instrument is titled Defence Determination, Conditions of service Amendment (Compassionate travel and approved clubs) Determination 2019 (No. 15) and is signed by the Acting Assistant Secretary, People Policy and Employment Conditions, Defence People Group.
Mechanically, the Determination:
- Substitutes item 1 in section 1.3.72 (Serious illness), changing the table entry to reference compassionate leave under Chapter 5 Part 9 Division 2 and travel for compassionate leave under Chapter 15 Part 3 Division 6; the instrument records the substitution in Schedule 1 item 1.
- Removes two definition entries from section 15.3.31, namely “Very seriously ill” and “Seriously ill” (Schedule 1 items 2 and 3).
- Replaces section 15.3.32 with a new clause titled "Payment of benefits under this Division" which states that benefits may be paid either directly to the service provider or by way of reimbursement to the person who incurred the cost (Schedule 1 item 4).
- Replaces sections 15.3.33, 15.3.34 and 15.3.35 with new provisions that set out eligibility conditions and the calculation or caps for travel costs in a range of compassionate scenarios involving close relatives and members on long-term postings overseas (Schedule 1 items 5-7).
- Adds an entry to the approved clubs list at section 15.8.7, inserting "Spain Holmes Place - Capitán Haya, Madrid" after the Solomon Islands entry (Schedule 2 item 1).
