What it does
This Determination amends the Defence Determination 2016/19, Conditions of service, to change how assisted leave travel entitlements can be offset, to add an in-country definition, to impose proof requirements, and to create short transitional arrangements for travel undertaken between 26 February 2021 and commencement. It was made under section 58B of the Defence Act 1903 (see Authority, item 3) by the Assistant Secretary, People Policy and Employment Conditions, and commenced on 10 June 2021 (items 2-3).
Mechanically, the instrument does four discrete things to the assisted leave travel regime in the Defence Determination:
- Adds a defined term. It inserts an “In‑country” definition into section 16.1.2: “In-country means in the country where the member’s posting location is located” (Schedule 1, item 1).
- Reduces entitlement counts when travel is offset. It inserts subsection 1A into 16.4.7.1 so that the number of trips a member may be eligible for is reduced by one for each assisted leave travel benefit that is offset under the new section 16.4.11 (Schedule 1, item 2).
- Replaces the offsetting rule. It substitutes a rewritten section 16.4.11 that permits the Chief of the Defence Force (CDF) to authorise offsets of an assisted leave travel entitlement to (a) travel to a location in another country (other than the location listed in Annex 16.B), or (b) travel in‑country; sets criteria the CDF must consider; specifies the effect of an offset (cessation of eligibility for that trip and entitlement to the value of the travel under s16.4.5); and, for in‑country travel during the COVID‑19 pandemic, limits the benefit to return transport costs up to the same value and links private vehicle travel to s16.4.15 (Schedule 1, item 3).
- Tightens documentary proof requirements. It replaces section 16.4.12 so proof is required where a member offsets travel or is paid in advance; documentary evidence must be provided within two weeks of returning; and acceptable items are listed (passport entry/exit stamps, airline boarding pass, travel agent confirmation, bus or train ticket) (Schedule 1, item 4).
