What it does
This instrument, the Defence (Cultana,Defence Area) Declaration 2024, declares a defined area as a "declared defence area" and prescribes two discrete legal effects. First, it identifies the Cultana Training Area as the area depicted and identified as "defence land retained" in the Schedule map together with the airspace above that land (s 3(1)(a)). Second, it records the defence purposes for which the Area is required: carrying out military manoeuvre, and live firing including with air weapons and explosive ordnance (s 3(2)(a)-(b)). Finally, the instrument imposes an absolute prohibition on entry into the Area at all times (s 3(3)).
The instrument is made under subsection 58(1) of the Defence Regulation 2016, as stated in the preamble, and is dated 20 April 2024. Commencement is the day after registration on the Federal Register of Legislation (s 2). The Schedule contains the map that performs the definitional work by depicting and identifying the area as "defence land retained"; the instrument therefore locks the Area’s boundaries to that Schedule rather than to textual coordinates (s 3(1)(a); Schedule).
Mechanically, the declaration converts the mapped land and the airspace above it into a declared defence area and forbids entry at any time. The instrument does not set out penalties, permit schemes, exceptions, or operational details for notices, notifications or temporary openings. It also does not itself describe the mechanics of enforcement or identify any process for authorising access. Those matters are not addressed in this instrument and, insofar as they are relevant, will depend on the enabling framework under the Defence Regulation 2016 and any other statutory or regulatory regimes, none of which are reproduced in this text.
The immediate compliance trigger is the instrument’s commencement, which is the day after registration on the Federal Register of Legislation (s 2). From that date the prohibition on entry applies to the Area as defined by the Schedule (s 3(3); s 3(1)(a)). The instrument therefore both defines the spatial scope and prescribes a single behavioural rule,do not enter, backed by the instrument’s status as a statutory declaration under the Defence Regulation 2016.
