Debt Collectors Licensing Regulations 1964

The Regulations revolve around a handful of recurring administrative and regulatory concepts that determine how the licensing regime operates on the ground.

• Licence lifecycle: The Regulations govern the full lifecycle of a debt collector’s licence issued under the Act , application formalities (reg 2; reg 3 for corporations), issue and renewal fees (reg 4), prescribed currency of a licence (reg 6 and reg 6A), transfer (reg 5), duplication (reg 7), surrender (reg 9) and refund on surrender (reg 9A). The Commissioner is the central decision‑maker in transfer, register updates and refunds (regs 5, 9A, 12).
• Financial prerequisites and security: Applicants and proposed transferees must provide fidelity security in the form prescribed (reg 5(2)(d); reg 8) and the Second Schedule sets the bond text and the sums to be guaranteed ($10,000 corporate; $6,000 natural person). The Second Schedule also governs the surety’s ability to terminate liability on notice, whilst preserving liability for acts before termination.
• Fees, late payment and small monetary caps: The fee table in reg 4 fixes concrete monetary obligations. A late renewal attracts a penalty equal to 25% of the renewal fee (reg 4(2)). Separately, reg 13 caps fees charged to debtors where the debt is paid by instalments (50 cents or up to 2.5% of the amount of the debt).
• Registration data and ongoing notice obligations: Licensees must notify certain changes within 14 days (reg 12). The Commissioner must maintain and update the register pursuant to the Act when notice is received (reg 12(3) and reg 5(6)(b) referring to the register kept under s 12 of the Act).
• Confidentiality with narrow exceptions: Auditors and persons appointed by the Minister have a duty of non‑disclosure for information obtained during audits, with carve-outs that permit reporting to the Minister, use in legal proceedings connected to trust accounts, and disclosures to sureties where the Minister consents (reg 10).
• Offences and streamlined enforcement: The Regulations create low‑value infringement pathways through the Criminal Procedure Act 2004 (reg 16). The Third Schedule lists several offences (including carrying on business without a licence and failure to notify opening or change of trust account name) as infringement offences with modified penalties (Third Schedule). More general breaches of the Regulations carry penalties not exceeding $200 (reg 15).
• Exemptions and scope‑limiting conditions: Reg 14 details circumstances where the Act does not apply, namely where persons collect specified secured debts and satisfy conditions about the debtor’s knowledge and absence of involvement in court process preparation.

These concepts structure incentives. For example, fidelity bonds impose a tangible financial barrier, the fees establish recurring costs for maintaining licencing, the 14‑day notice window creates a continuing compliance duty, and the authorised officer/infringement notice architecture makes routine, low‑value enforcement administratively straightforward (reg 16). The Second Schedule’s surety termination clause introduces risk that a surety can cease future liability with 30 days’ notice (Second Schedule), which affects the ongoing viability of a licence unless replacement security is provided.

Throughout, decision authority rests primarily with the Commissioner (applications, transfers, refunds, register updates, appointment of authorised officers) and the Minister has an approval role for sureties and may appoint persons for specified purposes (reg 10(2)(c); Second Schedule references the Minister’s approval of insurance companies). Police are notified on issue, transfer or other actions (reg 5(1), reg 5(6)(c), First Schedule Form 4).

The Regulations affect a defined set of actors connected to the debt‑collection supply chain, and specify who bears which duties and costs.

• Prospective and current debt collectors who require a licence under the Act are the primary subjects. They must comply with application formalities (reg 2, reg 3), pay prescribed fees (reg 4), lodge a fidelity bond or approved security (reg 5(2)(d); reg 8; Second Schedule), and meet ongoing notification obligations (reg 12). They are also restricted from using visible vehicle markings that identify them as debt collectors (reg 11).
• Corporations and their officers: The Regulations require corporation licence applications to be signed by a manager, secretary or other governing officer (reg 3). When a transferee is a corporation, references to the proposed transferee are read as references to the corporation’s directors (reg 5(5)). Corporate applicants face the higher bond sum in the Second Schedule ($10,000).
• Proposed transferees of licences: A transferee must satisfy the Commissioner as to good fame and character, fitness, and age (reg 5(4)), supply testimonials from three reputable persons, pay the transfer fee (reg 5(2)(b)‑(c)), and lodge a fidelity bond or approved security (reg 5(2)(d)). If an existing bond is acceptable, the surety may provide a written undertaking to extend liability to the transferee (reg 5(3)).
• Sureties and insurers: The Second Schedule sets the fidelity bond terms and requires the surety to be an incorporated insurance company approved by the Minister (Second Schedule). Sureties are liable for adjudged penalties, damages and costs in respect of acts as a debt collector, but the surety can give written notice to be relieved as from a date not earlier than 30 days after service of notice (Second Schedule).
• The Commissioner and the Minister: The Commissioner has administrative and regulatory authority , receiving and processing transfer and surrender applications, endorsing licences and updating the register (reg 5(6); reg 9; reg 9A(2); reg 12(3)). The Commissioner also appoints authorised officers to issue infringement notices and must issue identifying certificates (reg 16(3)‑(4)). The Minister approves insurance companies for fidelity bonds and can appoint persons under reg 10.
• Police: The Commissioner must notify the Commissioner of Police on licence transfer or related actions (reg 5(1), reg 5(6)(c); First Schedule Form 4 provides a standard notification to Commissioner of Police).
• Debtors and creditors: The Regulations set how much a licensee may charge a debtor where instalments are used (reg 13). Creditors who engage debt collectors face the practical consequence that a licensed collector may charge these capped fees; consumers (debtors) are protected by the cap.
• Persons falling within the exemptions in reg 14: These are persons who collect moneys owing under mortgages, bills of sale or contracts for sale/letting of land or business where the debtor has knowledge of the collector’s authority at or before maturity or within one month thereafter, provided the collector does not prepare or issue court process for recovery. Such persons are outside the Act’s application but must satisfy the reg 14 conditions to rely on exemption.

Financially, licence applicants and holders carry the direct cost of the prescribed fees (reg 4) and the cost of obtaining and maintaining fidelity security (reg 5, reg 8, Second Schedule). The Commissioner has discretional functions that affect applicants’ outcomes (transfer approvals, refunds, register updates). Enforcement staff (authorised officers) and the Commissioner administer low‑level enforcement through infringement notices linked to the Criminal Procedure Act 2004 (reg 16; Third Schedule).

The Regulations create a set of affirmative duties for licensees, applicants and related persons and confer particular administrative rights on the Commissioner and the Minister. These obligations and entitlements determine compliance burdens and administrative discretion.

Duties on applicants and licensees

• Use approved forms and provide particulars: The forms in the First Schedule must be used for their respective purposes, with particulars as indicated (reg 2). An application by a corporation must be signed by an authorised corporate officer (reg 3).
• Provide fidelity bond or approved security: Applicants and proposed transferees must lodge the bond in the prescribed form or approved security as required by s 20 of the Act (reg 5(2)(d); reg 8 and Second Schedule). If a fidelity bond already exists, a surety may provide an undertaking to extend liability to a transferee (reg 5(3)).
• Pay fees and accept late penalty if applicable: Fees for issue/renewal, transfer and duplicates are prescribed (reg 4 Table). A late renewal attracts 25% of the renewal fee as a penalty (reg 4(2)).
• Notify certain changes: Licensees must notify the Commissioner in writing within 14 days of changes to name, business address, residential address (if natural person) or directors (if corporation) (reg 12(1)‑(2)); the Commissioner must update the register on receipt (reg 12(3)).
• Avoid marking vehicles: A licensee must not use any vehicle that displays the fact or words importing that the occupant carries on business as a debt collector (reg 11).
• Comply with trust account and audit obligations: While the Act contains provisions on trust accounts (referred to in Third Schedule), the Regulations preserve audit confidentiality obligations for auditors and persons appointed by the Minister, subject to listed exceptions (reg 10).

Rights and administrative powers

• Transfer and register rights: A licensee may apply to transfer a licence and, if the Commissioner is satisfied of the transferee’s fitness, the licence may be transferred and the transferee is deemed the holder during the licence currency (reg 5(1), (4) and (6)(b)).
• Refunds on surrender: A person who surrendered a licence may apply for a refund of the prescribed fee proportionate to the unexpired portion of the licence, at the Commissioner’s opinion (reg 9A(2)); this creates a discretionary right to a partial refund.
• Authorised officer and infringement processes: The Commissioner may appoint authorised officers for issuing infringement notices under the Criminal Procedure Act 2004 (reg 16(3)) and must provide identification certificates (reg 16(4)). The Third Schedule lists specified offences that attract a modified penalty and may be dealt with by infringement notice (reg 16(1)‑(2)).
• Ministerial approvals and appointments: The Minister has an approval role for sureties under the Second Schedule (surety must be an insurance company approved by the Minister) and persons appointed by the Minister in connection with audits have both duties and limited disclosure rights (reg 10; Second Schedule).

Enforcement entitlements

• The Commissioner must notify the Commissioner of Police of certain licensing actions (reg 5(1), (6)(c) and First Schedule Form 4). This establishes a pipeline for police awareness but does not, within the Regulations, specify police action.
• The Regulations authorise the use of infringement notices for specified contraventions to streamline enforcement (reg 16; Third Schedule). The modified penalties are relatively low ($40 for several listed contraventions in the Third Schedule), and the general maximum penalty for regulatory breaches is $200 (reg 15).

Key practical implications of duties and rights

• Time‑bound reporting duties (14 days) create ongoing compliance monitoring costs and an administrative process that can lead to infringement notices for non‑compliance (reg 12; Third Schedule r.12).
• Fidelity bond requirements and the specific monetary sums in the Second Schedule create a predictable security burden and expose licensees to the surety’s contractual terms including a 30‑day termination mechanism (Second Schedule).
• The Commissioner’s discretion over transfers and refunds (reg 5(4); reg 9A(2)) is pivotal; applicants must meet character and fit‑and‑proper tests and provide required testimonials (reg 5(2)(b)‑(c)).

All these duties and rights are grounded in the Regulations’ text: forms (reg 2; First Schedule), fees (reg 4), transfer (reg 5), bonds (reg 8; Second Schedule), notifications (reg 12), caps on charges (reg 13), confidentiality (reg 10) and enforcement (regs 15‑16; Third Schedule).

The Regulations prescribe both monetary penalties and an administrative enforcement pathway for specified contraventions. They allocate enforcement authority and establish the mechanics for infringement notices and prosecution.

Monetary penalties

• General regulatory penalties: A person who breaches the Regulations is guilty of an offence and liable to a penalty not exceeding $200 (reg 15).
• Modified penalties and infringement notices: The Third Schedule lists prescribed offences under the Act and the Regulations that qualify for infringement notices under Part 2 of the Criminal Procedure Act 2004. Each listed offence has a modified penalty amount adjacent to it (Third Schedule). For example, carrying on business as a debt collector without a licence (s 5 of the Act) and failing to notify the Commissioner of trust account openings or name changes (s 15(4) of the Act) each attract a modified penalty of $40. The Regulatory offences under the Regulations (r 11 use of vehicle identifying person as debt collector; r 12 failing to notify change of address) also attract $40 modified penalties (Third Schedule).
• Late renewal penalty: For late renewal applications, the amount prescribed by way of penalty is 25% of the renewal fee (reg 4(2)). This is a fee‑based penalty rather than a direct fine.

Enforcement authorities and processes

• Authorised officers and issuing infringement notices: The Commissioner may, in writing, appoint authorised officers or approved officers for the purposes of Part 2 of the Criminal Procedure Act 2004 to issue infringement notices (reg 16(3)). The Commissioner must issue each authorised officer with a certificate, badge or identity card identifying them as persons authorised to issue infringement notices (reg 16(4)). The forms for infringement notices and their withdrawal are set out in the First Schedule (Forms 7 and 8).
• Criminal Procedure Act interface: The Regulations expressly make the offences in the Third Schedule offences for which infringement notices may be issued under Part 2 of the Criminal Procedure Act 2004 (reg 16(1)‑(2)). The modified penalty is the amount specified for the purposes of s 5(3) of the Criminal Procedure Act 2004 (reg 16(2)).
• Fines enforcement: Form 7 (the infringement notice form in the First Schedule) explicitly warns alleged offenders that failure to pay the modified penalty within 28 days can lead to prosecution or enforcement under the Fines, Penalties and Infringement Notices Enforcement Act 1994, listing potential enforcement actions such as licence suspensions, garnishment and publication of details (First Schedule, Form 7).
• Prosecution route: If an alleged offender opts for court prosecution (Form 7 includes the option to request prosecution), or if the modified penalty is not paid and prosecution is pursued, the normal criminal process under Western Australian law would apply , the Regulations provide the infringement option but preserve prosecutorial pathways.

Practical enforcement consequences and administrative incentives

• Low modified penalties for common breaches: The $40 modified penalties in the Third Schedule (e.g. s 5, s 15(4), r 11 and r 12) are substantially lower than the maximum $200 penalty for breaches of the Regulations (reg 15). This design encourages resolution by payment rather than contested litigation for minor breaches; it also lowers the expected penalty for some contraventions, which may affect compliance incentives.
• Commissioner control over enforcement staff: The Commissioner controls who may issue infringement notices (reg 16(3)) and must equip authorised officers with identification (reg 16(4)), centralising enforcement decisions and the optics of enforcement.
• Audit confidentiality and legal proceedings: Reg 10 protects audit information from disclosure except in limited circumstances, but also permits disclosure in legal proceedings arising out of audit reports or in connection with trust accounts. This can be part of enforcement where trust account irregularities are detected in audits and then become the basis for proceedings.
• Surety liabilities in enforcement: The Second Schedule makes the surety liable for penalties, damages and costs adjudged against the licensee relating to acts done as a debt collector prior to termination of the bond; the surety’s exposure and its ability to withdraw on notice influence enforcement outcomes and risk allocation.

Overall, enforcement is a mixed model: a combination of administrative infringement notices for low‑value regulatory contraventions (with specified modified penalties), a residual prosecutorial route for non‑payment or contested matters, and a bond/surety backstop for certain civil liabilities arising from trust account mis‑handling (Second Schedule). The Regulations explicitly tie enforcement mechanics to the Criminal Procedure Act 2004 and to the Fines, Penalties and Infringement Notices Enforcement Act 1994 via the Form 7 process.

The Regulations explicitly cross‑refer to and operate alongside several statutory instruments. The text frames multiple dependencies and administrative linkages.

Primary statute relationship

• Debt Collectors Licensing Act 1964: The Regulations are subordinate to and implement the Act. They refer multiple times to specific Act provisions (for example, reg 5 references s 20 of the Act for fidelity bond requirements; regs 6 and 6A operate for the purposes of s 10A(1) of the Act; reg 7 references s 9(5) of the Act for duplicate licences; reg 5(6)(b) refers to the register kept pursuant to s 12 of the Act). The Regulations do not amend or alter the Act’s substantive licensing threshold; rather they set procedural, fee and documentary rules necessary for the Act’s administration.
• Licensing Provisions Amendment Act 2016: Reg 6A(1) defines a transition period as that commencing on the day s 13 of the Licensing Provisions Amendment Act 2016 comes into operation and ending 12 months later. Reg 6A(3) then prescribes staggered renewal periods for licences renewed during that transition period. This demonstrates direct interaction with amending legislation.

Enforcement and procedure

• Criminal Procedure Act 2004: The Regulations make specified offences subject to infringement notices under Part 2 of the Criminal Procedure Act 2004 (reg 16(1)). The modified penalties in the Third Schedule are declared to be the modified penalties for the purposes of s 5(3) of that Act (reg 16(2)). The Commissioner is empowered to appoint authorised officers for the purposes of Part 2 of the Criminal Procedure Act (reg 16(3)) and to provide them with identification (reg 16(4)).
• Fines, Penalties and Infringement Notices Enforcement Act 1994: Form 7 (the infringement notice form) advises the alleged offender that failure to pay may lead to enforcement under this Act, listing the enforcement powers available under that Act, such as licence suspensions, garnishee proceedings and immobilisation of vehicles (First Schedule, Form 7). That makes clear the practical enforcement pathway if a modified penalty is unpaid.

Other administrative and statutory interfaces

• Ministerial approval and insurance law: The Second Schedule requires the fidelity bond to be provided by an incorporated company carrying on insurance business in Western Australia and approved by the Minister. This interlocks the Regulations with the Minister’s discretionary approval processes and any statutory or prudential requirements applicable to insurers.
• Police notification and public administration: Reg 5 requires notification to the Commissioner of Police on receipt of transfer applications and on transfer (reg 5(1) and reg 5(6)(c)); Form 4 is the standard notification to police in respect of issue, renewal, cancellation, surrender, change of place of business or transfer. This creates an administrative link between the licensing register and police awareness but does not specify police enforcement powers in the Regulations themselves.
• Trust account and audit processes: Reg 10 governs non‑disclosure by auditors and persons appointed by the Minister in relation to audits under the Act. The Third Schedule expressly lists s 15(4) of the Act (failing to notify the Commissioner of the opening or change of name of a trust account) as a prescribed offence attracting a modified penalty. Thus statutory trust account rules in the Act are implemented and policed through regulatory offences and audit confidentiality carve‑outs.
• Compilation and amendments: The Compilation table shows many subsequent amendments and amendments to fees and administrative rules via other regulations (e.g. Commerce Regulations amendments 2016-2025 and the Licensing Provisions Regulations Amendment 2017). This demonstrates that the Regulations are updated through related regulatory instruments and fee reforms.

Net effect of cross‑references

• The Regulations are tightly integrated into a statutory ecosystem where the Act supplies substantive licensing and trust account duties, the Criminal Procedure Act 2004 supplies the infringement notice machinery, and the Fines Act supplies enforcement conduits. The Minister and Commissioner perform discrete roles, with the Minister retaining approval/appointment powers (Second Schedule, reg 10) and the Commissioner exercising most operational discretion (transfers, register updates, refund decisions, appointment of authorised officers).
• Practitioners must therefore consider the Act’s substantive provisions and these other statutes when advising clients, since the Regulations presuppose and implement duties found in those instruments (e.g. fidelity security required under s 20 of the Act; infringement notice procedure under the Criminal Procedure Act 2004).

All cross‑references, approvals and process linkages are explicit in the Regulations and associated Schedules (regs 2, 4(2), 5, 6, 6A, 8, 9A, 10, 15‑16; Second Schedule; Third Schedule; First Schedule).

The Regulations carry a detailed compilation history that records multiple amendments and reprints from 1965 to 2025. The compilation table in the instrument is the authoritative internal record of those changes and identifies the instruments and commencement dates.

Key stages and notable amendments recorded in the compilation table

• Initial commencement and early regulations: The Debt Collectors Licensing Regulations 1964 were published 14 April 1965 and commenced 1 May 1965 (Compilation table). Additional untitled regulations were added in October 1965 and January 1966 (Compilation table).
• Mid‑period updates and reprints: A 1975 amendment inserted reg 3 requiring corporate applications to be signed by a corporate officer (see reg 3 inserted Gazette 26 Sep 1975 p. 3725). Reprints occurred in 1980, 2001 and various later dates, reflecting consolidation with prior amendments (Compilation table).
• Fee and administrative amendments since 2004: Significant modernisation and fee adjustments appear in a cluster of amendments and reprints from 2004 onward. The 2004 amendment (Gazette 30 Dec 2004 p. 6915‑17) and subsequent amendments adjusted forms, fidelity bond references and administrative processes (reg 8 amended, reg 7 amended). The fee Table in reg 4 shows a history of amendments with multiple Gazette entries cited in reg 4 (Gazette 23 Jun 2015; 3 Jun 2016; 23 Jun 2017; 27 Jun 2017; 25 Jun 2018; 18 Jun 2019; 25 Jun 2019; SL 2020/196 r. 19; SL 2021/86 r. 25; SL 2022/59 r. 14; SL 2023/35 r. 16; SL 2024/96 r. 15; SL 2025/89 r. 14).
• Infringement notice machinery: Reg 16 and the Third Schedule were inserted by Gazette 22 Sep 2006 p. 4102‑04 and reflect the regulatory choice to use the Criminal Procedure Act 2004's infringement notice system as an enforcement channel.
• Licensing provisions amendments and transitional rules: Reg 6A (prescribed period for renewal) was inserted Gazette 27 Jun 2017 p. 3411 in response to the Licensing Provisions Amendment Act 2016. It defines a transition period and provides staggered renewal durations during that transition (reg 6A(1)‑(3)).
• Recent fee updates: The fee table in reg 4, including the precise dollar figures stated, has been updated repeatedly up to and including the 2025 entry (SL 2025/89 r. 14), demonstrating periodic adjustment of administrative costs and compliance burdens.

Specific textual insertions and deletions

• Reg 3 insertion was recorded in 1975 (reg 3 inserted: Gazette 26 Sep 1975 p. 3725).
• Forms 1, 2, 3, 5 and 6 have been deleted at various times (First Schedule notes deletions), while Forms 4, 7 and 8 remain and were amended between 2004 and 2018 (First Schedule).
• Reg 4(1A) and reg 4A were deleted (notations show deletion of (1A) and reg 4A: SL 2021/86 r. 26 and earlier changes).
• Reg 6 (prescribed period for issue of licence) was inserted 27 Jun 2017 (reg 6 inserted: Gazette 27 Jun 2017 p. 3411), and reg 6A was inserted the same day to handle transitional renewal periods.
• The Second Schedule fidelity bond text was amended in 2004 and 2006 entries (Second Schedule amended Gazette 30 Dec 2004 p. 6917; 22 Sep 2006 p. 4104).
• Reg 10 and reg 16 were inserted or amended to implement audit confidentiality and infringement notice appointment processes (reg 10 inserted/unchanged, reg 16 inserted Gazette 22 Sep 2006 p. 4102).

Practical reading of amendment history

• The compilation table is comprehensive from enactment through to 2025 and should be used to trace specific fee‑setting or administrative changes. For example, the precise fee figures in reg 4 reflect successive amendments up to SL 2025/89; practitioners must check the compilation table to confirm the commencement date of a fee change if advising on payments or refunds.
• The insertion of the infringement notice machinery (2006) and later adaptations (2020 additions tied to COVID‑19 response and other Commerce Regulations amendments) indicate policy shifts towards administrative enforcement and fee indexation/adjustment rather than substantive change to licensing thresholds.

The Regulations explicitly record these amendments; all references to Gazette entries and statutory instruments are provided in the compilation table at the end of the Regulations text.

The Regulations themselves do not include cases or judicial decisions, and the instrument contains no internal litigation history. The text names no decisions, appeals, or litigated outcomes.

What the Regulations disclose about potential litigation

• Enforcement pathways: The presence of an infringement notice regime (reg 16; Third Schedule) and the option for an alleged offender to request court prosecution (Form 7, First Schedule) indicate two possible routes that could result in litigation: (a) contested infringements where the recipient opts for court, and (b) prosecutions where a modified penalty is unpaid and the matter proceeds to court. The Regulations therefore anticipate litigation but do not record any judicial treatment.
• Surety liability: The Second Schedule creates a legal instrument (the fidelity bond) that could form the basis of civil litigation between surety, licensee and claimants where adjudged penalties, damages or costs arise or where the surety purports to terminate liability on notice. The Second Schedule’s termination and residual liability provisions may be litigated in appropriate disputes, but no cases are cited in the Regulations.
• Administrative discretion and review: The Regulations confer administrative powers on the Commissioner (transfers, refunds, appointments) which are typical subjects of judicial review or merits review in administrative law contexts. The text does not canvass review routes or precedent.

Guidance for practitioners

• Because the Regulations themselves do not include litigation references, a practitioner who needs the litigation history around any particular regulatory provision must consult external sources: tribunal or court databases, decisions under the Act, and disciplinary or administrative decisions published by the Department. The Regulations provide the enforcement mechanism and potential causes of action but do not catalog outcomes.
• The lack of internal litigation history means reliance on the statutory language and on external searches for authoritative interpretative guidance or reported disputes regarding issues such as the Commissioner’s fitness assessments for transfers (reg 5(4)), the Commissioner’s discretion in refunding surrender fees (reg 9A(2)), or the operation of the Second Schedule surety termination clause.

In short, the Regulations contain no named cases or litigation history; they set out the legal tools and processes that can give rise to litigation, and practitioners should consult external judicial and tribunal records to locate any judicial interpretation, review or enforcement decisions that engage these Regulations.

This section identifies points where routine practice often produces compliance traps, operational surprises or contractual and timing risks. Each point is grounded in the Regulation text.

High fixed fees and late‑application percentage penalty

• The prescribed issue/renewal fee is $2,525.35 (reg 4 Table, item 1). A licensee who renews late will pay an additional penalty equal to 25% of that renewal fee (reg 4(2)). That 25% is a material extra charge and is calculated on the renewal fee, not a nominal flat amount. Practitioners should note that fee figures have been recently updated repeatedly (compilation table) and confirm current figures at the time of application.

Fidelity bond sums and surety termination risk

• The Second Schedule prescribes bond sums of $10,000 for corporate applicants and $6,000 for natural persons (Second Schedule). Obtaining such a bond from an insurer approved by the Minister could delay application processing and carries costs. The surety can give written notice to be relieved of further liability as from a date not earlier than 30 days after service, with residual liability preserved for acts before the termination date (Second Schedule). That creates a continuity risk for licensees if a surety withdraws and replacement security is not promptly supplied (reg 5(2)(d); reg 5(3)).

Commissioner discretion in transfers and refunds

• Transfers are conditional on the Commissioner being satisfied that the transferee is of good fame and character, fit and proper, and over 21 (reg 5(4)). The regulations require testimonials from at least three reputable persons (reg 5(2)(b)). These are qualitative criteria that may be applied with administrative discretion; applicants should present comprehensive evidence. Refunds for surrendered licences are at the Commissioner’s opinion as to the amount “that relates to the period between the day the licence is surrendered and the day the licence would have expired” (reg 9A(2)). The exercise of that discretion is not tightly constrained in the text and may lead to disputes.

Narrow exemption conditions

• Reg 14 exempts certain collectors of secured moneys only if the debtor’s knowledge of the collector’s authority exists “at or before the time when the debt becomes due and payable or within one month thereafter”, the person is not otherwise a debt collector under the Act, and the person does not prepare or issue or take active part in preparing or issuing court process. Small failures in timing or involvement in recovery proceedings can accidentally remove an exemption and trigger the licensing obligation (reg 14(1)). Parties relying on this exemption should document debtor notices and avoid involvement in court process.

14‑day notification timescale

• Licensees must notify the Commissioner of changes to name, business place, residential address or directors within 14 days (reg 12(1)‑(2)). The Third Schedule lists reg 12 failing to notify change of address as a prescribed infringement offence with a $40 modified penalty (Third Schedule). The short window requires administrative processes; missing it risks easy‑to‑avoid small penalties.

Vehicle signage prohibition

• Reg 11 makes it an offence for a licensee to use a vehicle on which is painted, affixed or otherwise exhibited “the fact that he is a debt collector”, the words “debt collector”, or any words importing that he carries on the business. This can look counter‑intuitive for firms that use company vehicles for visibility. The prohibition extends to words “importing” the business, so generic signage implying collection services could be captured. The Third Schedule lists r 11 as a prescribed infringement offence ($40). Practitioners should review vehicle decals and marketing materials.

Low modified penalties may encourage payment over contest

• The $40 modified penalties for many contraventions (Third Schedule) are low relative to the maximum fine of $200 (reg 15). The practical effect is that an alleged offender has a cheap option to pay and avoid prosecution; this can dampen contestation of enforcement actions and reduce development of caselaw on regulatory ambiguities.

Audit confidentiality with narrow exceptions

• Auditors and Minister‑appointed persons must not divulge audit information except in narrow circumstances such as Ministerial reports, legal proceedings arising from reports or disclosures to sureties with Ministerial consent (reg 10(1)‑(2)). This will limit the flow of audit information to third parties but does permit disclosure where litigation or surety claim necessitates it. Practitioners handling trust account disputes should be aware that audit findings are not freely disclosable without meeting an exception.

Register and police notification

• The Commissioner must notify the Commissioner of Police on receipt of a transfer application and on transfer (reg 5(1) and reg 5(6)(c)). This means police will be routinely informed of licensing changes; some applicants may not anticipate this external notification stream.

Formality traps

• The Regulations require specified forms; for certain processes the First Schedule prescribes forms that have been changed and some deleted over time (reg 2; First Schedule note deletions). Using an outdated form or failing to secure the Minister’s necessary approvals for surety could delay processing. Corporate signatory rules (reg 3) are mandatory; an improperly executed application by a corporation risks rejection.

Interaction timing and transitional renewals

• Reg 6A creates a transitional set of renewal periods dependent on when an application is made during a defined transition period. If renewals and expiry dates fall during the transition, licences may be renewed for 1, 2 or 3 years depending on expiry timing (reg 6A(3)(a)‑(c)). Practitioners should pay attention to these transitional rules during the specified period.

In sum, the principal gotchas are monetary (upfront bond and fee costs and late renewal penalty), timing (14‑day notifications and transition renewal windows), discretion (Commissioner’s satisfaction for transfers and refund), and formality (approved forms, signatures and bond form). Each of these is directly traceable to the relevant regulations: regs 2-5, 8-9A, 11-13, Second Schedule and Third Schedule.

This section sets out a practical compliance roadmap anchored in the Regulations’ text. It addresses application preparation, ongoing obligations, risk management around bonds and audits, and enforcement‑avoidance measures.

Pre‑application and application

• Use approved forms and correct signatories: Prepare the application using the approved form in the First Schedule for the relevant purpose (reg 2). If a corporation is the applicant, ensure the application is signed by the corporation’s manager, secretary or other governing officer as required by reg 3.
• Prepare fidelity security in prescribed form: Obtain a fidelity bond or approved security in the prescribed form or effect (reg 8; Second Schedule). Ensure the surety is an incorporated insurance company approved by the Minister as contemplated by the Second Schedule. For corporate applicants expect the $10,000 bond requirement; for natural persons the bond sum is $6,000 (Second Schedule).
• Budget for fees and potential late penalty: Pay the fee in reg 4 Table at the time of application (issue/renewal fee $2,525.35 as stated in the Table). If renewal will be late, budget for a 25% penalty of the renewal fee (reg 4(2)). Verify the current fee at the time of application, as figures are updated by regulation amendments (see Compilation table).
• For transfers, assemble testimonials and documents: When applying for a transfer, lodge the existing licence, provide at least three testimonials of character for the proposed transferee, pay the prescribed fee (reg 5(2)(a)‑(c)), and provide a fidelity bond or equivalent security for the transferee (reg 5(2)(d)). If the existing fidelity bond is acceptable, obtain a written undertaking from the surety to extend liability to the transferee (reg 5(3)).

Licence management during currency

• Check and diarise renewal dates and prescribed periods: Note that issued and renewed licences are typically for a three‑year period (regs 6 and 6A(2)). Where transitional rules may apply (reg 6A(3)), map expiry into the transitional scheme to avoid unexpected shorter renewals.
• Maintain and update register details promptly: If there is a change to name, business address, residential address (if natural person) or directors (if corporation), notify the Commissioner in writing within 14 days (reg 12(1)‑(2)). On receipt, the Commissioner must update the register (reg 12(3)). Implement internal procedures so that staff trigger timely notification when any listed change occurs.
• Avoid vehicle signage that identifies you as a debt collector: Remove or avoid placing on vehicles any wording that “the person is a debt collector” or words importing that function (reg 11). If fleet markings might suggest collection activities, change them to avoid exposure to the infringement offence listed in the Third Schedule.
• Fee charging to debtors: If collecting debts paid by instalments, ensure that charges to debtors do not exceed 50 cents or 2.5% of the amount of the debt, whichever is greater (reg 13). Keep records of calculation rationale for any such amounts charged.

Trust accounts, audits and confidentiality

• Observe trust account rules in the Act and notifications: The Third Schedule identifies failing to notify the Commissioner of opening or change of name of a trust account (s 15(4) of the Act) as a prescribed offence with a $40 modified penalty. Ensure trust account openings and name changes are promptly notified in compliance with the Act and the Regulations.
• Be prepared for audits and confidentiality constraints: Auditors and persons appointed by the Minister must keep audit information confidential except in limited circumstances (reg 10). Where auditors report issues, be prepared that disclosures may be made to the Minister, used in related proceedings, or disclosed to a surety with Ministerial approval (reg 10(2)). Maintain appropriate records to respond to audit queries and to support trust account reconciliations.

Bond management and surety renewals

• Monitor surety and bond status: The Second Schedule allows a surety to give written notice to be relieved of liability as from a date not earlier than 30 days after service (Second Schedule). Monitor any received notices and ensure replacement security is available before the termination date to avoid licensing jeopardy. Maintain contact with the insurer to ensure continuity of bond coverage.
• Keep a copy of the bond and ensure compliance with bond conditions: The Second Schedule defines the surety’s obligations for penalties, damages and costs adjudged against the licensee for acts as a debt collector, and requires the bond to remain effective until terminated according to the bond’s provisions.

Responding to enforcement actions

• Treat infringement notices as cost‑effective resolution options where appropriate: The Third Schedule prescribes specific contraventions as suitable for infringement notices with modest modified penalties (e.g. $40). Consider the commercial choice between paying a modified penalty or electing court prosecution only when there is a bona fide contest of the facts or law. Use Form 7 and its instructions in the First Schedule to ensure proper handling of infringement notices and any requests for extension or court prosecution.
• Maintain records for contesting or negotiating enforcement actions: Keep contemporaneous records of compliance steps (notifications, bond documents, trust account records, vehicle signage approvals) to contest an infringement or to seek withdrawal (Form 8 in First Schedule details withdrawal and refund procedures).

Administrative housekeeping

• Use approved forms and check for updates: The First Schedule contains current approved forms; some forms have been deleted and others amended over time. Always use the current form set as required by reg 2 and check the Department’s published forms and guidance.
• Build internal compliance processes: Implement a compliance checklist that covers renewal diaries, 14‑day notification triggers, trust account notifications, fidelity bond expiry and insurer notices, vehicle branding reviews, and record retention for audits.

Who to contact and decision routes

• Commissioner for Consumer Protection: The Commissioner is the central administrative contact for licence transfers, endorsements, refunds and register updates (regs 5(6)(a)‑(b); reg 9A(2); reg 12(3)). Notification to police is effected by the Commissioner as required by reg 5.
• Minister where approvals required: For fidelity bond approvals and some audit disclosures (reg 10(2)(c)), the Minister’s role is relevant; applicants relying on surety approvals should engage early with the Department’s licensing administrators.

In short, compliance under the Regulations is procedural and document‑centric: use the approved forms, secure fidelity security to the Second Schedule, meet the 14‑day notification obligations, avoid prohibited vehicle markings, cap debtor charges as provided, and maintain records to support trust account audits and any infringement contest. Each step is traceable to the relevant regulation cited above (regs 2-5, 8-13, 15-16; Second and Third Schedules; First Schedule Forms).
