sec.109 Use of information obtained under ss 105 or 108

This section applies to the chief executive in considering information about a person obtained under section 105 or 108 . Information about a conviction of a person may be used only for making a decision as to whether a person is— a suitable person to hold a licence; or a suitable person to be registered as a subagent; or suitable to perform a debt collection activity as authorised under part 2 , division 3 ; or a suitable person to open a trust account under the Administration Act , part 2 . Information about a charge of an offence laid against a person may not be the basis for making a decision mentioned in subsection (2) . (sec.109-ssec.1) This section applies to the chief executive in considering information about a person obtained under section 105 or 108 . (sec.109-ssec.2) Information about a conviction of a person may be used only for making a decision as to whether a person is— a suitable person to hold a licence; or a suitable person to be registered as a subagent; or suitable to perform a debt collection activity as authorised under part 2 , division 3 ; or a suitable person to open a trust account under the Administration Act , part 2 . (sec.109-ssec.3) Information about a charge of an offence laid against a person may not be the basis for making a decision mentioned in subsection (2) .

• (a) a suitable person to hold a licence; or
• (b) a suitable person to be registered as a subagent; or
• (c) suitable to perform a debt collection activity as authorised under part 2 , division 3 ; or
• (d) a suitable person to open a trust account under the Administration Act , part 2 .
