Daylight Saving Act 2006

The Act pivots on a small set of legal concepts and cross‑references to other statutes. Definitions in section 3 establish baseline terminology. "Standard time" is the time declared under the Standard Time Act 2005; "summer time" is the time to be observed as provided by this Act (s 3). The Act treats "the hour of 2 a.m." as that hour determined by standard time (s 3), which matters because the specified starts and finishes for summer time are expressed by reference to that hour (s 4).

Summer time, when declared under the Act, is defined mechanically as one hour in advance of standard time and is to be observed throughout the State for the specified trial periods (s 4). The Act thus does not establish a discretionary regional regime; it operates state‑wide for the dates listed. The trial is statutory and temporally bounded: three separate summer time intervals across two southern summer seasons are prescribed explicitly in the schedule of section 4.

The referendum mechanism is a statutory trigger for a potential permanent legal alteration. The "prescribed question" is specified verbatim in s 5(2). The timing window for submission to electors is defined in s 5(1). The Act prescribes the required marking on the ballot paper (s 5(3)) by instructing electors to write "yes" or "no" depending on their view of advancing standard time one hour from the last Sunday in October to the last Sunday in March annually.

Section 7 is a general construction clause. It operates as an interpretive rule: any time or period in enactments, contracts, agreements, deeds or instruments is to be read as summer time for the duration of the declared summer time period unless a contrary intention is expressed. That makes the Act an operational default for temporal meaning across many legal instruments.

Section 9 creates delegated regulatory power to declare trading hours, hours of work, licence trading hours and school hours, and "such other matters" that the Governor, on the Minister's recommendation, considers necessary to moderate the effect of summer time. These regulations can be applied by region and period (s 9(3)), but are constrained by s 9(2): they must not increase or decrease prescribed trading/work/operation hours, and they cannot shift commencement or termination by more than one hour relative to times under the relevant written law. Subsection 9(4) provides that regulations made under s 9(1) operate according to their tenor "despite any written law or other law, or any award or agreement, or any order or ruling", thereby giving those regulations primacy during their specified operation period.

Section 8 narrows the Act's reach by preserving the Standard Time Act 2005 generally (s 8(1)) and by protecting use of standard time specifically for astronomy, meteorology and navigation, and for the construction of documents mentioning those times (s 8(2)).

Commencement mechanics in section 2 link the operation of the permanent change provision (section 6) to the procedural mechanics of the Referendums Act 1983, including the requirement for publication of the statement referred to in Referendums Act s 30(3), and to potential judicial avoidance of the referendum or returns under Referendums Act Part VI, which can trigger a proclamation ceasing section 6 (s 2(2)-(3)).

The Act therefore combines fixed statutory shifts (s 4), an electorate decision point tied to a statutory question and voting instructions (s 5), an interpretive default for time references across instruments (s 7), delegated regulatory powers with primacy over conflicting instruments during the summer period (s 9), and a set of narrow technical carveouts (s 8).

The Act’s scope is state‑wide and its primary legal subjects are multiple: electors, persons and organisations whose hours of trade or work are regulated, holders of licences and operators of schools, parties to contracts and instruments that specify time, and various arms of government charged with implementing or regulating hours. The Act defines "electors" by reference to the Referendums Act 1983 (s 3), and the referendum in s 5 is to be conducted under and in accordance with that Act, which therefore governs who may vote and how the referendum is administered (s 5(1)).

Section 4 declares that summer time shall be observed "throughout the State" for the listed periods. That means individuals, businesses and public authorities operating anywhere in Western Australia must observe summer time for those precise intervals. Section 7 extends the Act’s effect into private and public legal relationships by requiring that prescribed times or periods in any enactment, contract, agreement, deed or instrument be held to be, and determined by reference to, summer time during any declared period, unless a contrary intention appears. Therefore, parties to leases, licences, service contracts, deadlines in statutory instruments, and similar legal documents are directly affected because the default temporal reference shifts by statutory operation.

Organisations regulated under the Retail Trading Hours Act 1987 are explicitly targeted in s 9(1)(a): the Governor may make regulations declaring trading hours for any such organisation. Employers and employees whose hours are regulated under the Industrial Relations Act 1979 are identified in s 9(1)(b): the Governor may declare hours of work. Licensed premises under the Liquor Licensing Act 1988 are referenced in s 9(1)(c) for trading hours declarations. Schools regulated under the School Education Act 1999 are referenced for hours of operation in s 9(1)(d). That list maps regulatory levers to specific sectors where time‑of‑day matters materially affect operational practice.

Regulators, tribunals, courts and industrial bodies are affected indirectly because regulations made under s 9(1) are stated to have effect "despite any written law or other law, or any award or agreement, or any order or ruling" (s 9(4)). That may compress the domain where those bodies typically exercise authority over hours, particularly for the period and regions specified in any regulation.

Public bodies engaged in astronomy, meteorology and navigation are insulated from the switch: section 8(2) preserves the use of standard time for the purposes of those fields and for the construction of documents referencing times in connection with them. Legal practitioners, courts, tribunals and compliance officers must therefore attend to whether a temporal reference is to be read in summer time (per s 7) or remains standard time because it relates to the protected technical purposes in s 8(2).

Finally, the Governor and the Minister have decision roles. The Act gives the Governor power to make regulations on the Minister’s recommendation (s 9(1)), and section 2(3) gives the Governor power by proclamation to cease section 6’s operation should the Supreme Court, under the Referendums Act, avoid the referendum or returns (s 2(3)). Thus the executive branch carries regulatory and contingency powers under the Act.

The Act primarily imposes statutory defaults and confers regulatory powers rather than creating a long list of affirmative duties on private persons. The clearest duty imposed on the public at large is the obligation to observe summer time during the statutory trial periods set out in section 4: "summer time shall, throughout the State, be one hour in advance of standard time and shall be observed accordingly" for the listed periods (s 4). That statutory instruction is express; compliance with observed time (rectifying clocks, schedules, timekeeping systems) during those periods is therefore required for persons and institutions operating in the State.

For those administering the referendum, the Act requires that the "prescribed question" be submitted to electors under and in accordance with the Referendums Act 1983 within a statutorily prescribed window (s 5(1)). The Act prescribes how electors must mark the ballot paper: an elector votes "yes" by placing the word "yes" in the space provided if they are in favour, or "no" similarly if opposed (s 5(3)). Those are procedural prescriptions for ballot conduct.

Section 7 creates a legal duty on drafters, contracting parties and adjudicators to treat time references as being by reference to summer time during declared periods unless a contrary intention is expressed. Practically, that means legal advisers and contracting parties bear the obligation to express any contrary intention clearly if they want a time reference to remain fixed to standard time during the declared summer time period. The Act shifts the default legal burden: express language is required to displace the statutory interpretive rule.

Section 9 imposes a procedural constraint and an executive duty: the Governor, on the Minister's recommendation, may make certain regulations to moderate the effect of summer time (s 9(1)). The Minister therefore has a functional gatekeeping role for regulation‑making in respect of hours. Regulations under s 9 must comply with limits in s 9(2) , they must not increase or decrease regulated trading, work or operation hours, nor move start/finish times by more than one hour relative to the time under the relevant written law. Those constraints are judicially cognisable prescriptions that the executive must observe when exercising delegated power.

Rights preserved by the Act include the right of electors to vote in the referendum using the prescribed method (s 5(3)), and the right to continue to use standard time for specified technical purposes: the Act expressly says nothing in it affects the use of standard time for astronomy, meteorology or navigation, or the construction of documents tied to those purposes (s 8(2)). Section 8(1) also asserts that, except where expressly provided in this Act, the Standard Time Act 2005 is not affected, which preserves existing statutory arrangements beyond the narrow departures created by the trial periods and other express provisions.

The Act confers no express private‑law causes of action or statutory penalties; enforcement and detailed rights and obligations concerning trading hours, employment hours or licence conditions, if regulated, will depend on the content and operative effects of regulations made under section 9 and on the applicable underlying legislation referenced therein.

The Daylight Saving Act 2006 contains no express offences, penalty schedules or direct enforcement mechanisms within its text. There is no provision in the Act creating criminal liability for failing to observe summer time, nor does the Act specify civil penalties payable to the Crown for non‑compliance with the summer time observance itself. Consequently, compliance incentives and sanctioning mechanisms will, as a legal matter, derive from other statutory regimes and from regulations made under section 9.

Section 9 provides delegated regulatory authority to declare trading hours, hours of work, licence trading hours and school hours, and such other matters as the Governor considers necessary to moderate the effect of summer time (s 9(1)). Those regulations may, depending on their form and the parent statute they operate under, prescribe offences or civil penalties, or otherwise adjust regulatory consequences that attach to contraventions of trading‑hours, employment or licensing frameworks. The Act expressly allows regulations made under s 9 to have effect "despite any written law or other law, or any award or agreement, or any order or ruling" (s 9(4)), which gives those regulations primacy during their specified period and geographic application. Where regulations are framed to impose obligations, enforcement will be by the machinery contained in those regulations and in the parent statutory regimes referenced in s 9(1) (for example, the Retail Trading Hours Act 1987, the Industrial Relations Act 1979, the Liquor Licensing Act 1988, or the School Education Act 1999) , but the Act itself does not reproduce those enforcement provisions.

Administrative enforcement may also arise via public law mechanisms where executive actors exercise the powers conferred by the Act. For example, the Governor's proclamatory power in s 2(3) to cause section 6 to cease if the Supreme Court avoids the referendum or returns contemplates executive action pursuant to judicial determination. The Act anticipates possible judicial involvement in the referendum process , the Referendums Act Part VI , but the Daylight Saving Act does not itself prescribe remedies for contravening the referendum process or for invalid returns; that is a matter for the Referendums Act.

Because breaches of obligations that are statutory in nature under other Acts referenced in s 9 may carry penalties under their own regimes, businesses and individuals should examine those statutes and any regulations made under s 9 to determine the enforcement consequences that will apply during the summer time period. The Daylight Saving Act gives the executive the device to alter operational hours and to put those changes beyond the disruptive effect of other laws during their operation (s 9(4)), but it stops short of setting out its own sanctions or enforcement procedures.

The Act is deliberately cross‑referential and calibrated to operate in tandem with several named statutes and the Referendums Act 1983. Section 4 operates "despite the Standard Time Act 2005" to declare that summer time will be in force for the specific trial periods, thereby creating an express, temporary departure from the Standard Time Act’s settings during those intervals. Section 8(1), however, limits that departure, stating that except as otherwise expressly provided in this Act, the Standard Time Act 2005 is not affected. That preserves the Standard Time Act except for the specific variations enacted here.

The referendum procedures are to be carried out "under and in accordance with the Referendums Act 1983" (s 5(1)). Section 2(2) expressly links the commencement of section 6 to publication of a statement referred to in Referendums Act s 30(3). Section 2(3) contemplates litigation under Referendums Act Part VI: if a Legislative Assembly or Council resolution refers questions respecting validity to the Supreme Court and the Supreme Court avoids the referendum or returns, the Governor may by proclamation cause section 6 to cease to be in operation (s 2(3)). Accordingly, the Act’s pathway for any permanent legal change is integrated into the Referendums Act’s legal and judicial architecture.

Section 9 identifies four Acts that regulate hours in specific sectors: the Retail Trading Hours Act 1987, the Industrial Relations Act 1979, the Liquor Licensing Act 1988 and the School Education Act 1999. The Governor may make regulations declaring trading hours or hours of work or operation in relation to organisations, employees, licensees and schools regulated under those Acts (s 9(1)(a)-(d)). Regulations are constrained by s 9(2), which forbids increasing or decreasing those hours, and forbids declaring hours to commence or terminate more than one hour after the time of commencement or termination prescribed under the relevant written law. This limits the executive’s ability to alter those statutory or regulatory timings beyond a maximum one‑hour displacement, but it also allows the executive to override particular hours subject to those bounds.

Critically, s 9(4) provides that regulations made under s 9(1) "have effect according to their tenor despite any written law or other law, or any award or agreement, or any order or ruling of any court, tribunal, commission or body." That clause establishes that, during their operation period and within their specified regions, s 9 regulations will operate with primacy over potentially conflicting awards, agreements, judicial or tribunal orders and other statutory instruments. The Act therefore creates a legislative mechanism to temporarily displace a range of existing legal norms governing hours during the summer period as regulated.

Section 7 affects private law by changing the construction of time references in contracts, deeds, instruments and enactments. It declares that any time prescribed in such instruments "shall, with respect to any period during which summer time is declared by this Act to be in advance of standard time, be held to be, and shall be determined by reference to, summer time unless the contrary is expressed" (s 7). That interpretive rule interfaces with private contract law and statutory drafting practice; it can alter the operation of other statutes and agreements simply by changing the default meaning of time‑of‑day references during the summer period unless the instrument expressly provides otherwise.

Section 8(2) establishes a narrow carveout: the Act does not affect use of standard time for astronomy, meteorology or navigation, or the construction of documents referring to time in connection with those purposes. That keeps those technical fields aligned to standard time irrespective of the summer time shift.

Overall, the Act is drafted to effect time‑of‑day shifts for the State and to provide the executive with limited but potent regulatory tools to smooth operational impacts, while integrating the permanent change mechanism into the Referendums Act framework. The interaction clauses (s 4, s 7, s 8, s 9) directly change how time is interpreted across statutes, private instruments and executive regulations.

The compilation table included in the statute text records the Act as enacted (No. 61 of 2006) with assent on 24 November 2006, and states the commencement arrangement: the Act other than section 6 commenced on 24 November 2006 (s 2(1)). The compilation table and the "Uncommenced provisions table" note that section 6 has not come into operation; section 6 is listed as operative only on the day after publication of a statement in the Gazette as contemplated in s 2(2) (compilation/uncommenced table entries).

No other amendments, insertions, repeals or subsequent statutory modifications are recorded within the text provided. The Act therefore appears, on the face of the material supplied, to be the original enactment as assented in 2006 with the single uncommenced provision (s 6) contingent on the referendum result and subsequent Gazette publication under the Referendums Act (s 2(2)). The notes caution readers: "For provisions that have come into operation see the compilation table. For provisions that have not yet come into operation see the uncommenced provisions table." The uncommenced table specifically lists s 6 with the same commencement mechanics referenced in s 2(2).

Because the Act cross‑references and depends procedurally on the Referendums Act 1983 for the activation of section 6 and on the Standard Time Act 2005 for the baseline definition of standard time (s 3), any legislative change to those external Acts could have knock‑on effects on the Daylight Saving Act’s operation, but the statute text itself reports no amendments to the Daylight Saving Act beyond its enactment and the conditional commencement status of s 6.

If parties require an up‑to‑date statutory history for compliance or litigation, they should consult the official WA legislation compilations or the Gazette entries, because the compilation table in the Act text is the only source of amendment information provided here.

The Daylight Saving Act 2006 text does not record any litigation history or judicial determinations interpreting its provisions. The statute itself anticipates potential judicial engagement with the referendum process by reference to the Referendums Act 1983. Section 2(3) contemplates the possibility that a question respecting the validity of the referendum, or of any return or statement showing the voting on the referendum, may be referred to the Supreme Court by resolution of either House under the Referendums Act Part VI. If the Supreme Court subsequently avoids the referendum or such a return or statement, section 2(3) authorises the Governor, by proclamation, to provide that section 6 ceases to be in operation on the day specified in that proclamation. That is a procedural interaction with judicial review mechanisms contained in the Referendums Act rather than a substantive remedy created in this Act.

Because the Act text provided contains no entries in a litigation history section and cites no cases, there is no within‑Act record of judicial interpretation of section 7’s construction rule, the scope of section 9(4)’s "despite" clause, or any other contested point. Any history of suits, declaratory relief, or interpretation concerning this Act would therefore be external to the text supplied and must be located through judicial databases or case law searches. The Act's built‑in acknowledgment of potential Supreme Court referral with the power to cause section 6 to cease (s 2(3)) is the only explicit nod to litigation processes in the source material.

Practitioners should note that disputes are foreseeable on questions such as the effect of s 7 on deadlines, the permissible scope of s 9 regulations given the constraints in s 9(2), and the scope of s 9(4)’s capacity to displace awards and agreements; however, any assertion about actual litigation outcomes or precedent would require independent verification from case law, which is not present in the Act text provided.

Several practical and legal traps arise directly from the Act’s text and structure. These are matters where statutory defaults or delegated powers can produce consequential operational outcomes that parties might overlook.

1. Default temporal construction changes many instruments. Section 7 makes summer time the default reference for time and period expressions in enactments, contracts, agreements, deeds and instruments during declared summer time periods unless a contrary intention is expressly provided. The "unless the contrary intention appears" phrase requires express language to preserve standard time. That can unintentionally shift statutory deadlines, notice periods, limitation calculations, contractual delivery times, court filing cut‑offs and the like simply because parties did not anticipate the statutory time change. Practitioners drafting or advising on time‑sensitive instruments should insert express language specifying whether times refer to standard time or to local time as observed to avoid automatic displacement.

2. Executive regulations can temporarily override awards, agreements and other laws. Section 9(4) says regulations made under s 9(1) operate "despite any written law or other law, or any award or agreement, or any order or ruling". That gives such regulations broad displacing effect during their operation periods and in their specified regions. Employers and unions should note the risk that a s 9 regulation could temporarily adjust hours of work or trading hours irrespective of enterprise agreements or modern awards, subject to the limits in s 9(2). This can affect rostering, penalty rates, overtime calculations and licensing conditions.

3. Limits on regulatory adjustments are precise but narrow. Section 9(2) prohibits regulations from increasing or decreasing trading, work or operation hours, and from declaring hours to commence or terminate more than one hour after the time of commencement or termination prescribed under the relevant written law. Those caps mean the executive can only move prescribed times up to one hour, but it can still make material operational adjustments within that one‑hour window. Entities that rely on precise start/finish windows should model the operational and financial impact of a one‑hour displacement even if statutory hours remain unchanged.

4. Technical carveouts preserve standard time for certain uses. Section 8(2) expressly preserves standard time for astronomy, meteorology and navigation and for construction of documents referring to times in connection with those purposes. Commercial actors using those technical fields should ensure their systems and documentation remain aligned to standard time when those purposes are implicated; failing to do so may create inconsistency between operational practice and statutory carveouts.

5. The Act contains an uncommenced permanent‑change provision. Section 6 has not been brought into operation and is conditional on referendum outcome and Gazette publication under the Referendums Act (s 2(2)). The Governor also has power to cause section 6 to cease if the Supreme Court avoids the referendum or returns under Referendums Act Part VI (s 2(3)). So permanent legal change is not automatic; it is contingent and subject to procedural and judicial events. Stakeholders should not assume permanence until the statutory triggers are satisfied and section 6 is brought into force.

6. Ballot marking is prescribed. Section 5(3) prescribes that electors must place the word "yes" or "no" on the ballot paper as their vote. That is an unusual level of prescription about ballot form and could have implications for ballot validity where marking deviates. Election administrators and legal advisers advising on ballot challenges should be aware the Act dictates the required form.

7. Temporal anchors use standard time. The Act defines "the hour of 2 a.m." as that hour determined by standard time (s 3). That is material because the prescribed start and end times in s 4 are tied to "the hour of 2 a.m." and hence to standard time, ensuring a consistent reference point when clocks are shifted.

8. Regulations are geographically and temporally bounded but can be targeted. Section 9(3) permits regulation by "such region or area" and "during such period" as the regulations specify, but also declares they have no effect outside the period from 2 a.m. on the last Sunday in October to 2 a.m. on the last Sunday in March. Stakeholders must therefore monitor both the regional scope and the temporal scope of any regulation to determine operational applicability.

Each of these points arises directly from the wording of the Act and represents an operational or legal risk that parties should address in contractual drafting, system configuration, rostering, compliance policies and litigation planning.

The Act’s compliance requirements are largely operational and drafting‑centric. Because the statute modifies the legal meaning of time during declared periods and gives the executive limited but wide regulatory competency, compliance involves preparedness, clear drafting and monitoring of executive action.

1. Identify affected instruments and insert clear time language. Review contracts, licences, deeds, statutory notices and procedural rules that specify times or periods. Where a particular time must remain anchored to standard time, add an express clause to that instrument stating the time is to be read as "standard time" (or equivalent explicit language) to displace the default in s 7. Conversely, if an instrument should follow local observed time, confirm that express wording aligns with summer time during declared periods.

2. Update operational systems and clocks for declared trial periods. Section 4 requires observance of summer time during the three statutory trial intervals. Organisations should ensure timekeeping systems, scheduling software, public‑facing hours, point‑of‑sale systems and telecommunications platforms reflect the one-hour advance for those specified intervals. The statutory anchor for the transition is "the hour of 2 a.m." as standard time (s 3), so transitions should be programmed to occur at that legal reference point.

3. Review industrial instruments and rostering practices in light of s 9. Employers and human resources teams should map enterprise agreements, awards and rostering practices to the potential for s 9 regulations to declare hours of work and for those regulations to operate despite awards and agreements (s 9(1)(b), s 9(4)). Even though s 9(2) prohibits moving hours by more than one hour, that permitted displacement can affect penalty rates and overtime. Parties should engage with unions and regulatory agencies to understand anticipated regulations and mitigate disputes.

4. Prepare for any retail, liquor or school hours adjustments. Retailers, liquor licensees and education administrators must monitor regulations under s 9(1)(a), (c) and (d). Regulations cannot increase or decrease prescribed hours or move times by more than one hour (s 9(2)), and any such regulations have specified territorial and temporal effect (s 9(3)). Organisations should maintain contingency plans to adjust opening hours, staffing and communication to customers or parents in response to any regulation.

5. Observe the technical carveouts. Entities and professionals in astronomy, meteorology and navigation must continue to use standard time for their purposes and documents where applicable (s 8(2)). Ensure scientific reporting, timetables and navigational references remain linked to standard time as required.

6. Train staff on legal deadline interpretation. Legal teams, court registry staff and compliance officers should be briefed that statutory construction for time references will change under s 7 during declared summer periods unless contracts expressly state otherwise. That includes filing deadlines, notice periods and limitation calculations. Where necessary, build extra operational buffers around deadlines to manage the interpretive shift.

7. Monitor the Gazette and ministerial/ executive notices. The commencement of section 6 is linked to publication of a statement under the Referendums Act (s 2(2)) and the Governor may act by proclamation under s 2(3). The Governor’s regulations under s 9 are made on the Minister’s recommendation; their instruments, territorial scope and operative periods will be published in the Gazette or other official channels. Active monitoring is required to detect changes with legal effect.

8. Electoral compliance for referendum administrators. Where involved in the referendum process, ensure ballots conform to the prescribed question (s 5(2)) and the voter marking instructions (s 5(3)). Electoral administrators should check that ballot paper design and instructions match the statutory prescription to avoid procedural invalidity grounds.

9. Seek express regulatory guidance where uncertain. Because s 9(4) gives regulations the capacity to operate despite awards and orders, affected stakeholders should seek early engagement with government and regulatory agencies to clarify how any proposed regulations will interface with existing industrial and licensing frameworks, and to test the application of s 9(2)’s caps.

10. Document operational rationale and notices to third parties. If a party elects not to change contractual times or to specify particular treatment of times, document that express intention in the contract or in formal notices to counterparties, because section 7 resolves the default against parties who fail to state a contrary intention.

Compliance under this Act is a mix of statutory observance (follow summer time during declared periods), protective drafting (express whether times refer to standard time), regulatory monitoring (watch for s 9 regulations) and operational adjustment (shift clocks, schedules and systems to the legal time anchor). The Act itself does not create penalties; enforcement will flow from regulations or other statutory regimes where applicable, so compliance should be oriented around the instruments and statutes referenced in s 9 and the practical effects of s 7.
