91 Dealing with complaints
(1) If the Commissioner receives a complaint under section 88, the Commissioner must: (a) make any preliminary inquiries, of the complainant, respondent or any other person, that the Commissioner considers necessary for the purposes of determining whether and how to deal with the complaint; and (b) consider whether it would be appropriate to seek to resolve the complaint by conciliation, or an external dispute resolution scheme recognised under section 131, and, if so, make the necessary arrangements. (2) Paragraph (1)(b) does not apply if the Commissioner is satisfied that a ground exists for not dealing with the complaint (see section 92).
