127 Guidelines
(1) The Commissioner may, by legislative instrument, make written guidelines in relation to matters for which the Commissioner has functions under this Act.
Note: Data scheme entities must have regard to the guidelines when engaging in conduct for the purposes of this Act (see section 27).
(2) The guidelines may include principles and processes relating to: (a) any aspect of the data sharing scheme; and (b) any matters incidental to the data sharing scheme, including: (i) data release; and (ii) data management and curation; and (iii) technical matters and standards; and (iv) emerging technologies. (3) Guidelines that are inconsistent with the regulations, rules or data codes have no effect to the extent of the inconsistency, but guidelines are taken to be consistent with those instruments to the extent that the guidelines are capable of operating concurrently with them.
