36 Disposal of explosives after authorisation revoked (1) If the work health and safety commissioner intends to revoke the authorisation of an explosive, the work health and safety commissioner must, no later than 4 weeks before the intended date of revocation, give each person in the ACT known to be handling the explosive written notice of that intention (a notice of revocation) stating that the person is required to dispose of the explosive on or before the intended date of revocation by— (a) destroying the explosive; or (b) removing it from the ACT. (2) If a person fails to comply with the notice of revocation, the work health and safety commissioner may take whatever steps are necessary and reasonable to dispose of the explosive under the person’s control. (3) The reasonable costs of the disposal of an explosive under subsection (2) are a debt owing to the Territory by the person who failed to comply with the notice. (4) A person to whom a notice of revocation is given must comply with the notice. (5) A person to whom a notice of revocation is given must ensure that the explosive that is the subject of the notice is not— (a) used; or (b) supplied to anyone else, unless the supply is for the purpose of removing the explosive from the ACT.
