#### 54 Prohibiting a person from involvement in the dangerous goods transport industry 54 Prohibiting a person from involvement in the dangerous goods transport industry > > (1) In sentencing an offender for an offence, a court may, having regard to the matters referred to in subsection (2) and to such other matters as it thinks fit, order that the offender be prohibited for a specified period from involvement in the transport of dangerous goods by road or rail. > > > (2) The matters to which a court must have regard are— > > > > > (a) the offender’s record in the transport of dangerous goods by road or rail, and > > > > > (b) any prior convictions of the offender relating to dangerous goods, and > > > > > (c) the circumstances surrounding the commission of the offence for which the offender is being sentenced. > > > (3) A person who contravenes an order under this section is guilty of an offence. > > > > Maximum penalty—500 penalty units or imprisonment for 2 years, or both, for an individual or 2,500 penalty units for a body corporate.
