48 Court may order forfeiture
S. 48(1) amended by No. 66/2008 s. 22.
(1) A court that convicts a person of an offence against this Act or before which a person is charged with an offence against this Act of which the person is found guilty or to which the person pleads guilty and in respect of which a conviction is not recorded may order that the whole or any part of any dangerous goods or containers seized in relation to the offence pursuant to this Act be forfeited to the Government of Victoria.

(2) All dangerous goods or containers forfeited under subsection (1) shall be destroyed or otherwise disposed of as the Authority directs having regard to the public safety.
