### 8 Previous declarations taken to be declarations for purposes of this Act > > (1)  An instrument in writing that is – > > > > > > (a) a declaration made under section 19(1) of the [Sentencing Act 1997](/view/html/inforce/2026-04-12/act-1997-059) as in force before the day on which this Part commences; and > > > > > > > (b) in force immediately before that day – > > > > is to be taken to be a declaration made under [section 7(1)](#GS7@Gs1@EN) . > > > (2)  An instrument in writing that is – > > > > > > (a) a declaration made under section 392(1) of the [Criminal Code](/view/html/inforce/2026-04-12/act-1924-069) , as in force immediately before the day on which the [Sentencing Act 1997](/view/html/inforce/2026-04-12/act-1997-059) commenced; and > > > > > > > (b) in force immediately before the day on which this Part commences – > > > > is to be taken to be a declaration made under [section 7(1)](#GS7@Gs1@EN) .
