Dampier to Bunbury Pipeline (Corridor) Regulations 1998

The regulations revolve around a compact set of concepts that attach to the rights, duties and dispute resolution processes under the Act. The definitions and cross-references in reg 2 are essential: each defined term is tied to the Act, so the meaning of access area, claim for compensation and holder is functional within the pipeline Act framework. The term section is defined to mean a section of the Act, establishing that the regulations operate as adjunct details to statutory sections they reference (reg 2).

Access area. The regulation defines access area as land in respect of which rights are conferred under s 34 of the Act (reg 2). The regulation therefore treats the access area as the spatial legal unit to which the specified duties and conditions apply.

Holder. The holder is defined as the holder of the rights conferred under s 34 that are subject to the condition (reg 2). In practice, this ties obligations and potential civil penalties to the legal person or entity whose rights under s 34 are limited by conditions specified in the Act and in these regulations.

Civil penalty conditions. The regulations specify two conditions that are to be treated as civil penalty conditions for the purposes of s 37(1)(a) of the Act (reg 4(1)). The first imposes a standard of reasonable steps to minimise damage to the access area and surrounding land and to avoid unnecessary interference with surrounding land. The second imposes a duty to avoid unreasonable interference with the assets and operations of other holders of rights under s 34 in respect of the access area or parts of it. These are phrased as duties on a holder, and therefore the concept of a civil penalty condition operates as a non-criminal regulatory stick enforceable via civil penalties specified in the regulations (reg 4(2)).

Civil penalty quantum and continuing contraventions. The regulations set a principal civil penalty of $500,000 per contravention, with a further civil penalty of $50,000 per day or part of a day where a contravention is of a continuing nature after the holder was given notice that the condition was being contravened (reg 4(2)). The continuing penalty is therefore event triggered by a notice; the instrument contains the triggering phrase, but it does not specify within the regulations who issues the notice or the procedural requirements for a notice.

Criminal offence for corridor use. Regulation 4A creates an offence for using land in the DBNGP corridor in a way that contravenes the restriction under s 41(2)(a), and an offence for use of land or exercise of statutory powers in a way that contravenes the restriction under s 41(2)(b). The penalty is a $10,000 fine for both individuals and bodies corporate (reg 4A(1)-(2)). The regulations thus make certain breaches of corridor restrictions criminal, as distinct from the civil penalties imposed on holders under reg 4.

Claims for compensation process. The regulations prescribe a six month filing window from the time the thing that gives rise to the entitlement occurs or arises, subject to ministerial extension in reasonable cases made in good faith (reg 5(1)-(2)). They also prescribe a specific contents list for a claim, including particulars of the land, the claimant’s interest, details of charges/leases/easements where relevant, particulars of each matter for which compensation is claimed, the claimant’s full name and address for service, and accompanying documents showing title or certified copies where originals are not available (reg 5(3)-(4)).

Fees. The regulations fix a modest prescribed fee of $60.00 for the matters referred to in s 31(8) and s 33(6) of the Act (reg 3). The regulations do not elaborate on what those Act subsections require, but they make explicit the monetary amount payable for the specified matters.

Amendments and linkage to the Act. The instrument is clearly a set of delegated regulations shaping procedural and penalty mechanics referenced by the primary Act. The 2005 amendment inserted reg 4A, thereby adding a criminal enforcement route specific to corridor use (compilation table and notation at reg 4A). The regulations thus function as a set of ancillary devices that modify incentives and compliance costs attached to the substantive statutory framework of the Dampier to Bunbury Pipeline Act 1997.

The regulations identify and affect a limited set of actors, through duties, fees, offences, and procedural requirements that map to rights and powers created by the Act.

Holders of rights conferred under s 34 of the Act. The principal group targeted by the regulations are holders of rights under s 34 who are subject to conditions. Those persons bear the obligations expressed in reg 4(1): to take reasonable steps to minimise damage to the access area and surrounding land and to avoid unnecessary interference and loss of enjoyment to surrounding land, and to avoid unreasonable interference with the assets and operations of other holders (reg 4(1)(a)-(b)). Holders are the named parties for civil penalty exposure, because reg 4(1) defines the duties as conditions on the holder and reg 4(2) specifies the civil penalties applied to contraventions.

Persons using land in the DBNGP corridor. Regulation 4A criminalises particular uses of land in the pipeline corridor that contravene specified restrictions in s 41(2)(a) or s 41(2)(b) of the Act. That captures private land users, developers, contractors, occupiers, and any person whose activity on or affecting the corridor falls within the description of use in reg 4A(1) and reg 4A(2)(a). The regulation also expressly includes persons exercising statutory powers under other written laws on or in respect of land in the corridor, where their action contravenes the restriction under s 41(2)(b) (reg 4A(2)(b)). Both natural persons and corporate bodies are subject to the $10,000 fine named in reg 4A(2).

Other holders of rights under s 34. The second civil penalty condition in reg 4(1)(b) specifically protects the assets and operations of other holders; accordingly, those other holders are indirectly affected because the regulations impose a duty on each holder not to interfere unreasonably with their operations. That creates an inter-holder regulatory relationship, where the conduct of one holder can attract civil penalties because it affects another holder.

Claimants seeking compensation under s 42. Persons who consider they have an entitlement to compensation under s 42 of the Act are affected by the procedural rules in reg 5. The regulations set a six month submission timeframe, provide for ministerial discretion to extend it, and require identification of land, particulars of title or interest, details of encumbrances such as charges, leases or easements, particulars of the claimed matters, and supporting documents or certified copies (reg 5(1)-(4)).

Applicants referenced in s 31(8) and s 33(6). The prescribed fee of $60 applies to persons making the applications or submissions referred to in those Act subsections. The regulations do not describe the substantive nature of those fees, but the financial implication is limited and specific: a $60 payment specified in reg 3(1)-(2).

The DBNGP Land Access Minister. The regulations expressly assign a decision role to the DBNGP Land Access Minister: the minister may extend the six month claims period on application and on satisfaction of reasonableness and good faith (reg 5(2)). The minister’s role is a discretion in relation to claims for compensation.

Surrounding landowners and occupiers. The duties in reg 4(1)(a) are phrased to protect not only the access area, but also the surrounding land and the enjoyment of surrounding land. Those neighbouring landowners or occupiers therefore have an interest that the regulations recognise by imposing duties and potential civil penalties on holders who damage or interfere with (reg 4(1)(a)).

In practice, the regulations alter the cost and risk allocation associated with rights under the Act: holders face potentially large civil penalties for specified conduct; users of the corridor face criminal fines for prohibited uses under s 41(2) as given effect by reg 4A; claimants must act within defined time and documentary constraints to preserve compensation claims; and applicants subject to fees referenced in the Act will pay the prescribed $60 amounts set out in reg 3.

The regulations specify discrete duties for particular actors and set the documentary and fee requirements for processes linked to the Act. The duties are primarily aimed at holders of rights under s 34 and users of land in the DBNGP corridor. Rights are implicit in procedural access to compensation and ministerial discretion.

Duties on holders of s 34 rights. Regulation 4(1) prescribes two civil-penalty conditions that operate as duties on holders. First, the holder must take reasonable steps to minimise damage to the access area and to the surrounding land and must avoid any unnecessary interference with, and loss of enjoyment of, the surrounding land (reg 4(1)(a)). The standard imposed is objective, framed as “reasonable steps”. Second, the holder must not unreasonably interfere with the assets and operations of any other holder of rights conferred under s 34 in respect of the access area or any part of that area (reg 4(1)(b)). The second duty frames an inter-party non-interference obligation between holders.

Consequences for breach of those duties are civil rather than criminal: reg 4(2) prescribes a $500,000 civil penalty for a contravention of either condition, and a further civil penalty of $50,000 for each day or part of a day during which the contravention has continued after the holder was given notice that the condition was being contravened (reg 4(2)). The triggering of the daily penalty requires notice to the holder; the regulations state this notice condition but do not specify the identity of the person or authority that must give notice, nor do they prescribe the form or content of the notice within the regulations themselves.

Duty not to contravene corridor restrictions. Regulation 4A creates criminal liability for persons who use land in the DBNGP corridor in a way that contravenes the restriction under s 41(2)(a), and for persons who use land in the corridor or exercise statutory powers on or in respect of land in the corridor in a way that contravenes the restriction under s 41(2)(b) (reg 4A(1)-(2)). The regulations do not restate what the restrictions under s 41(2) are; they instead link criminal liability to any contravention of those statutory restrictions. The penalty is a fine of $10,000 for both individuals and corporate bodies (reg 4A(2)). That means breach of corridor restrictions can be prosecuted as an offence under the regulations, attracting a monetary fine rather than the civil-penalty regime applicable to holders under reg 4.

Claims and claimant obligations. Regulation 5 imposes procedural obligations on any person making a claim for compensation under s 42 of the Act. A claim must be submitted within six months after the time when the thing giving rise to the entitlement occurred or arose, unless the DBNGP Land Access Minister extends the period under reg 5(2) (reg 5(1)-(2)). The claimant must include specific particulars: identification of the land; the nature and particulars of the claimant’s right, title or interest; particulars of any charge, lease or easement; particulars of each matter or thing in respect of which compensation is claimed including the nature and extent; and the claimant’s full name and address for service (reg 5(3)(a)-(e)). The claim must be accompanied by all documents establishing the claimant’s title that are in the claimant’s custody, possession or power, and certified copies of any such documents not in the claimant’s custody (reg 5(4)(a)-(b)). These document requirements turn title evidence into a precondition to a valid claim.

Fees and payments. The regulations prescribe a fee of $60 for the purposes of s 31(8) and a fee of $60 for the purposes of s 33(6) (reg 3(1)-(2)). The regulations do not provide exemptions or differential treatment in those two items, rather they fix a specific, modest monetary amount.

Ministerial discretion. The DBNGP Land Access Minister has an express discretion to extend the six month period for submitting a claim if satisfied the application is reasonable and made in good faith (reg 5(2)). The extension power is discretionary, conditional on reasonableness and good faith, and requires an application from the claimant. The regulations do not otherwise constrain the minister or provide procedural steps or timeframes for the ministerial decision.

Rights implicit in the regulations. The primary procedural rights created by the regulations are the right to apply for an extension of the claims period (reg 5(2)) and the right to submit a claim for compensation with prescribed supporting material (reg 5(3)-(4)). Holders retain whatever substantive rights are conferred by the Act; the regulations instead focus on obligations tied to the exercise of those rights and the penalties for particular contraventions.

In summary, the regulations convert certain behavioural expectations into enforceable duties on holders and corridor users, prescribe a strict documentary and timing regimen for compensation claims, set modest application fees, and allocate a discrete discretionary role to the DBNGP Land Access Minister in extending claims periods.

The regulations create two distinct enforcement streams: civil penalties for contraventions of specified conditions by holders, and criminal fines for certain corridor uses or exercises of statutory powers. The instrument states penalty amounts explicitly, and it ties enhancement of civil penalties to continuing contraventions post-notice.

Civil penalties for holders. Regulation 4(2) prescribes a civil penalty regime for the two civil penalty conditions identified in reg 4(1). The principal civil penalty is $500,000 for a contravention of either condition (reg 4(2)). Where a contravention is of a continuing nature, an additional civil penalty of $50,000 applies for each day or part of a day during which the contravention continues after the holder was given notice that the condition was being contravened (reg 4(2)). The regulations therefore make two enforcement features explicit:

• High single-event exposure. A single contravention attracts a $500,000 penalty. That quantum is set in the regulations and is recoverable as a civil penalty under the Act mechanism referenced in s 37(1)(a).
• Continuing daily exposure after notice. The daily penalty is attributable only after notice has been given that the condition is being contravened, which creates an administrative trigger for enhanced liability. The regulation does not identify who gives the notice, how notice is to be given, or any procedural safeguards associated with the notice within the text of the regulations.

Regulatory enforcement mechanism. The civil penalty amounts are stated in the regulations, but the regulations do not themselves specify the institution that will determine contraventions, conduct hearings, issue notices, or adjudicate disputes. The civil penalty reference points to s 37(1)(a) of the Act, which the regulations rely on; the Act is therefore the locus of the wider enforcement process not detailed in the instrument. Within the regulation the critical enforcement inputs are the definitions of the duty duties, the penalty quantum, and the notice trigger for the daily penalty.

Criminal fines for corridor contraventions. Regulation 4A creates offences tied to contraventions of the statutory restrictions under s 41(2)(a) and s 41(2)(b) of the Act (reg 4A(1)-(2)). The penalty is a fine of $10,000 for both individuals and bodies corporate (reg 4A(2)). This creates a criminal enforcement route distinct from the civil penalties that apply to holders under reg 4. The regulations do not state procedural details for prosecution , for example, who brings the prosecution, standard of proof, or whether other remedies can be sought , all of that remains within the established processes for criminal enforcement under Western Australian law and the underlying Act.

Relative scale of penalties. The instrument sets the civil-penalty maximum at a level much larger than the criminal fine for corridor contraventions: $500,000 per contravention and $50,000 per day for continuing contraventions, versus a $10,000 fine for individuals and corporations offending under reg 4A. The regulation therefore creates a large monetary exposure for holders who fail the civil-penalty conditions, while the offence targeting use of the corridor carries a comparatively modest criminal fine. That scale difference is explicit in the instrument.

Notice as a trigger. The daily civil penalty only accrues after the holder was given notice that the condition was being contravened (reg 4(2)). This introduces a procedural element that the regulations take as given, but do not elaborate. The existence of this notice trigger suggests that enforcement authorities must give a recognisable notice before daily penalties begin to run.

No express alternative sanctions. The regulations set monetary penalties but do not provide for injunctive relief, operational suspensions, or licence revocation within their text. Any non-monetary remedies or processes would be within the Act or within general law, but they are not specified in these regulations themselves.

In short, the instrument establishes a two-tier enforcement structure with precise monetary outcomes, leaves procedural enforcement detail to the Act and to usual administrative or prosecutorial processes, and creates a material escalation risk for continuing civil contraventions once notice has been given.

The regulations are entirely framed as ancillary to the Dampier to Bunbury Pipeline Act 1997. Their operational validity and legal effect depend on the Act, because the instrument repeatedly references specific sections of the Act and fills in particular procedural and monetary details that the Act leaves to regulation. The regulations therefore should be read and applied in conjunction with the relevant Act sections they reference.

Reference points to the Act. The regulations explicitly tie several items to specific sections of the Act:

• reg 3 prescribes fees for the purposes of s 31(8) and s 33(6) of the Act (reg 3(1)-(2)).
• reg 4 identifies civil penalty conditions for the purposes of s 37(1)(a) of the Act (reg 4(1)), and sets the associated civil penalties consistent with the Act’s civil-penalty framework (reg 4(2)).
• reg 4(1) and reg 4A refer to rights conferred under s 34 and to the restrictions under s 41(2)(a) and s 41(2)(b) respectively.
• reg 5 regulates the procedure for a claim for compensation under s 42 of the Act (reg 5(1)-(4)).

Because the regulations repeatedly state “for the purposes of” specific sections of the Act, they are an interpretive and operational extension of those sections. The regulations do not restate the substantive content of s 31, s 33, s 34, s 37, s 41 or s 42, rather they attach fees, conditions, penalties, offences and procedural requirements relevant to those provisions.

Interaction with other written laws. Regulation 4A(2)(b) expressly reaches persons who exercise any statutory power under any other written law on or in respect of land in the DBNGP corridor where that exercise contravenes the restriction under s 41(2)(b) of the Act. That means the regulation can capture activity undertaken under other statutes where those activities impact the corridor and contravene the Act’s restriction. The regulation does not resolve conflicts between laws; it criminalises the behaviour where inconsistent with s 41(2)(b), subject to the usual rules of statutory interpretation and operational enforcement.

Ministerial discretion and other statutory powers. The DBNGP Land Access Minister is given a specific discretion to extend a claims period in reg 5(2). That creates a regulatory interface where ministerial discretion under the regulations can affect time-limited entitlements under the Act. The regulations do not otherwise set out dispute resolution mechanisms, means of assessing compensation quantum, or appeal rights , these remain within the Act or other applicable procedural law.

Delegated instrument nature. The regulations are a delegated instrument, providing detail left to regulation-making power in the Act. The compilation table included in the instrument records amendments and reprints, and the historical note identifies the 2005 amendment that inserted reg 4A. The regulations thus operate as subordinate law that modifies the implementation of the Act within the bounds of the Act’s regulation-making power.

Practical interaction points:

• Fee compliance: persons making applications or submissions under s 31(8) or s 33(6) must pay the $60 prescribed fee in the regulations (reg 3), not any other amount.
• Enforcement coordination: where activities under other written laws interact with the corridor, prosecutions or enforcement for contraventions of s 41(2) may be triggered via reg 4A, and agencies administering other laws need to be aware that executing statutory powers in the corridor could attract criminal liability under these regulations.
• Evidence and procedural standards: the regulations prescribe documentary standards for compensation claims (reg 5(3)-(4)); assessing agencies or tribunals will rely on those prescribed materials.

In sum, the regulations supply operational detail to the Act and create points of interface with other statutes by criminalising certain exercises of statutory power that contravene the Act’s corridor restrictions, while leaving adjudicative and procedural enforcement particulars to the Act and general administrative law frameworks.

The instrument includes a short but specific amendment history recorded in its compilation table and in the marginal notes. The regulations were originally made and gazetted on 10 March 1998, and commenced on that date (Compilation table entry for the Dampier to Bunbury Pipeline (Corridor) Regulations 1998). The instrument was reprinted as Reprint 1 as at 7 May 2004, indicating a consolidation point up to that date.

A recorded amendment occurred in 2005. The Dampier to Bunbury Pipeline (Corridor) Amendment Regulations 2005 were gazetted on 13 December 2005 and commenced the same day, as shown in the compilation table (Dampier to Bunbury Pipeline (Corridor) Amendment Regulations 2005, Gazette 13 Dec 2005 p. 5977-8). The amendment inserted regulation 4A, which creates the criminal offences and specified fines relating to corridor use and to the exercise of statutory powers that contravene s 41(2)(b) (text note: [Regulation 4A inserted: Gazette 13 Dec 2005 p. 5977-8.]).

The defined terms list appended in the instrument is part of the compilation materials, specifying where the defined terms appear in the regulations (Defined terms list identifying access area, claim for compensation, holder, section at reg 2). The presence of the reprint and amendment notes indicates the typical lifecycle of subordinate legislation: initial making, subsequent reprint for consolidation at a date, and targeted amendment thereafter.

What the amendment history shows, concretely, is that the regulations were stable in their initial form for several years and that the 2005 amendment added a specific criminal enforcement element. The amendment’s timing and content are stated in the instrument; the regulations themselves do not provide legislative commentary about the policy reason for the insertion, nor do they catalogue further changes.

No further amendments or reprints are recorded within the instrument provided. The compilation table is self-contained in the text and therefore represents the edition history up to and including the 2005 amendment. The regulations, as compiled, therefore consist of the 1998 original instrument and the 2005 amendment inserting reg 4A, with a reprint recorded as at 7 May 2004 that consolidates the instrument to that date.

For practitioners, the amendment history is relevant in two practical ways. First, reg 4A did not exist prior to 2005, so conduct occurring before that date could not have been criminalised under the regulation’s present terms. Second, the insertion of a criminal offence in 2005 reflects a regulatory expansion from civil enforcement of holder duties to criminal enforcement of certain corridor uses and statutory-power exercises, and that expansion is explicit in the amendments recorded in the compilation table.

The text of the regulations itself does not contain any judicial or administrative decisions, citations of cases, or summaries of litigation. The instrument is a compilation of the regulations and the amendment that inserted reg 4A in 2005; it does not include any reported decisions or a litigation annex. Therefore the regulatory text, as presented, provides no internal record of adjudication, enforcement actions, or case law that have interpreted or applied these provisions.

From a practitioner perspective, the absence of litigation history within the instrument itself means that any legal questions about interpretation, scope, reasonableness standards in reg 4(1)(a), the meaning of “unreasonably interfere” in reg 4(1)(b), the procedural effect of the notice trigger in reg 4(2), or the application of reg 4A to statutory power exercises under other written laws will need to be researched outside the instrument. The regulations state duties and penalties, but they do not provide guidance about evidentiary thresholds, the meaning of “reasonable steps” or “unreasonable interference”, or how courts and tribunals have applied the notice requirement that triggers daily civil penalties.

Practical implications of the lack of recorded litigation in the instrument:

• Interpretive uncertainty. Key terms are stated but not defined at a high level of precision. For example, “reasonable steps” and “unnecessary interference” are open-textured standards. Without recorded judicial interpretation in the instrument, parties will have to rely on general statutory interpretation principles and any external case law that incidentally addresses similar language in other contexts.
• Enforcement practice unknown. The instrument sets monetary penalties and a notice-triggered daily penalty, but it does not document how enforcement authorities have used notices, what evidentiary threshold is applied for notice, or whether agencies have pursued civil penalty orders or prosecutions under reg 4A.
• Litigation risk assessment. Where potential exposure is large, as with the $500,000 principal civil penalty and $50,000 per-day continuing penalty, the lack of cases recorded in the instrument means risk assessment must be conservative until external jurisprudence clarifies enforcement patterns, defences, and mitigation obligations.
• Reliance on the Act and external authorities. Practitioners must consult the Dampier to Bunbury Pipeline Act 1997 for complementary procedural and adjudicative mechanisms, and must search tribunal and court databases, prosecutorial records, and administrative decisions outside the instrument for any reported applications of these regulations.

Because the instrument itself contains no litigation history, any authoritative statements about how courts or tribunals interpret or enforce these regulations cannot be drawn from the text of the regulations. The regulations state the legal framework and monetary parameters; the operational shape of enforcement, and the judicial gloss on phrases such as “reasonable steps” or “unreasonably interfere”, will be provided only by external case law or administrative practice, neither of which is included in the instrument text.

The regulations are short but contain several features that require attention because they create asymmetries, tight procedural windows, and potential evidentiary burdens. The following are practical pitfalls that arise from the text.

Definition anchoring. The definitions in reg 2 are minimal and refer back to the Act. For example, access area, holder and claim for compensation are defined only by reference to s 34 and s 42 of the Act. This means that understanding who is a “holder”, what land constitutes an “access area”, and which matters trigger a “claim for compensation” requires reading the Act. Practitioners who consider only the regulations without the Act risk misidentifying the relevant parties or land.

Two distinct enforcement regimes. The instrument creates civil-penalty conditions for holders under reg 4 and a separate criminal offence under reg 4A for corridor use that contravenes s 41(2). The sanctions differ in scale and character: a single civil penalty of $500,000 and daily accrual of $50,000 after notice for holders, versus a $10,000 fine for corridor users and statutory-power exercisers (reg 4(2); reg 4A(2)). A gotcha is failing to map the correct enforcement stream to the conduct: similar factual conduct might give rise to either civil or criminal exposure depending on the actor and which statutory restriction is contravened.

Notice-based daily penalties. The $50,000 per day continuing civil penalty only accrues after the holder “was given notice that the condition was being contravened” (reg 4(2)). The regulations do not define who gives notice, how notice must be served, or whether the notice must identify remedial steps. Parties may therefore be exposed to significant daily penalties if they receive a notice and do not act promptly. Conversely, absence of a formal notice may prevent daily accrual even where contraventions have occurred. This creates operational risk tied to the procedural step of notice.

Small prescribed fees may mislead. The $60 fee for the purposes of s 31(8) and s 33(6) is modest (reg 3). A practitioner could under-estimate the broader costs of compliance, litigation risk, or possible civil penalties because the upfront fee appears small. The fee does not reflect potential liability under reg 4 or reg 4A.

Strict claims timing and documentary burden. A claim for compensation must be submitted within six months from the event or occurrence that gives rise to the entitlement, unless the DBNGP Land Access Minister extends the period on an application meeting reasonableness and good-faith thresholds (reg 5(1)-(2)). The claim must include detailed particulars and be accompanied by all documents establishing title that are in the claimant’s custody, possession or power, with certified copies required for anything not held by the claimant (reg 5(3)-(4)). Practitioners should note that the six month window is short, and that obtaining certified copies of documents not in the claimant’s possession could introduce delay. Failure to observe the timeframe or the documentary standard risks dismissal of the claim or loss of entitlement.

Inter-holder non-interference standard is open-textured. The prohibition on unreasonably interfering with other holders’ assets and operations (reg 4(1)(b)) is not quantified. In a multi-holder environment, there may be conflicting legitimate uses of access areas; parties need to anticipate disputes about what conduct is unreasonable and be prepared to document reasonable steps taken to mitigate interference.

Overlap with other statutory powers. Regulation 4A(2)(b) extends criminal liability to people exercising statutory powers under any other written law in respect of land in the corridor where their exercise contravenes s 41(2)(b). This can catch public authorities or utilities who think they are exercising lawful powers under other statutes; because the regulation criminalises such exercises where they contravene the Act’s restriction, coordination between agencies and awareness of the corridor restriction is critical.

Absence of procedural detail in the regulations. Several important procedural questions are left undetailed: who issues notices that trigger daily civil penalties; the method and grounds on which the DBNGP Land Access Minister will assess reasonableness and good faith for an extension; enforcement processes, timeframes, or appeal rights for civil penalties and prosecutions under reg 4A. These procedural gaps create practical uncertainty and increase transaction costs for parties seeking to comply or to challenge enforcement actions.

Equality of criminal fines for individuals and corporations. The criminal fine under reg 4A is the same for individuals and bodies corporate, being $10,000 for each (reg 4A(2)). That means corporate actors do not face a higher fine than individuals at the level set by the regulation. In some cases the corporate fine can be a modest sanction relative to the scale of the operator; in others the parity may produce inequitable incentives. The regulation does not differentiate.

In short, the practical “gotchas” are short timelines, potentially large asymmetric penalties tied to notice, reliance on definitions contained in the Act, interaction with other statutory powers, and procedural lacunae that leave significant enforcement mechanics to the Act or to other administrative processes.

Compliance focuses on three operational areas: obligations of holders of s 34 rights, managing risk when using land in the corridor or exercising statutory powers, and meeting the claims for compensation requirements. The regulations make explicit the precise documentary, temporal and monetary steps to meet.

For holders of rights under s 34 (reg 4):

• Risk assessment and preventative steps. Holders should document and implement measures that would constitute “reasonable steps” to minimise damage to the access area and surrounding land, and to avoid unnecessary interference with surrounding land (reg 4(1)(a)). Prepare written plans, maintenance logs, environmental monitoring data and stakeholder communications to evidence reasonable steps.
• Inter-holder coordination. Because reg 4(1)(b) requires holders to avoid unreasonable interference with the assets and operations of other holders, arrange operational coordination with neighbouring holders. Maintain written agreements or memoranda of understanding about timing, access, and noise or traffic impacts, and document efforts to resolve disputes.
• Notice readiness. Given that continuing civil penalties accrue only after notice has been given that the condition is being contravened (reg 4(2)), design processes to react quickly to any notice. Track the receipt date of any notice, promptly assess the alleged contravention, undertake remedial action, and preserve evidence of remediation and communications. Retain legal counsel to advise on whether a notice was properly issued and on challenge options.
• Insurance and financial exposure. The principal civil penalty ($500,000) and the daily continuing penalty ($50,000 per day after notice) present material exposure. Review insurance arrangements and budget for potential civil liabilities, including scenarios where penalties accrue over several days.

For users of land in the DBNGP corridor and statutory power exercisers (reg 4A):

• Confirm corridor restrictions. Before using land in the corridor or exercising a statutory power on or in respect of land in the corridor, check whether the proposed activity could contravene the restriction under s 41(2)(a) or s 41(2)(b). The regulations do not restate the restrictions; compliance requires consulting the Act’s s 41(2).
• Inter-agency coordination. If a statutory power under another written law might be exercised in or near the corridor, coordinate with the DBNGP Land Access Minister’s office or relevant pipeline authority to confirm whether the exercise would contravene s 41(2)(b). This is especially important for public authorities or utilities that routinely exercise statutory powers.
• Legal clearance prior to action. Obtain written legal advice or a clearance confirming that the proposed use or exercise of statutory power will not contravene the corridor restrictions, to reduce the risk of a $10,000 fine under reg 4A.

For claimants seeking compensation under s 42 (reg 5):

• Observe timing. Submit a claim within six months of the time the thing or matter giving rise to compensation occurred or arose (reg 5(1)). If a six month window is impractical, prepare an early application to the DBNGP Land Access Minister for an extension under reg 5(2), with evidence supporting reasonableness and good faith.
• Prepare the prescribed particulars. Ensure the claim includes: identification of the land; nature and particulars of the claimant’s right, title or interest; particulars of any charge, lease or easement; particulars of each matter claimed and the nature and extent of the claim; and the claimant’s full name and address for service (reg 5(3)(a)-(e)). Use precise legal descriptions for land and attach clear explanations of the entitlement relied upon.
• Assemble documentary proof. Accompany the claim with all documents that establish title which are in the claimant’s custody, possession or power, and prepare certified copies for any documents not held by the claimant (reg 5(4)(a)-(b)). Start early on obtaining certified copies from registries or third parties to avoid late filing.
• Document good faith for extension. If seeking an extension, compile contemporaneous evidence of why the claim could not reasonably be submitted within six months and why the application is made in good faith, including communications, delays in obtaining documents, or complexity of issues.

For fee payments (reg 3):

• Pay prescribed fees. Where an application falls under s 31(8) or s 33(6) of the Act, ensure payment of the $60 prescribed fee per reg 3(1)-(2). Confirm payment methods and receipting procedures with the agency handling the application to guarantee the fee is properly attributed.

General compliance practices:

• Read the Act in tandem. Because the regulations repeatedly cross-reference the Act, compliance requires reading the relevant Act sections cited in the regulations to understand the full substantive duties and restrictions.
• Maintain audit trails. Keep records of site inspections, communications with neighbouring holders, notices received, mitigation measures taken, and financial decisions, as these will be relevant for any enforcement or claims processes.
• Engage early with the DBNGP Land Access Minister’s office. For potential claims for compensation or questions about corridor restrictions, early engagement can clarify procedural expectations and may reduce the risk of missed deadlines or enforcement issues.
• Legal review of notices. Where a notice is received alleging contravention of a civil-penalty condition, obtain prompt legal advice to determine whether the notice is valid, what remedial steps are reasonable, and whether to seek to contest the notice.

Following the letter of the regulations requires careful procedural management: timely submissions, thorough documentary evidence, and proactive operational coordination between holders and users of the corridor. The regulations provide clear monetary penalties and a short claims timeline; compliance is therefore primarily a matter of timely documentary and operational rigour keyed to the specific provisions recited in the instrument.
