72  Delegation by DAA—before second DAA phase‑down time  (1) The DAA may, by resolution, delegate to:  (a) a DAA member; or  (b) a senior employee of the Corporation; all or any of the DAA’s functions and powers.  (2) A delegation of a function or power under this clause:  (a) may be revoked by resolution of the DAA (whether or not constituted by the persons constituting the DAA at the time when the function or power was delegated); and  (b) continues in force notwithstanding a change in the membership of the DAA.  (3) Section 34A of the Acts Interpretation Act 1901 applies in relation to a delegation under this clause as if the DAA were a person.  (4) A certificate signed by the DAA Chair stating any matter with respect to a delegation of a function or power under this clause is prima facie evidence of that matter.  (5) A document purporting to be a certificate mentioned in subclause (4) is, unless the contrary is established, taken to be such a certificate and to have been duly given.  (6) A delegate under this clause is, in the exercise of a function or power delegated under this clause, subject to any directions given by the DAA.  (7) A reference in this clause to a senior employee of the Corporation is a reference to a person who:  (a) is an employee of the Corporation; and  (b) holds or performs the duties of a position of General Manager.  (8) This clause does not apply after the second DAA phase‑down time.
