Customs (United Arab Emirates Rules of Origin) Regulations 2025

The regulations build on a small set of recurring technical concepts that determine whether goods qualify as Australian originating goods for preferential treatment with the UAE. These concepts appear repeatedly and structure compliance choices and documentation needs.

Qualifying value content (QVC). QVC is the share of a good’s value attributable to originating elements. The instrument provides two methods to compute QVC: indirect (build‑down) and direct (build‑up) (sections 6-7). Each method may be calculated either by reference to customs value (the statutory customs valuation method in Division 2 of Part VIII of the Act) or by reference to ex‑works price (definitions in subsection 153ZSB(1) of the Act), producing either a numerator/denominator formula (sections 6(2)-(3), 7(2)-(3)). QVC must be expressed as a percentage (sections 6(4), 7(4)).

Indirect (build‑down) method. This method calculates the percentage of the value that is not attributable to non‑originating materials, i.e., (customs value minus value of non‑originating materials) / customs value times 100 (or the same with ex‑works price) (sections 6(2)-(3)). It therefore relies on accurate valuation of non‑originating inputs under Part 4.

Direct (build‑up) method. This method aggregates the value of originating materials plus direct labour, direct overheads, profit and other costs, divided by customs value or ex‑works price (sections 7(2)-(3)). The terms direct labour costs and direct overhead costs are given plain descriptions in the regulation (for example, direct labour includes wages, remuneration and other employee benefits) whereas profit and other costs are to be interpreted as in Article 3.4 of Chapter 3 of the Agreement (section 7(2)-(3)).

Valuation of materials. Section 8 prescribes a three‑part rule for the value of materials used in production: materials imported into the UAE by the producer (use price paid at importation or, if not determinable, GATT Article VII valuation); materials acquired in the UAE (importer choice among three valuation options under s8(2)(b)); and materials produced by the producer (sum of all costs plus a profit equivalent). Sections 8(3)-(5) then specify inclusion or deduction of transport costs, duties, taxes and brokerage fees and treatment of waste and spoilage depending on whether the materials are originating or non‑originating.

Tariff change requirement. Section 5 settings a rule about change in tariff classification. A non‑originating material that ordinarily would not meet a specified tariff change is taken to satisfy it where it was produced entirely in the UAE, or in the UAE and Australia, from other non‑originating materials and each of those other non‑originating materials satisfies the tariff change (including by recursive applications of s5). This is a production‑chain provision affecting multi‑stage processing.

Accessories, spare parts and packaging. Sections 9 and 10 require taking account of accessories, spare parts, tools, information materials, packaging and containers in QVC calculations where corresponding Act criteria are met (for example, paragraphs 153ZSF(1)(a)-(c) and 153ZSH(1)(a)-(b) of the Act). Those items are to be treated as originating or non‑originating materials for purposes of the applicable QVC calculation method.

Record keeping. Part 5 prescribes different record sets for exporters who are not producers (section 11) and producers (section 12), including proof of purchase, HS classification evidence, production records, values, and a copy of the certificate of origin. Records must be retained for at least five years after the certificate is issued or signed, may be kept overseas, and must be in a form that permits determination of whether goods are Australian originating goods; if not in English then readily translatable and, if electronic, readily convertible to a hard copy in English (sections 11(2)-(3) and 12(2)-(3)).

Definition dependencies. Many operational terms are not defined inside the regulations but by reference to subsection 153ZSB(1) of the Act or to the Agreement (e.g. ex‑works price, Harmonized System, originating materials, production, territory of the UAE). The practical application therefore depends on those external definitions and any interpretive apparatus contained in the Act or the Agreement.

The instrument allocates obligations and choices across several classes of actors in cross‑border supply chains between Australia and the UAE: producers, exporters (including those who are not producers), importers of materials in the UAE, and Australian customs authorities insofar as enforcement flows from the Customs Act.

Producers of goods intended for export to the UAE. Producers carry the most comprehensive document and valuation responsibilities. Section 12 requires producers to keep purchase records for goods and materials used in production, evidence of HS classification for materials, evidence of material and goods values, production records, and copies of the certificate of origin. This applies whether the producer is also the exporter or not. Producers who produce accessories, packaging or containers must keep separate records of purchases and production for those inputs (s12(1)(h)-(k)). Producers must retain records for five years from the date the certificate of origin is signed (s12(2)) and must ensure records are in a form enabling determination of whether goods are Australian originating goods, translatable into English and convertible to hard copy (s12(3)).

Exporters who are not producers. Section 11 prescribes a specific record set for exporters who are not the producer. These exporters must keep records of their purchases of the goods and purchases made by the person to whom the goods are exported, evidence that payment has been made, HS classification evidence, records and evidence relating to accessories/packaging (if purchased or produced by the exporter), and a copy of the certificate of origin (s11(1)). The same five‑year retention rule applies from the date the certificate is issued (s11(2)). Exporters may keep records overseas but must ensure form and translation requirements are met (s11(3)).

Importers of materials in the UAE. The regulations give the importer of goods (in relation to materials acquired in the UAE) a choice between valuation options (s8(2)(b)). The importer’s chosen valuation option will determine the value attributed to materials acquired in the UAE when working out QVC, thus affecting the producer’s ability to meet the origin threshold. That choice creates a practical locus of decision and record responsibility at the importer level in the UAE.

Australian customs authorities and compliance officers. While the instrument does not itself create enforcement sanctions, it is made under the Customs Act 1901 (s3) and repeatedly references specific Act provisions (for example, subsection 126ASB(1) for record keeping). Enforcement of record‑keeping, origin claims and valuation will be exercised under the powers and sanctions that reside in the Act. The regulations place operational evidentiary expectations on the officials who will evaluate certificates of origin and supporting records (for example, expecting HS classification evidence and conversion capability into English).

Suppliers of inputs across borders. Foreign or third‑country suppliers of non‑originating materials are indirectly affected because their pricing, invoice details, shipping terms and document trail feed into the valuation options available to producers (s8). The regulations specify inclusion of costs incurred in international shipment for materials imported into the UAE (s8(3)), and permit deductions of freight and duties for non‑originating materials (s8(5)), creating traceability requirements for suppliers.

Third‑party service providers. Accountants, logistics providers, consultants and customs brokers will be engaged to assemble the records required under Parts 3-5, to calculate QVC under the alternative formulas, and to advise on the correct inclusion/deduction of transport, duties and waste costs as set out in section 8.

Who bears the compliance and operational costs? The regulations allocate most immediate compliance costs to producers and exporters through record keeping and valuation. Importers in the UAE have decision rights over certain valuation choices that can alter producers’ QVC. Suppliers and service providers will bear transactional compliance costs as part of their commercial arrangements. Australian customs authorities bear administrative costs of verifying claims using the documentation the regulations mandate.

The instrument establishes specific duties (obligations) and rights (choices) that determine how origin claims are substantiated and how QVC is calculated.

Duties: valuation and calculation duties. Producers and importers must apply the valuation rules in Part 4 when determining values for originating and non‑originating materials, including international shipment costs for imported materials (s8(3)), and the inclusion/deduction rules for freight, insurance, duties, taxes and waste (s8(4)-(5)). Producers must calculate QVC using either the indirect or direct method and may use either customs value or ex‑works price as the basis (s6(1), s7(1)). QVC must be expressed as a percentage (s6(4), s7(4)).

Duties: record keeping. Exporters who are not producers must keep the enumerated purchase, HS classification, payment evidence, accessory/packaging records and a copy of the certificate of origin for at least five years from issue (s11(1)-(2)). Producers must keep a broader set of records, including purchase, production, classification and value evidence and the certificate for at least five years from signature (s12(1)-(2)). Both must ensure records are maintained in a form that enables assessment of origin, are translatable into English if necessary, and if electronic are convertible to hard copy in English (s11(3), s12(3)).

Rights: choice of valuation option for materials acquired in the UAE. Section 8(2)(b) grants the importer of goods a specific right to choose one of three valuation methods for materials acquired in the UAE: the price paid by the producer, the value determined as if the materials were imported under s8(2)(a), or the earliest ascertainable domestic price. That decision affects QVC outcomes.

Rights: alternative bases for QVC calculation. Producers and exporters have the right to compute QVC using either customs value or ex‑works price, per sections 6 and 7. The availability of two alternative bases and two methods (build‑down or build‑up) gives firms tactical flexibility to choose the calculation method that best demonstrates compliance with origin thresholds, subject to documentary support.

Duties: treatment of accessories and packaging where Act conditions apply. If the Act’s paragraphs 153ZSF(1)(a)-(c) are satisfied (for accessories/parts/tools/information materials) or 153ZSH(1)(a)-(b) are satisfied (for packaging), these items must be taken into account in QVC calculations; and they must be treated as originating or non‑originating materials consistent with their status (ss9-10). Firms therefore must track and value these items where the Act’s conditions trigger inclusion.

Duties: avoiding double accounting and ensuring proper cost allocation. Sections 8(4)-(5) allow inclusion or deduction of certain costs to avoid double counting (for example, freight, insurance and duties), but they require careful accounting so that the same cost is not included both in the value of materials and in overhead or other cost elements.

Who decides: importer, producer and exporter choices are the key decision points. Importers choose the valuation option for materials acquired domestically in the UAE (s8(2)(b)). Producers and exporters choose which QVC method and basis to apply (s6(1), s7(1)), and whether to include certain costs to the extent they have not already been taken into account (s8(4)). These choices require contemporaneous records and will be subject to verification under the Customs Act.

Procedural obligation: certificate of origin integration. Both exporters and producers must retain a copy of the certificate of origin (ss11(1)(i), 12(1)(l)), making it the anchor for the five‑year retention period and signalling that origin claims must be supported by documentary evidence in the event of verification.

The regulations themselves do not create express monetary penalties or enforcement sanctions within their text. Instead, they operate by imposing technical duties and documentary standards and rely on the enforcement, inspection and sanctioning powers that are in the Customs Act 1901 and other statutory instruments cited by the Act. The provisions in these regulations point to Act sections that provide the authority to require records, verify origin claims and take remedial steps.

Reference points. Record keeping obligations are imposed “for the purposes of subsection 126ASB(1) of the Act” (sections 11(1) and 12(1)). That cross‑reference means enforcement of those record keeping duties will proceed under the framework at subsection 126ASB(1) of the Act and any associated powers and penalties that the Act provides. Similarly, sections 6 and 7 describe methods for working out qualifying value content “for the purposes of paragraph 153ZSE(5)(b) of the Act,” and section 5 operates “for the purposes of subsection 153ZSE(3) of the Act.” Enforcement action for incorrect origin claims or false certificates of origin therefore rests with the Act’s compliance architecture referenced in those subsections.

Documentary verification and audits. The record retention rules (ss11-12) create a statutory expectation that exporters and producers will produce documentary evidence to enable a determination of whether goods are Australian originating goods. That expectation translates into a practical enforcement pathway: customs officials can request records and verify HS classification, valuation calculations and supporting invoices, production records and certificates of origin. The instrument specifies required evidentiary items (HS classification evidence, proof of payment, value evidence and production records) that will be examined during audits or investigations.

Consequences implied by the Act references. Because the regulations sit under the Customs Act, failure to comply with obligations prescribed here (such as record keeping or correct valuation) will be addressed under the Act’s enforcement provisions. The instrument does not list particular penalties nor procedural steps for enforcement; instead it points users and enforcement officers to the Act where those measures are found. Readers must therefore consult the Customs Act’s enforcement and penalty provisions that correspond to the referenced subsections (for example, subsection 126ASB(1) and subsections in Part VIII) to understand sanctions, forfeiture, suspension of preferential treatment or administrative penalties.

Practical compliance and contestation risk. Because the regulations permit alternative calculation approaches and importer choices (for example s8(2)(b), ss6-7), enforcement actions are likely to focus on the documentary basis for a chosen approach and whether the records substantiate the numerical QVC outcome. Discrepancies, inconsistent statements across chain participants, or missing records that the regulations require will materially increase the risk of adverse administrative findings under the Act.

Limited regulatory discretion in the text. The regulations themselves give limited enforcement discretion to officials; they do not set out administrative review routes, penalty scales, or appeal procedures. Those procedural details will be located in the Act and its existing enforcement provisions. The instrument’s primary enforcement effect is to create binding documentary and calculation standards that trigger enforcement under the existing Act mechanisms.

This instrument is expressly made under the Customs Act 1901 (section 3), and it is designed to operate as a technical implementation of origin rules aligned with the Agreement that the Act references. The regulations contain multiple cross‑references to both the Customs Act and to provisions of the relevant trade Agreement, creating a layered legal interaction.

Dependency on definitions in the Act. Section 4 of the instrument adopts definitions by reference to subsection 153ZSB(1) of the Act for key terms such as Agreement, Australian originating goods, certificate of origin, Harmonized System, non‑originating materials, originating materials, production, territory of Australia and territory of the United Arab Emirates. That means the regulations cannot be read in isolation; their practical application is conditioned on the Act’s defined meanings. Any interpretive rulings or legislative amendment altering those definitions in the Act will change the regulations’ application.

Interaction with the Australia‑UAE Agreement and GATT valuation rules. Where valuation specifics fall beyond domestic statute, the regulations defer to international instruments. Section 8(2)(a)(ii) instructs that if the price paid at importation cannot be determined, the value must be worked out in accordance with the Agreement on Implementation of Article VII of GATT 1994. Sections 7(2) and 7(3) treat “profit” and “other costs” as having the same meaning as in Article 3.4 of Chapter 3 of the Agreement. Those cross‑references mean that international valuation and costing definitions in the Agreement and GATT instruments will be applied by Australian customs authorities when interpreting the regulations.

Relation to Schedule 1 of the Customs Amendment (Australia‑United Arab Emirates Comprehensive Economic Partnership Agreement Implementation) Act 2025. The instrument’s commencement is conditional on Schedule 1 to that Amendment Act commencing (section 2(1)(b)). The regulation therefore forms part of a package of implementing measures. Operational timing and legal effect for users will depend on when that Schedule commences alongside registration of this instrument.

Integration with customs valuation and classification regimes. The formulas in Parts 3 rely on customs value as defined by Division 2 of Part VIII of the Act. The instrument therefore interacts with the broader customs valuation framework in the Act, so customs valuation rules and precedents under Part VIII will inform QVC outcomes. Likewise, repeated obligations to produce evidence of Harmonized System classification make the HS classification rules and any associated administrative practices under the Act immediately relevant to the instrument’s operation.

Record‑keeping and compliance framework. The record obligations are applied “for the purposes of subsection 126ASB(1) of the Act” (sections 11 and 12). That cross‑reference integrates the regulations into the Act’s existing documentation and disclosure regime, meaning the Act’s timelines, procedural powers to inspect records and to require production, and any criminal or civil penalties for false or misleading statements will apply.

No contradictory domestic law override is contained. The instrument does not state any inconsistency with other Australian statutes beyond the Act. It therefore functions as a regulation under the Act and must be read alongside existing Australian legal frameworks that regulate trade documentation, taxation of exports and imports, and customs administration. For the operational user, the key interaction points are the referenced Act subsections and the Agreement terms the regulations import by reference.

The instrument contains an internal commencement table and a note about amendments to the published version, but no entries recording prior amendments to its substantive provisions. Key points in the instrument about amendment or status are as follows.

Original instrument and commencement. Section 1 names the instrument as the Customs (United Arab Emirates Rules of Origin) Regulations 2025. Section 2 contains a commencement table stating that the whole instrument commences on the later of the day after registration and the day Schedule 1 to the Customs Amendment (Australia‑United Arab Emirates Comprehensive Economic Partnership Agreement Implementation) Act 2025 commences. The table includes the specific date 1 October 2025 in Column 3, with a note that paragraph (b) applies; this indicates the intended operational date if Schedule 1 has commenced by that date. Section 2 also includes a standard editorial note that the table relates only to the instrument as originally made and will not be amended in the instrument text to reflect later changes.

Authority for amendment. Section 3 states that this instrument is made under the Customs Act 1901, which is the statutory instrument that empowers the creation and amendment of regulations of this kind. Any future change to these regulations would therefore require exercise of the enabling power in the Customs Act or amendment legislation.

No recorded in‑text amendments. The text presented contains no later amendment schedule, no substitution notes and no marginal notes indicating subsequent legislative or regulatory changes. The instrument includes the statutory caveat that information in Column 3 of the commencement table is not part of the instrument and may be edited in published versions (s2(2)), which is a publication practice rather than a substantive amendment mechanism.

Implied amendment route. Because the regulations operate by reference to the Act and to the Agreement, amendments to the Act (for example, to subsection 153ZSB(1) definitions) or to the implementing Schedule of the Customs Amendment Act could necessitate corresponding amendments to the regulations to preserve consistency. The instrument itself does not record any such amendments.

Practical note for users. As the instrument sets out detailed technical rules, any future amendment to relevant Act provisions, international Agreement language incorporated by reference, or to administrative guidance under the Act may materially change obligations. Users should monitor statutory amendments to the Customs Act and any administrative instruments or guidance associated with Schedule 1 to the Customs Amendment Act cited in the commencement provision. The instrument contains no historical amendment log or transitional provisions beyond the commencement dependence on the Amendment Act’s Schedule 1.

The text of these regulations does not record any litigation history. There are no judicial determinations, tribunal decisions or litigation annotations included within the instrument itself.

What the instrument documents. It is purely a made regulation, dated 21 August 2025, signed by the Governor‑General and an Assistant Minister (the administrative signatures at the head of the text). It contains no notes, footnotes or schedules asserting the existence of precedent litigation or judicial interpretation. The instrument therefore carries no embedded case law.

Implication for practitioners. Because the instrument does not reference or summarise any litigation, practitioners must rely on the primary statutory text here and on the Customs Act for interpretive questions. Any case law that would interpret the Customs Act provisions cited (for example, subsection 153ZSB(1), 153ZSE or 126ASB(1)) or that relates to customs valuation, HS classification or origin determinations must be located and analysed separately from this instrument. This regulation will be subject to interpretation in administrative and judicial proceedings in the future as disputes arise, but none are recorded here.

Monitoring and evidence planning. Since no litigation history is provided, exporters, producers, customs brokers and advisers should assume that contested interpretation of valuation options, inclusion/deduction of costs, the meaning of profit and other costs as imported from the Agreement, and the application of the tariff change chain in section 5 are likely areas for disagreement. Practitioners should prepare contemporaneous records that align with the statutory text in anticipation that disputes may be resolved by administrative review or judicial process under the Customs Act.

No administrative guidance annexed. The instrument does not include an explanatory memorandum or administrative guidance text within the provided materials. Any administrative guidance, internal instruction to customs officers, or published explanatory materials that might influence compliance expectations or enforcement approach are not part of this regulation as presented.

Several operational pitfalls arise from the text that can produce compliance failure, mismatches across a supply chain, or unintended valuation consequences. These are concrete, textual risks and decision points to watch.

Choice points create divergent outcomes. The regulations permit alternative choices at multiple junctions: QVC may be calculated by build‑down or build‑up methods and each method may be based on customs value or ex‑works price (sections 6 and 7). Importers of materials acquired in the UAE choose among three valuation options (s8(2)(b)). Those choices can produce materially different QVC outcomes, thereby affecting whether goods meet origin thresholds. Firms must document the commercial rationale for their choice and ensure consistency across transaction documents, because customs auditors will scrutinise inconsistent choices.

Importer choice impacts producer outcomes. Section 8(2)(b) vests the importer of goods with the right to choose the valuation method for materials acquired in the UAE. That choice is not directly controlled by the Australian producer, yet it affects the value the producer can count as originating materials. Producers selling to multiple importers in the UAE may face diverging valuation bases and consequent compliance complexity. Producers need contracts and data flows that capture and lock in the importer’s valuation choice where practical.

Freight and cost inclusion/deduction can be counterintuitive. The instrument requires that costs incurred in international shipment be included when valuing materials imported into the UAE (s8(3)). By contrast, section 8(5) permits deduction of freight, insurance, packing and similar costs for non‑originating materials. Practically, reconciling these two rules requires careful accounting: include shipping costs for imported materials as part of their value, but then deduct certain transport and other costs for non‑originating materials when relevant. Misallocation can produce calculation errors or lead to perceived over‑statement of non‑originating material value.

Profit and other costs are imported from the Agreement. Sections 7(2)-(3) treat “profit” and “other costs” as having the meaning in Article 3.4 of Chapter 3 of the Agreement. The regulation does not define these terms. Practitioners must therefore consult the Agreement’s Article 3.4 text to determine how to treat these line items. If advisers or producers apply a domestic or industry practice inconsistent with the Agreement definition, customs may challenge the QVC computation.

Recursive tariff‑change provision requires chain evidence. Section 5 allows recursive applications so that a non‑originating material produced in the UAE from other non‑originating materials can be taken to satisfy a tariff change if each constituent non‑originating material satisfies the change. That is a useful chain rule, but it requires documentary proof at each stage that the constituent materials satisfy the relevant classification changes. Absent such chain documentation, the producer cannot rely on s5. This creates a documentary burden across suppliers and stages of production.

Different record retention start dates and triggers. For exporters who are not producers, records must be kept for at least five years starting on the date the certificate of origin is issued (s11(2)). For producers, the five‑year period starts on the date the certificate of origin is signed (s12(2)). Depending on the timing and signature process, retention periods can differ. Firms must align retention policies with the applicable start date for their role.

HS classification evidence requirement. Both producers and exporters must keep evidence of the classification of goods and materials under the Harmonized System (ss11(1)(d), 12(1)(e)). Classification disputes are a common origin audit trigger. Firms should maintain classification rulings, internal classification memoranda and supporting technical data to defend HS positions.

Electronics and translation requirements. If records are not in English, they must be kept in a place and form that permits an English translation to be readily made (ss11(3)(b)(ii), 12(3)(b)(ii)). If records are kept electronically they must be readily convertible into a hard copy in English (ss11(3)(b)(iii), 12(3)(b)(iii)). Failure to ensure translation or conversion capability will impede verification and can lead to administrative adverse findings.

Packaging and accessories included only when Act conditions met. Sections 9 and 10 require inclusion of accessories/packaging only if the specified paragraphs of the Act are satisfied (153ZSF(1)(a)-(c) or 153ZSH(1)(a)-(b)). Practically, this means firms must determine whether those Act thresholds apply before deciding on inclusion; errors here can lead to over‑ or under‑inclusion in QVC.

No penalty detail in the regulation. The instrument does not list penalties. Practitioners must therefore map potential enforcement actions to the Act (for example, consequences for inadequate records or false statements under the Act). Not understanding that linkage can create surprises when a customs audit escalates to formal sanctioning.

Administrative evidence trail. The instrument requires copies of the certificate of origin be kept by both exporter and producer (ss11(1)(i), 12(1)(l)). Firms must ensure they obtain and retain the certificate at the time of export; failure to do so undermines the five‑year retention claim and complicates retrospective proof of origin.

This section sets out a concrete compliance checklist and practical steps for producers, exporters and importers to align operations with the regulatory text.

1. Choose and document QVC method and basis

• Decide whether to use the indirect (build‑down) method (s6) or direct (build‑up) method (s7) for each product line. Each method offers two bases: customs value (Division 2 of Part VIII of the Act) or ex‑works price (as defined in subsection 153ZSB(1) of the Act). Record the decision and the business rationale, dated and signed by an authorised person. QVC must be expressed as a percentage (s6(4), s7(4)).
• Maintain working papers showing the calculation using both numerator and denominator elements set out in the formulas (for example, value of non‑originating materials for build‑down; value of originating materials, direct labour, direct overhead, profit and other costs for build‑up).

2. Establish value calculation procedures per section 8

• For materials imported into the UAE by the producer, record and retain the price paid or payable at the time of importation (s8(2)(a)(i)). If such price cannot be determined, have procedures to value materials under the Agreement on Implementation of Article VII of GATT 1994 as required by s8(2)(a)(ii).
• For materials acquired in the UAE, ensure the importer makes a documented selection among the three options in s8(2)(b)(i)-(iii): price paid by producer, the value as if imported (per s8(2)(a)), or the earliest ascertainable domestic price. Capture the importer’s election in contractual terms, invoices or a written declaration and retain the evidence.
• For materials produced by the producer, keep full cost rollups that capture all production costs and an applied profit equivalent as required by s8(2)(c). The methodology for profit should be consistent with the text in s8(2)(c)(ii).

3. Account for transport, duties, taxes and waste properly

• Include costs incurred in international shipment when calculating the value of materials imported into the UAE (s8(3)).
• For originating materials, you may include freight, insurance, packing and other transport costs, duties, taxes and brokerage fees to the extent not already included (s8(4)(a)-(b)), and include waste/spoilage costs less the value of reusable scrap (s8(4)(c)).
• For non‑originating materials, ensure appropriate deductions of freight, insurance, packing and duties/taxes where allowed by s8(5). Keep supporting freight invoices and duty receipts to substantiate deductions.

4. Treat accessories, spare parts and packaging according to Act triggers

• Check whether the Act paragraphs 153ZSF(1)(a)-(c) (accessories/spare parts/tools/information materials) or 153ZSH(1)(a)-(b) (packaging) apply. If they do, include these items in QVC calculations and treat them as originating or non‑originating materials according to their status (ss9-10). Keep separate purchase and production records for these items (ss11(1)(e)-(h), 12(1)(h)-(k)).

5. Implement record keeping and retention systems

• For exporters who are not producers, maintain records listed in s11(1): purchase records of the goods, purchase records of the buyer (person exported to), evidence of payment, HS classification evidence, accessory/packaging records as applicable, and a copy of the certificate of origin. Retain for five years from date certificate issued (s11(2)).
• For producers, maintain the broader set of records set out in s12(1): purchase records for goods and materials, HS classification evidence, evidence of values, production records, records relating to accessories/packaging, and the certificate of origin. Retain for five years from the date the certificate is signed (s12(2)).
• Ensure records are stored in a form that allows determination whether goods are Australian originating goods (s11(3)(b)(i), 12(3)(b)(i)). If records are not in English, keep them where an English translation can be readily made (s11(3)(b)(ii), 12(3)(b)(ii)). If electronic, make sure files are readily convertible to hard copy in English (s11(3)(b)(iii), 12(3)(b)(iii)).

6. Lock in importer valuations contractually

• Because s8(2)(b) vests the importer with a valuation choice for materials acquired in the UAE, negotiate and document valuation method selection in sales contracts, purchase orders or invoices. Require the importer to provide a written election or declaration with supporting invoices to avoid downstream disputes for origin claims.

7. Standardise HS classification evidence practices

• Maintain a classification file for each tariff classification relied upon, including technical specifications, internal classification memoranda, and, where available, official binding rulings or prior decisions. Section 11(1)(d) and 12(1)(e) explicitly require HS classification evidence.

8. Prepare profit and other costs methodology aligned to the Agreement

• Because profit and other costs are defined by Article 3.4 of Chapter 3 of the Agreement (s7(2)-(3)), adopt a documented methodology mapping domestic cost categories to the Agreement’s definitions. Retain calculation worksheets, allocation keys and supporting ledgers.

9. Ensure certificate of origin processes are robust

• Keep a copy of every certificate of origin issued or received and link it to the related production and valuation files (ss11(1)(i), 12(1)(l)). Track the date the certificate is issued or signed to trigger the five‑year retention clock.

10. Audit trail and internal review

• Implement internal compliance reviews to test QVC calculations under both allowed bases (customs value and ex‑works) and both allowed methods. Keep review minutes, corrective adjustments and decision sign‑offs to demonstrate good faith and diligence in any future verification.

11. Cross‑border document retrieval and translation plan

• If records are stored outside Australia, maintain a local index and a plan for producing English translations and hard copies on short notice as required by s11(3) and s12(3). Ensure service agreements with overseas affiliates or third parties include contractual commitments to produce translation and hard copy within a specified timeframe.

12. Scenario planning for multi‑stage production chains

• Where s5’s recursive tariff change rule is to be relied upon, obtain supplier certifications and production documentation at each stage to demonstrate that non‑originating materials were produced entirely in the UAE (or UAE and Australia) from other non‑originating materials that satisfy the tariff change. Keep supplier attestations and production records to substantiate recursive application.

13. Engage customs and trade advisers early

• Because the regulations rely on definitions and valuation methods in the Act and the Agreement, involve customs counsel or trade specialists to interpret cross‑references (for example, GATT Article VII and Article 3.4 of Chapter 3 of the Agreement) and to ensure calculations and record sets will satisfy administrative verification.

14. Review and update compliance on a periodic basis

• Given the instrument’s dependency on the Customs Act definitions and the referenced Agreement, periodically review that internal policies align with any changes to the Act, the Agreement, guidance issued by the administering authority, or to Schedule 1 of the implementing Amendment Act on which commencement depends.

Adhering to these steps will create a traceable, auditable compliance posture in line with the regulations’ prescriptions and the connected statutory framework of the Customs Act.
